About this file
This interoffice memorandum, dated July 29, 2026, documents liquidated damages provisions for a contract managed by the Orange County Transportation Authority (OCTA) in California for the procurement of two hydrogen mobile fuelers to service 40-foot hydrogen fuel cell buses. The project budget is $5,872,800 for an initial one-year term. The memorandum, prepared by Senior Section Manager Sunil Chettiar for Senior Contracts Administrator Ellis Hoskin, establishes specific performance requirements and remedies related to Requisition No. R002501.
The liquidated damages clause specifies that the Contractor shall be assessed $250 per bus per day if the mobile fueling station becomes inoperable or unable to provide fuel for any period exceeding the initial twenty-four (24) consecutive hours. The maximum liability is capped at 15 buses, meaning potential damages do not exceed $3,750 per day. The $250 daily rate per bus is calculated based on 2.5 hours of staff time per bus, comprising approximately 1.5 hours for travel and fueling activities and 1.0 hour for administrative duties including fuel logging, fuel transaction reconciliation, and related documentation, valued at $100 per hour.

INTEROFFICE MEMO
July 29, 2026
To: Ellis Hoskin, Senior Contracts Administrator
From: Sunil Chettiar, Senior Section Manager
Subject: Requisition No. R002501 - Hydrogen Mobile Fuelers for 40-
Foot Hydrogen Fuel Cell Buses
The liquidated damages are $250 per bus per day.
In the event the mobile fueling station is inoperable or otherwise unable to provide fuel for any reason beyond the initial twenty-four (24) consecutive hours, the Contractor shall be assessed liquidated damages in the amount of Two Hundred Fifty Dollars ($250.00) per day per bus, not to exceed 15 buses.
The basis for this amount is two and one-half (2.5) hours of staff time per bus per day, consisting of approximately one and one-half (1.5) hours for travel and fueling activities and one (1) hour for administrative duties, including fuel logging, reconciliation of fuel transactions, and related documentation.
Calculation:
2.5 hours × $100/hour = $250 per bus per day.
