About this file
This is a lease agreement between the Florida Inland Navigation District (FIND) as the Landlord and the Board of County Commissioners of Brevard County, Florida as the Tenant, for the Eau Gallie Muck Removal Project. The lease covers the DMMA BV-52 property located in Palm Bay, Brevard County, and is effective from the date of execution until December 31, 2026, with an option for the Tenant to renew the lease. The project involves dredging approximately 812,650 cubic yards of muck from about 241 acres of the Indian River Lagoon, with the initial dredge project area consisting of 376,000 cubic yards from Area 1A. The lease allows the Tenant to use the property exclusively for the dewatering and temporary storage of dredged materials generated by the project.
The lease requires the Tenant to perform various site remediation and management activities, including vegetation removal, perimeter ditch restoration, grassing, and environmental monitoring. The Tenant must submit multiple plans for approval, including a dredging and dredged material management facility plan, a baseline sampling plan, and a site restoration plan. The Tenant is responsible for obtaining necessary permits, conducting environmental surveys (including a gopher tortoise survey), and performing groundwater and surface water monitoring. Financial terms include the Tenant performing site remediation work in lieu of paying rent, and the Tenant must provide a performance bond of $100,000 and maintain comprehensive insurance coverage with a minimum of $20 million in combined single limit liability protection.
