About this file

This is a Supplemental Asbestos Inspection and Lead Paint Testing Report for the Montrose VA Medical Center (Franklin Delano Roosevelt VA Hospital) located at 2094 Albany Post Road, Montrose, New York. The report was prepared by Terracon Consultants, Inc. for Triple C - The A&E Group LLC on August 21, 2023, to support planned Electronic Health Record Modernization (EHRM) renovation activities. The inspection was conducted on June 13, 14, 15, and 28, 2023, by New York State-certified asbestos inspector Megan Cruz and EPA-certified Lead Inspector/Risk Assessor across 14 buildings and 91 specified rooms within the medical center campus.

The inspection identified multiple asbestos-containing materials (ACM) and lead paint across the surveyed areas. The asbestos assessment collected 273 layered bulk samples from 91 homogeneous areas of suspect ACM, with samples analyzed by Scientific Analytical Institute using polarized light microscopy via New York State methods 198.1, 198.4, and 198.6. Materials tested included vinyl floor tiles (VFT), carpet mastics, ceiling tile mastics, linoleum, transite board, and various mastic adhesives, with asbestos concentrations ranging from non-detected levels to 87% by weight. Lead paint testing utilized X-ray fluorescence (XRF) analysis to measure lead content on drywall, plaster walls, and metal radiators, with high lead content concentrations identified (≥1.0 mg/cm²) in Buildings 3 and 6. The report specifies that any identified ACM impacted by renovation activities must be properly removed and disposed of prior to construction in accordance with federal, state, local regulations, and VA specifications.

1.0 INTRODUCTION

Terracon Consultants, Inc. (Terracon) conducted a Supplemental Asbestos Inspection and Lead Paint Sampling regarding project-specific areas to be renovated at the Montrose VA Medical Center located at 2094 Albany Post Road in Montrose, New York. The supplemental inspection was performed to augment the original survey performed by another environmental consultant. The asbestos inspection scope of services was conducted on June 13, 14, 15, and 28, 2023 by a New York State-certified asbestos inspector and the lead paint inspection was conducted on June 13, 14, 15, and 28, 2023 by an EPA-certified Lead Inspector/Risk Assessor in general accordance with Terracon Proposal No. PJ2237038, dated May 5, 2023. Accessible interior building components within Client-specified rooms of concern were inspected, and homogeneous areas of suspect asbestos-containing materials (ACM) were visually identified and documented for the purpose of subsequent sample collection and laboratory analysis to determine asbestos-content. Although reasonable effort was made to inspect accessible suspect materials, additional suspect but un-sampled materials could be located in walls, in voids, or in other concealed areas. An X-ray fluorescence (XRF) analyzer to measure the lead content of various painted components in the Client-specified rooms.

1.1 Project Objective

We understand our scope of services was requested due to planned EHRM renovations at the Montrose VA Medical Center. Asbestos inspections are required prior to renovation and demolition activities to satisfy requirements of the United States Environmental Protection Agency (USEPA) 40 Code of Federal Regulations (CFR) Part 61, Subpart M, the National Emission Standards for Hazardous Air Pollutants (NESHAP) regulation. The purpose of the lead inspection was to provide general information so that contractors who disturb paints with lead can take the appropriate actions to comply with US Occupational Safety and Health Administration (OSHA) regulation 29 CFR 1926.62 – Lead in Construction.

3.0 FIELD ACTIVITIES

3.1 Asbestos Inspection

The asbestos inspection was conducted by Ms. Megan Cruz, a New York State-certified asbestos inspector on June 13, 14, 15, and 28, 2023. A copy of Ms. Cruz’s asbestos inspector accreditation is attached as Appendix C. The inspection was conducted in general accordance with the sample collection protocols established in USEPA 40 CFR Part 763, Subpart E, Section 763.86, AHERA. A summary of survey activities is provided below.

3.1.1 Visual Assessment

Inspection activities were initiated with visual observation of the accessible project-specific areas referenced above to identify homogeneous areas of suspect ACM. A homogeneous area (HA) consists of building materials that appear similar throughout in terms of color and texture with consideration given to the date of application.

3.1.2 Physical Assessment

A physical assessment of each HA of suspect ACM was conducted to assess the friability and condition of the materials. A friable material is defined by the USEPA as a material which can be crumbled, pulverized, or reduced to powder by hand pressure when dry. Friability was assessed by physically touching suspect materials.

Facilities | Environmental | Geotechnical | Materials 3

3.1.3 Asbestos Sample Collection

Based on the results of the visual observation, bulk samples from suspect ACM were collected in general accordance with USEPA AHERA sampling protocols. Samples of suspect materials were collected from randomly selected locations in each homogeneous area. Bulk samples were collected using wet methods as applicable to reduce the potential for fiber release.

Samples were placed in sealable containers and labeled with unique sample numbers using an indelible marker.

The selection of sample locations and frequency of sampling were based on Terracon’s observations and the assumption that like materials in the same area are homogeneous in content.

Terracon collected a total of 273 layered bulk samples from 91 homogeneous areas of suspect ACM. A summary of suspect ACM samples collected during the inspection is included as Appendix A and photos associated with the ACM samples are in Appendix D. Sample locations are indicated on excerpts from Client-provided plans in Appendix E.

Bulk samples were submitted under chain of custody to Scientific Analytical Institute, Inc.

(SAI) of Greensboro, North Carolina for analysis. Friable material samples were analyzed by polarized light microscopy (PLM) via New York State (NYS) method 198.1 and non-friable organically bound (NOB) material samples were analyzed by PLM NOB via NYS method 198.6.

Additionally, NOB samples with inconclusive results (<1% asbestos) via PLM NOB were additionally analyzed by transmission electron microscopy (TEM) via NYS method 198.4. SAI is accredited for bulk asbestos analysis under the National Voluntary Laboratory Accreditation Program (NVLAP), accreditation number 200664-0

3.2 Lead Paint Testing

The lead paint testing was conducted on June 13, 14, 15, and 28, 2023 by EPA-certified Lead Inspector/Risk Assessor Ms. Megan Cruz (Certification #: LBP-I-1224177-1). Terracon visually assessed the interior of project-specific rooms at the Montrose VA Medical Center to identify apparent unique combinations of suspect lead paint (LP). A unique combination of paint is based on paint color, building component and substrate. Assessment was conducted throughout visually accessible areas of the tenant space. A visual assessment of each unique combination of suspect LP was conducted to assess the condition of the paint. Based on results of the visual observation, Terracon performed limited LP measurements utilizing a direct read X-ray fluorescence (XRF) analyzer to measure the lead content of painted components. Two

(2) paint chip samples were additionally collected for confirmation and were submitted to SAI for analysis.

4.0 REGULATORY OVERVIEW

4.1 Asbestos

The asbestos NESHAP (40 CFR Part 61, Subpart M) regulates asbestos fiber emissions and asbestos waste disposal practices. The asbestos NESHAP regulation also requires the identification and classification of existing ACM according to friability prior to demolition or renovation activity. Friable ACM is a material containing more than 1% asbestos that, when dry, can be crumbled, pulverized, or reduced to powder by hand pressure. All friable ACM is considered regulated asbestos containing material (RACM).

The asbestos NESHAP regulation classifies material subject to demolition or renovation as either RACM, Category I non-friable ACM, or Category II non-friable ACM. RACM includes all friable ACM (pre-disturbance), along with Category I non-friable ACM that becomes friable (during disturbance), and Category I non-friable ACM subject to sanding, grinding, cutting, or abrading, or Category II non-friable ACM with a high probability of becoming crumbled, pulverized, or reduced to powder by forces expected to act on the material during disturbance.

Category I non-friable ACM are exclusively asbestos-containing packings, gaskets, resilient floor coverings, and asphalt roofing products that contain more than 1% asbestos. Category II non-friable ACM are all other non-friable materials (other than Category I non-friable ACM) that contain more than 1% asbestos. Category II non-friable ACM generally includes (but is not limited to) cementitious material such as: cement pipes, cement siding, cement panels, glazing, mortar, and grouts.

Asbestos activities are regulated by the New York Department of Labor (NYDOL) under the New York Regulations Industrial Code Rule 56 (12 NYCRR Part 56) which enforces NESHAP.

The owner or operator must provide New York State Asbestos Control Bureau with written notification at least 10 calendar days prior to the commencement of asbestos abatement activities that will disturb RACM in amounts greater than or equal to 160 square feet or 260 linear feet.

The NYDOL enforces the Occupational Safety and Health Administration (OSHA) standards at 29 CFR 1910.1001 and 29 CFR 1926.1101, which regulates employee exposure to asbestos.

The OSHA standard requires that employee exposure to airborne asbestos fibers be maintained at or below 0.1 fibers per cubic centimeter of air (0.1 f/cc) as an eight-hour time weighted average (TWA) and not exceed 1.0 fibers per cubic centimeter of air (1.0 f/cc) over a 30-minute time period known as an excursion limit (EL). The TWA and EL are known as OSHA’s permissible exposure limits (PELs). The OSHA standard classifies construction and maintenance activities which could disturb ACM and specifies work practices and precautions which employers must follow when engaging in each class of regulated work.

Facilities | Environmental | Geotechnical | Materials 5

4.2 Lead Paint

As applicable to this project, lead is regulated by OSHA. OSHA regulates lead exposure to workers. For the purpose of the OSHA lead standard, lead includes metallic lead, inorganic lead compounds, and organic lead soaps. A synopsis of the OSHA regulations (29 CFR 1926.62) and the applicability are described below.

The OSHA Lead Standard for Construction (29 CFR 1926.62) applies to construction work where an employee may be occupationally exposed to lead. Work related to construction, alteration, or repair (including painting and decorating) is included. The lead-in-construction standard applies to any detectable concentration of lead in paint, as even small concentrations of lead can result in unacceptable employee exposures depending upon on the method of removal and other workplace conditions. Under this standard, construction includes, but is not limited to, the following:

Demolition or salvage of structures where lead or materials containing lead are present.

Removal or encapsulation of materials containing lead.

New construction, alteration, repair, or renovation of structures, substrates, or portions containing lead, or materials containing lead.

Installation of products containing lead.

Lead contamination/emergency clean-up.

Transportation, disposal, storage, or containment of lead or materials containing lead on the site or location at which construction activities are performed; and, Maintenance operations associated with construction activities described above.
