About this file
This is a Civil Litigation History Certification form required for bid submission to the Rose Bowl Operating Company (RBOC) for a Construction Manager at Risk (CMAR) position on the Plumbing Infrastructure Enhanced Maintenance Project in Pasadena, California. Bidders and proposers must disclose any civil litigation history arising from construction contract performance within California during the five to ten years preceding bid submittal. The certification requires identification of the bidder/proposer, any officers, managers, or owners with ownership interests, and the qualifying person licensed by the State Contractors' License Board. Litigation disclosure requirements exclude cases limited solely to enforcement of mechanics' liens or stop notices. Bidders must either complete the certification stating no civil litigation history exists or provide detailed information regarding each case, including the case name, court identification number, jurisdiction, and litigation outcome.
Failure to provide the certification or information may result in a determination of non-responsiveness, while incomplete or inaccurate submissions may lead to a determination that the bidder is not responsible. The certification must be executed under penalty of perjury by the owner, officer, manager, or licensee responsible for bid submission. The RBOC seeks a CMAR with directly relevant wet-utility experience, expertise in open-cut main replacement and trenchless sewer rehabilitation, experience managing live event-window phasing in occupied venues, subsurface risk management capabilities, financial strength, a strong safety record, and commitment to local Pasadena-based subcontractors and workforce development.
