(viii) Evaluation Factors for Award
RFO 52.215-1(f) applies to this acquisition and is amended as follows:
(a) This is a competitive best value – trade off acquisition following source selection procedures in accordance with (IAW) Revolutionary FAR Overhaul (RFO) Part 15. The Government intends to award to an 8(a) Small Business.
(b) The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
(1) Price
(2) Technical
(3) Past Performance
Technical and Past Performance are significantly more important than price.
(c) A written notice of award or acceptance of an offer, emailed or otherwise furnished, to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract.
Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Basis for Contract Award: This is a competitive best value source selection in which competing offerors technical and past performance history will be evaluated on a basis significantly more important than price. By submission of its offer in accordance with the instructions provided in RFO 52.215-1, Instructions to Offerors, the offeror accedes to the terms of this solicitation, and all such offers shall be treated equally except for their prices and performance records. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
i. Price Evaluation. Initially, offers will be ordered according to price, from lowest to highest. The Total Evaluated Price (TEP) will be calculated by adding the base year price, plus all option year prices.
For price evaluation purposes, the Government will calculate an evaluated price for the RFO 52.217-8 six-month extension by pro-rating the Offeror’s proposed price for Option Year 4 to a six-month period.
This amount will be included in the Total Evaluated Price. Should the Government later exercise this option, the actual price will be determined by the contract prices in effect at the time of exercise, in accordance with RFO 52.217-8.An offeror’s proposed prices will be determined by multiplying the quantities by the unit prices identified in Attachment 3 – JB Custodial Bid Schedule for each item to confirm the extended amount for each line item. All sub-totals will then be added to confirm the total for the base and all option periods.
ii. Technical. For a proposal to be considered Technically Acceptable, it must satisfy two conditions: it must first receive an “Acceptable” rating on the Mission Essential Services Plan and then receive an “Acceptable” rating on Key Personnel.
The Government will first review the Offeror’s Mission Essential Services Plan on a “Accetpable” or “Unacceptable” basis. The purpose of this evaluation is to determine compliance with the requirements set forth in R-DFARS 252.237-7024, Notice of Continuation of Essential Contractor Services. To receive an “Acceptable” rating, the submitted plan must include and address all required elements outlined in the aforementioned R-DFARS clause. Proposals that receive an “Acceptable” rating will proceed to the second part of the Technical Evaluation. A proposal that fails to meet these requirements will be rated as “Unacceptable” and will not be considered further for award.
For proposals that receive an “Acceptable” rating on the Mission Essential Services Plan, the Government will then evaluate the proposed Key Personnel on an “Acceptable” or “Unacceptable” basis. This evaluation will assess the extent to which the proposed individuals possess the relevant qualifications, experience, and skills necessary to ensure successful contract performance.
To receive an “Acceptable” rating, the proposal must demonstrate a comprehensive and well-qualified team for the positions of On-site Project Manager, Quality Control Manager, and at least (1) Lead Supervisor. The Government will evaluate the depth and relevance of each individual’s experience on projects of similar size, scope, and complexity to include but not limited to: Total-Square Feet, Geographically Separated Sites, Multiple Shifts, Periodic Floor Cleaning Services, Quality Control Plan (QCP), Number of Level of Services, Fitness Centers, Secure facilities requiring additional access requirements or escorts, Provide Restroom Supplies, Total Number of Facilities, Child Development and Youth Centers, Mission Essential Services, and Replacing Restroom Dispensers. The assessment will also analyze the evidence provided of successful past performance and consider the value of any professional education, training, and certifications, particularly how these credentials relate to the successful execution of the required services. A proposal will be rated “Acceptable” only if it clearly and convincingly articulates how the unique background and expertise of each proposed individual will be leveraged to ensure high-quality service delivery.
A proposal that receives an “Acceptable” on the Mission Essential Services Plan and an “Acceptable” rating for Key Personnel will be considered Technically Acceptable and will advance to the Past Performance evaluation factor. A proposal that receives an “Unacceptable” rating for Key Personnel will not be considered further for award.
iii. Past Performance. Beginning with the lowest priced, technically acceptable offer, the contracting officer will seek recent and relevant performance information on all offers based on (1) the references provided by the offeror, (2) completed Past Performance Questionnaires, and (3) data independently obtained from other government and commercial sources.
Recent is defined as performance during the preceding three years from the date of issuance of this solicitation.
Relevant past performance includes performance of efforts providing management, tools, equipment, and labor for Custodial Services that involved similar scope and magnitude of effort and complexity as this solicitation requires. The Government will evaluate key elements of past performance to include but not limited to: Total-Square Feet, Geographically Separated Sites, Multiple Shifts, Periodic Floor Cleaning Services, Quality Control Plan (QCP), Number of Level of Services, Fitness Centers, Secure facilities requiring additional access requirements or escorts, Provide Restroom Supplies, Total Number of
Facilities, Child Development and Youth Centers, Mission Essential Services, and Replacing Restroom Dispensers.
The purpose of the past performance evaluation is to allow the government to assess the offeror’s probability of meeting the solicitation requirements based on the offeror’s demonstrated past performance.
The assessment process will result in an overall performance confidence assessment of Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence as defined in the table below.
Table 1. Past Performance Evaluation Rating Method
Rating Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Past performance regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will not be rated as highly as past performance information for the principal offeror. Offerors with no recent/relevant performance history or if the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned shall receive the rating of “Neutral Confidence," meaning the rating is treated neither favorably nor unfavorably. Substantial and Satisfactory confidence are considered higher performance confidence assessments than Neutral confidence.
In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation. The following table describes past performance relevancy ratings.
Table 2. Past Performance Relevancy Ratings Ratings Definitions Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
As described above, the Government intends to first order all proposals by price. Starting with the lowest priced proposal, the government will evaluate that offeror’s technical proposal, and if rated technically acceptable, the government will then perform a Past Performance Confidence evaluation. If the lowest priced evaluated offer is judged to be technically acceptable, and receives a “Substantial Confidence” rating, then that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.
If the lowest priced, technically acceptable offeror is not judged to have a “Substantial Confidence” rating, the next lowest priced offeror will be evaluated, and the process will continue (in order of price lowest to highest) until an offeror is judged to be technically acceptable and have a “Substantial Confidence” rating or until all offerors are evaluated. The Source Selection Authority shall then make an integrated best value determination. Based on the integrated best value determination the government will make an award to the proposal providing the best value to the government.
