About this file
This document is an addendum to FAR 52.212-2 that establishes the evaluation criteria and award methodology for the DLA Energy Aerospace – N204 Acquisition. The Government intends to make a single award of a Firm-Fixed-Price with Economic Price Adjustment (FP-EPA) contract to the offeror submitting the Highest Technically Rated Proposal with Fair and Reasonable Price (HTRO-FRP). The contract covers aerospace-grade N2O4 (nitrogen tetroxide) production in accordance with MIL-PRF 26539G with Amendment 1, dated April 19, 2017, and includes both fixed unit prices for commodity delivery (subject to Economic Price Adjustments) and a fixed monthly facility maintenance fee over a 10-year period of performance.
Technical evaluation will be conducted using four Comparative Technical Factors ranked by importance: Factor 1 – Production Capability and Technical Approach (most important), covering existing production capability, process maturity, quality assurance systems, testing methodology, and scalability; Factor 2 – Domestic Industrial Base and Supply Chain Resiliency (second most important), addressing U.S.-based manufacturing, domestic sourcing, supply chain stability, and long-term sustainability; Factor 3 – Safety and Environmental Compliance and Factor 4 – Domestic Capability Enhancement (equal in importance and less critical than Factors 1 and 2), evaluating OSHA compliance, EPA permitting, facility expansion, workforce development, and process innovation. Two Acceptable/Unacceptable factors include Factor 5 – Past Performance (rated Acceptable/Unacceptable/Neutral, with Neutral treated as Acceptable) and a Small Business Subcontracting Plan compliance requirement for large businesses per FAR 52.219-9. Price will not be scored, weighted, or used as a competitive discriminator during technical ranking. A Pre-Award Survey visit is required to evaluate production capabilities and readiness. Large business offerors must submit Solicitation Attachment L – DLA SB Subcontracting Plan Form, and all offerors must submit Solicitation Attachment H – Contractor Performance Data Sheet.

DLA Energy Aerospace – N204 Acquisition
ADDENDUM TO FAR 52.212-2: EVALUATION—COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (DEVIATION 2026 – O0038) (FEB 2026)
A. BASIS FOR AWARD
The Government intends to make a single award of a Firm-Fixed-Price with Economic Price Adjustment (FP-EPA) Requirements contract to the offeror submitting the Highest Technically Rated Proposal with a Fair and Reasonable Price (HTRO-FRP).
Award will be made to the offeror whose proposal is determined to provide the highest overall technical merit in accordance with the evaluation factors identified in this solicitation, provided the proposed price is determined to be fair and reasonable.
1. Technical Evaluation & Comparative Ranking Process:
The Government will conduct a comparative assessment of all received non-price (technical) proposals. The Government will evaluate the strengths, weaknesses, and risks of each proposal against the comparative Technical Factors (Factors 1 through 4).
Based on this evaluation and the stated relative importance of the factors, the Government will compare the technical proposals against one another to establish the order of technical ranking, from highest overall technical merit to lowest.
2. Elimination of Comparative Trade-offs between Technical Merit and Price:
The Government will not conduct a comparative tradeoff between technical merit and price. Price will not be scored, rated, weighted, or used as a competitive discriminator among offerors during the technical ranking process.
B. EVALUATION FACTORS
The Government will evaluate technical proposals against the following factors, categorized into Comparative Technical Factors and Acceptable/Unacceptable Factors:
Comparative Technical Factors (Used to establish Technical Ranking):
Factor 1 – Production Capability and Technical Approach:
• Existing operational, pilot, or prototype production capability
• Process maturity and technical controls
• Ability to meet aerospace-grade N2O4 in accordance with MIL-PRF 26539G with
Amendment 1, dated April 19, 2017.
• Quality assurance systems and lot traceability
• Testing methodology and reliability of production process
• Scalability and surge capacity
Factor 2 – Domestic Industrial Base and Supply Chain Resiliency:
• U.S.-based manufacturing footprint
• Domestic sourcing strategy and raw material availability
• Supply chain stability and redundancy
• Reduction of foreign dependency
• Long-term operational sustainability
Factor 3 – Safety and Environmental Compliance:
• OSHA compliance and process safety systems
• EPA and environmental permitting status
• Hazardous materials handling procedures
• Transportation safety and containment controls
• Emergency response capability
Factor 4 – Domestic Capability Enhancement:
• Facility expansion or production line development
• Transition from prototype to sustained production
• Capital investment in U.S. infrastructure
• Workforce development and retention
• Industrial base resiliency improvements
• Process innovation and modernization
• A Pre-Award Survey (PAS) visit is required to evaluate the Offeror's production capabilities and readiness.
(Must be rated "Acceptable" to be eligible for award):
Factor 5 – Past Performance:
The Government will evaluate past performance based on the degree of confidence the Government has in an offeror’s ability to deliver the service that successfully meets the requirement, based on a demonstrated record of performance. Past performance will be evaluated to assess the offeror’s relevant and recent aerospace, propulsion, or hazardous chemical experience, quality/schedule performance history, regulatory compliance, and contract management responsiveness. Offerors must submit Solicitation Attachment H – Contractor Performance Data Sheet.
Small Business Subcontracting Plan:
All offerors classified as a large business will be evaluated for compliance in accordance with FAR 52.219-9 (DEVIATION 2026-O0038) (FEB 2026). Offerors must submit Solicitation Attachment L – DLA SB Subcontracting Plan Form.
C. RELATIVE IMPORTANCE STATEMENT
The Comparative Technical Factors are weighed as follows:
Factor 1 (Production Capability and Technical Approach) is the Most Important factor.
Factor 2 (Domestic Industrial Base and Supply Chain Resiliency) is the Second Most Important factor.
Factor 3 (Safety and Environmental Compliance) and Factor 4 (Domestic Capability Enhancement) are Equal to each other and are less important than Factor 1 and Factor 2.
Because this acquisition utilizes a Highest Technically Rated Offeror with a Fair and Reasonable Price (HTRO-FRP) methodology, technical merit is the sole basis for establishing the competitive ranking of offerors. Acceptable/Unacceptable Factors (Factors 5 and 6) and Price are not weighted or combined with the Comparative Technical Factors.
D. ACCEPTABLE/UNACCEPTABLE EVALUATION AND PRICE EVALUATION
1. Acceptable/Unacceptable Evaluation Criteria:
Past Performance (Factor 5): Evaluated on an Acceptable / Unacceptable / Neutral basis. In accordance with FAR 15.202(c)(1), an offeror without a record of relevant past performance will receive a "Neutral" rating. For award eligibility, a "Neutral" rating is considered "Acceptable."
Small Business Subcontracting Plan: Evaluated on an Acceptable/Unacceptable basis.
2. Price Evaluation Parameters:
The Government will evaluate proposed prices to determine whether they are fair and reasonable using applicable FAR 15.404-1 price analysis techniques. The price evaluation will assess the total evaluated price across the 10-year period of performance, which includes both the fixed unit prices for N2O4 commodity delivery (subject to Economic Price Adjustments) and the fixed monthly facility maintenance fee (including any proposed Non-Recurring Engineering costs). The Government will also evaluate pricing to ensure it is not unbalanced.
