Metal with LBP can be recycled as scrap metal.
Non‐recyclable debris should be tested or disposed of as hazardous waste.
Asbestos waste may be disposed of at a permitted municipal solid waste landfill.
For a landfill to accept the asbestos waste, it must be packaged in accordance with applicable EPA, OSHA, and MD requirements.
Lead‐based paint can be assumed to fail TCLP under RCRA (D008) and can be managed as hazardous waste, or the waste itself can be tested. Maryland has authorization for RCRA. Metal with LBP can be recycled.

The intent of this inspection was to locate, identify and quantify ACM, LBP and universal wastes that will be impacted during the upcoming project.
Michael Johnson and Alexander Smolyar performed this survey on July 29, 2019. Michael Johnson is a certified Asbestos Inspector and Designer, and USEPA-certified Lead Risk Assessor (LBP-R- I198619-1). Alexander Smolyar certified Asbestos Inspector, and USEPA-certified Lead Risk Assessor (LBP-R-129050-1).

2.0 ASBESTOS FIELD INVESTIGATION PROCEDURES AND SAMPLE ANALYSIS
METHODS
Guidelines used for the inspection were established by the Environmental Protection Agency (EPA) in the Guidance for Controlling Asbestos Containing Materials in Buildings, Office of Pesticides and Toxic Substances, Doc 560/5-85-024, and 40 CFR Part 763, Asbestos Hazard Emergency Response Act (AHERA).
Field information was organized in accordance with the AHERA methodology of homogenous area (HA). During the survey, reasonable effort was made to identify all locations and types of ACM materials associated with the scope of work. Sampling has included multiple samples of the same materials with locations chosen at random. However, due to inconsistencies of a manufacturer's processes and the contractor’s installation methods, materials of similar construction may contain various amounts of asbestos. Furthermore, some materials that were not originally specified to contain asbestos may in fact contain this mineral.
Bulk samples of suspect ACM were analyzed using polarized light microscopy (PLM) coupled with dispersion staining, as described in 40 CFR Part 763 and the National Emissions Standard for Hazardous Air Pollutants (NESHAPS). NESHAPS is the standard industry protocol for the determination of asbestos in building materials. A suspect material is immersed in a solution of known refractive index and subjected to illumination by polarized light. The color displays that result are compared to a standardized atlas whereby the specific variety of asbestos is determined. It should also be recognized that PLM is primarily a qualitative identification method whereby asbestos percentage, if any, is estimated. While EPA regulations governing ACM consider materials containing greater than 1-percent as asbestos, accurately quantifying asbestos content below 5-percent has been shown to be unreliable.
The laboratory performing this analysis procedure was Atlas Environmental Lab, Corp., located at 255 W 36th Street Suite 1503, New York, NY 10018. The laboratory has received accreditation from the following agencies:
National Voluntary Laboratory Accreditation Program (Lab Code 500092-0) American Industrial Hygiene Association Accredited Laboratory (Lab No. 208306)

2.4 SAMPLE ANALYSIS TABLE
Laboratory analysis results, in tabular form, are included in Appendix A.
2.5 AREAS NOT ACCESSIBLE
At the time of inspection, Berger’s inspection team was not able to access the ceiling plenum in the Men’s and Women’s Bathroom at Antietam Visitor Center.
3.0 LEAD FIELD INSPECTION PROCEDURES
The lead-based paint inspection is an interior and exterior investigation to identify all lead-based paint on a surface-by-surface basis by paint chip sampling methodology.
Louis Berger Page 15 December 02, 2019
The lead in soil inspection consisted of collecting composite soil samples from bare soil in the dripline/foundation area or the building. Soil samples were collected with a scooping technique.
Soil samples was collected up to a depth of approx. ½ inches, following the US EPA HUD (US Dept. of Housing and Urban Development) Scoop Sampling Guidelines (Appendix 13.3).
The lead regulatory levels provided below are those used when preparing this lead-based paint evaluation or when evaluating data collected.
EPA Levels
Lead-Based Paint Guideline for Maryland Equal to or less than 0.7 mg/cm2
The laboratory performing this analysis procedure was Atlas Environmental Lab, Corp., located at 255 W 36th Street Suite 1503, New York, NY 10018. The laboratory has received accreditation from the following agencies:
National Voluntary Laboratory Accreditation Program (Lab Code 500092-0) American Industrial Hygiene Association Accredited Laboratory (Lab No. 208306)

3.5 CONCLUSIONS AND RECOMMENDATIONS
Various Lead-based Paints have been identified in our inspection effort.
Any work which disturbs painted surfaces containing lead shall be performed, and waste managed and transported in accordance with the Occupational Safety and Health Administration (OSHA), 29 CFR 1926.62 (Lead in Construction Standard), and EPA’s 40 CFR 745 regulation, and New York State 6 NYCRR 364. Personal air monitoring should be conducted when disturbing lead based paints and lead containing materials as per 29CFR1926.62 (OSHA).
Prior to any excavation activities, a site-specific health and safety plan (HASP) must be submitted by Contractor which will meet the requirements set forth by the Occupational Safety and Health Administration (OSHA) and any other applicable regulations. The HASP should identify the possible locations and risks associated with potential contaminants that may be encountered and the administrative and engineering controls that will be utilized to mitigate concerns.
In addition, all waste generated as part of the project, regardless of the lead content in the paint, shall be tested in accordance with the EPA Resource Conservation and Recovery Act (RCRA) to determine the classification of the waste. Under RCRA, any waste material that when tested by Toxicity Characteristics Leaching Procedure (TCLP) results in a leachate lead concentration of five (5) parts per million or greater must be disposed of at an EPA licensed hazardous waste facility.
The finer renovation debris and paint chips that result from renovation of components with measurable quantities of lead can be tested by TCLP, or can be assumed hazardous waste and disposed of accordingly. If the scope of work is increased to include removal of actionable building components, we recommend that a TCLP test be performed on one typical component (e.g. metal, sheetrock, masonry, etc.) to determine proper disposal for all similar components.
Louis Berger Page 20
The incurred cost for disposal of lead based paint materials/debris may depend upon the TCLP results for materials/debris collected and the total weight of items which return TCLP results above the EPA allowed 5 parts per million.
The cost of the TCLP depends on the laboratory and location; but typically, a lead TCLP analysis may cost from $40 to $80. Any waste material that when tested by TCLP results in a leachate lead concentration of five (5) parts per million or greater must be disposed of at an EPA licensed hazardous waste facility. Cost of disposal may range for $5,000 to $7,000 per ton of waste.
5.0 UNIVERSAL WASTES
Universal Wastes (i.e., batteries, thermostats, lamps, ballasts, mercury-containing equipment, radioactive sources, CFCs) are regulated pursuant to the USEPA Universal Waste Requirements (40 CFR Part 273), and New York State 6 NYCRR Parts 370 series regulations. Similarly, these sampling procedures may also be used to determine disposal/management or clean-up options for Universal Wastes. Typical equipment that might contain universal wastes are emergency light batteries, CFC containing refrigerators, water fountains, mercury containing bulbs, thermostats and thermometers. Please see the below table itemizing the number of assumed universal wastes:

6.0 CONCLUSIONS AND RECOMMENDATIONS
Various ACM and LBP have been identified in our inspection effort that will be impacted by the upcoming site restoration project. These materials, reported in Section 2.0 and Section 3.0 of this report, will require complete abatement prior to the start of the project as per all…
