About this file
This is a Bid Bond form issued by the State of Colorado, Office of the State Architect, State Buildings Programs, for the Colorado Department of Corrections Facilities Management Services. The project involves HVAC replacement for YOS Building 7 (Project No. YOS1601). The bid bond serves as a proposal guaranty requirement for contractors submitting proposals for this project. Bidders are required to maintain their proposals in full force and effect for thirty days following the opening of proposals. Should a bidder's proposal be accepted, the contractor must execute the required agreement, furnish performance and labor/material payment bonds, provide insurance documentation and certificates, and submit certification and affidavit regarding illegal aliens within the prescribed timeframe.
The bid bond guaranty amount is set at five percent of the principal's total bid price, which constitutes liquidated damages in the event of default. The bond must be executed by a corporate officer (President or Vice President) with attestation by the Secretary and proper corporate seal if the principal is a corporation, or properly signed if an individual or partnership. Critically, the bid bond must be accompanied by a properly executed Power of Attorney with an effective date; failure to provide both documents will render the bidder's proposal non-responsive. The surety, a corporation authorized to conduct business in Colorado, is jointly and severally bound with the principal under the terms of this obligation.
