About this file

This document is Bid Bond Preparation Instructions for West Virginia state procurement, specifically for the Chiller and Ventilation Maintenance contract opportunity. The instructions provide a standardized template and detailed guidance for bidders to prepare bid bonds required for submission with their proposals to the West Virginia Department of Administration's Purchasing Section. The bid bond serves as a guarantee that the bidder will enter into a contract if their bid is accepted and will furnish all required bonds, insurance, and performance obligations as specified in the solicitation documents.

The bid bond must be executed by the principal (bidder) and surety (bonding company) and submitted with the bid proposal. The minimum acceptable bid bond amount is 5 percent of the total bid amount, stated either as a percentage or specific dollar figure. The surety executing the bond must be licensed in West Virginia to transact surety insurance, must affix its corporate seal, and must attach a dated Power of Attorney with the surety's seal affixed. The bond conditions provide that the obligation becomes null and void if the bid is rejected or, if accepted, the principal enters into a contract and performs all obligations as required. The surety's liability is limited to the penal amount stated in the bond, and the surety waives notice of any extension of time for bid acceptance.
