ATTACHMENT "B"

INSURANCE REQUIREMENTS

CONTRACTOR shall secure the type of insurance with the requirements and limits of liability specified in this Attachment.

Without limiting Contractor's indemnification, Contractor shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property which may arise from or in conjunction with the performance of the work hereunder by the contractor, his agents, representatives or employees. County shall retain the right at any time to review the coverage, form, and amount of the insurance required hereby. If in the opinion of the County's Risk Management Office the insurance provisions in these requirements do not provide adequate protection for County and for members of the public, County may require Contractor to obtain insurance sufficient in coverage, form and amount to provide adequate protection. County's requirements shall be reasonable but shall be imposed to assure protection from and against the kind and extent of risks that exist at the time a change in insurance is required.

Verification of Coverage

Contractor shall furnish the County with certificates evidencing coverage required above. Certified copies of required endorsements must be attached to provided certificates. All certificates are to be received and approved by the County before work commences. The County reserves the right to require that Contractor provide complete, certified copies of any policy of insurance offered in compliance with these specifications. As an alternative to insurance certificates, the Contractor's insurer may voluntarily provide complete, certified copies of all required insurance policies, including endorsements, effecting the coverage required by these specifications.

I. COMMERCIAL/COMPREHENSIVE GENERAL LIABILITY

Contractor shall carry a commercial/comprehensive general liability insurance policy, naming County as additional insured, providing protection against claims for bodily injury and property damage for premises and operations; personal injury for premises and operations, independent contractors (if any basis); incidental contracts, contractual liability; and products and completed operations. A "claims made" policy is not acceptable.

Minimum Limits: - $1,000,000 per occurrence for bodily injury, personal injury, or property damage, combined single limits, on an occurrence policy form; or

- $1,000,000 bodily injury or personal injury per occurrence;

and

- $1,000,000 property damage per occurrence; and

- $2,000,000 aggregate on an occurrence policy form.

II. PROFESSIONAL LIABILITY

(MALPRACTICE ERRORS AND OMISSIONS LIABILITY)

CONTRACTOR shall carry a professional liability insurance policy providing protection against legal liability arising out of an occurrence of malpractice, error, or mistake in rendering or failing to render professional services in the practice of the Contractor's profession.

Minimum Limits: - $1,000,000 per occurrence for bodily injury and personal injury; and

- $1,000,000 property damage per occurrence; and

- $3,000,000 aggregate

If such policy is provided on a "claims made" form, the retroactive date must be the date this agreement becomes effective or a date prior to the effective date of this agreement. The "claims made" tail coverage shall not be less than 365 days after the policy expiration. If coverage is cancelled or non-renewed, and not replaced with another claims made policy form with a retro date prior to the contract effective date, the Contractor must purchase "extended reporting" coverage for a minimum of one (1) year after completion of the contract. A copy of the claims reporting requirements must be submitted to the County for review.

III. WORKERS' COMPENSATION AND EMPLOYER'S LIABILITY

CONTRACTOR shall carry an insurance policy providing full workers' compensation insurance coverage for all persons employed, either directly or through subcontractors, in carrying out the work under this contract, in accordance with the Workers' Compensation and Insurance Act, Division 4 of the Labor Code of the State of California, and any Acts amendatory thereof, Contractor may in the alternative be self-insured for workers' compensation in accordance with the provisions of the Act. The minimum limits for such policies or self insurance shall be the employer's liability limits specified in the Act.

IV. BUSINESS AND AUTOMOBILE LIABILITY POLICY

CONTRACTOR shall carry an automobile liability policy, naming County as additional insured, providing protection against loss as a result of liability to others arising out of the ownership, maintenance, or use of any automobile and resulting in bodily injury or property damage.

Minimum Limits: - $500,000 per occurrence for bodily injury or property damage, combined single limits, or

- $500,000 bodily injury per occurrence; and

- $500,000 property damage per occurrence; and

V. UMBRELLA POLICY

CONTRACTOR may carry an excess policy or an umbrella policy (following form) to meet the above required limits of liability.

VI. DEDUCTIBLES AND SELF-INSURED RETENSION

Any deductibles or self-insured retention must be declared to and approved by the County. At the option of the County, either: the insurer shall reduce or eliminate such deductibles or self-insured as respects the County, its officers, officials, employees, and volunteers; or the Contractor shall procure a bond guaranteeing payment of losses and related investigations, claim administration, and defense expenses.

VII. ACCEPTABILITY OF INSURERS

Insurance is to be placed with insurers with a current A.M. Best's rating of no less than A:VII.

The County Risk Manager may waive or alter this requirement, or accept self-insurance in lieu of any required policy of insurance if, in the opinion of the Risk Manager, the interests of the County and the General Public are adequately protected.
