About this file

This is an affidavit attachment document for the Commonwealth of Kentucky establishing required certifications and attestations for bidders, offerors, and contractors seeking state contract awards. The document contains three separate affidavit forms that must be completed, notarized, and submitted by authorized representatives of contracting entities. The first affidavit requires contractors to attest under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provisions. This attestation is effective for one year from the date of execution, and the Commonwealth reserves the right to request updated affidavits at any time. The affidavit must include the contractor's name, address, vendor code if known, and notarization by a qualified notary public.

The second affidavit addresses resident bidder status claims and requires bidders to verify that they are authorized to transact business in Kentucky and have, for one year prior to contract advertisement, filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained a workers' compensation policy in effect. The third affidavit pertains to qualified bidder status and requires bidders and all subcontractors to attest compliance with qualified bidder requirements under 200 KAR 5:410(3) for the contract duration. Qualified bidder status includes nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor man hours. The bidding agency reserves the right to request supporting documentation for any status claims, with failure to provide documentation upon request resulting in bidder disqualification or contract termination.
