About this file
Attachment K is a Certification of Drug Free Workplace document related to a state procurement process in Florida, specifically addressing requirements for vendors submitting proposals to a state department. The document outlines a standard form that respondents must complete to certify they have implemented a comprehensive drug-free workplace program, which includes six key provisions such as publishing statements prohibiting controlled substance use, informing employees about drug abuse dangers, providing employees with written policy statements, requiring employees to notify employers of drug-related convictions, and imposing sanctions or rehabilitation requirements for employees convicted of drug offenses.
The form serves as a potential tiebreaker mechanism in the procurement process, where if the department receives equal proposals in terms of price, quality, and service, preference will be given to the respondent that has signed and submitted this certification in accordance with Section 287.087 of Florida Statutes. The document emphasizes that false statements are punishable under law, and requires the authorized representative of the responding vendor to sign, print their name, provide their title, and date the certification, thereby attesting to the full compliance with the drug-free workplace program requirements.

(4) In the statement specified in (1), above, notifying the employees that, as a condition of working on the commodities or contractual services that are being competitively procured, the employees will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 893 or of any controlled substance law of the United States or any State, for a violation occurring in the workplace no later than five days after such conviction.
(5) Imposing a sanction on or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted.
