About this file
This is an Environmental Resource Permit Modification issued by the Florida Department of Environmental Protection (FDEP) Central District Office to Brevard County Natural Resources Management Department for the Indian River Lagoon Muck Removal Area 1A project. The permit modification authorizes the installation of an additional pipeline to support hydraulic dredging operations in Area 1A of the Indian River Lagoon, adjacent to the Eau Gallie River and Eau Gallie Causeway. The original permit (368832-001-EI), issued on October 26, 2018, authorized the removal of approximately 812,650 cubic yards of organic-rich fine-grained sediment from about 241 acres. The modification, issued on August 13, 2021, extends the construction expiration date from October 26, 2023, to October 26, 2028, providing an additional five-year completion timeline. The permit does not alter the specific or general conditions of the original authorization, and no wetland, surface waters, or floodplain impacts are authorized by this modification.
The permit includes specific conditions requiring compliance with the Standard Manatee Conditions for In-water Work (2011), with mandatory presence of a dedicated manatee observer during dredging operations. Observers must have prior on-the-job experience with manatee observation during similar dredging activities. The permit specifies that hydraulic dredging methods must be used exclusively, and mooring fenders providing three to four-foot standoff distance under maximum compression must be used between barges to reduce potential crushing incidents involving manatees. General conditions require immediate cessation of work and notification to the Florida Department of State, Division of Historical Resources, if any prehistoric or historic artifacts or unmarked human remains are encountered during project activities. The permit is authorized under state-owned submerged lands authorization, with potential additional requirements from the Army Corps of Engineers. The authorization was granted based on the determination that the proposed modification would not result in adverse environmental impact or water quality degradation.

Permit No.: 368832-002-EM
Permittee: Brevard County
Project: Indian River Lagoon Pipe Line Addition & Time Extension
Dear Mr. Culver:
The request to modify the above referenced permit has been received and reviewed by
Department staff. The permittee is authorized to install a pipeline to dredge Area 1A as depicted on the attached exhibits. In addition, the construction expiration date of 368832-001-EI is changed from October 26, 2023 to October 26, 2028.
There are no wetland, surface waters nor floodplain impacts authorized.
Specific Condition – Manatees
In order to satisfy the requirements of 379.2431(2) and 373.414(1)(a)2, Florida Statute; the
Florida Fish and Wildlife Conservation Commission recommends that the activities authorized by this permit modification be performed in accordance with the following recommendations:
• The Standard Manatee Conditions for In-water Work (2011) shall be followed for all in-water activity.
• An observer shall be present when dredging is being performed and shall be dedicated to the task of observation (perform no other duties that may interfere with their ability to observe for manatees). Observer(s) must have prior on-the-job experience observing manatees during previous dredging work where the activities were similar in nature to this project. Movement of a work barge or other associated vessels shall be minimized to the greatest extent possible at night.
• Dredging shall be performed by hydraulic dredging methods. To reduce the potential of crushing manatees between vessels, mooring fenders that provide a three to four-foot standoff distance under maximum compression shall be used between barges, or between a barge and tugboat, if used.

General Condition – Division of Historical Resources
• If prehistoric or historic artifacts, such as pottery or ceramics, projectile points, dugout canoes, metal implements, historic building materials, or any other physical remains that could be associated with Native American, early European, or American settlement are encountered at any time within the project site area, the permitted project shall cease all activities involving subsurface disturbance in the vicinity of the discovery. The applicant shall contact the Florida Department of State, Division of Historical Resources, Compliance Review Section at (850) 245-6333. Project activities shall not resume without verbal and/or written authorization. In the event that unmarked human remains are encountered during permitted activities, all work shall stop immediately and the proper authorities notified in accordance with Section 872.05, Florida Statutes.
Permitting History

This permit modification changes the 368832-001-EI permit construction expiration date from October 26, 2023 to October 26, 2028. This permit modification does not alter the
