Standard Operating Procedure for DEC Sewer Submittals
NYSDEC requires the following projects to be submitted for review:
Flows of 2500 gallons/day residential sewage
Note: Pump Stations and Sewer Mains will meet the flow requirement
Sewer capacity assurance:
Sewer capacity assurance for Fort Drum sanitary sewer system is the responsibility of Master Planning. Each fiscal year all construction projects that require connection to sanitary sewer are reviewed for sewer capacity with respect to population increases (flow may have moved to new facilities). Master Planning begins this process in mid April when new construction projects are in the design phase. Public Works Director signs Fort Drum Sewer Capacity Assurance letter addressed to DEC.
DANC line conveyance capacity assurance from Fort Drum to City of Watertown POTW is the responsibility of DANC. DANC Contracting Officer Representative (COR) provides average daily flows by projects that are listed on the Fort Drum Sewer Capacity Letter. DANC reviews the daily flows and provides concurrence that there is sufficient capacity within the DANC line.
Cultural Resources evaluation:
Fort Drum Cultural Resources will evaluate the proposed footprint (pdf, .dgn and shape file) for all construction projects. Results of the consultation must be included in the DEC submittal.
Responsibilities:
Public Works Environmental Compliance Wastewater Program Manager will manage all Army Corp of Engineers and Public Works Engineering sewer application submittals to
DEC.
Development Authority of the North Country (DANC) will obtain permits for new service connections from the City of Watertown Engineering office. DANC Contracting Officer Representative (COR) will verify permit fees as part of invoice review.
Other projects such as Mountain Community Homes or Contractor Owned Construction the A/E Project Company and Project Manager will manage their own sewer application submittals but keep Public Works Environmental Compliance Wastewater Program

Army COE and PW Engineering Procedure:
1. COE or PW Engineering will review the sewer design submittal to verify design meets 10 States Standards and UFC’s, drawings have engineers stamp and signature, Fort Drum Cultural Resources consultation has been completed, and capacity assurance from both Fort Drum and DANC is complete.
2. DEC Application for Approval of Plans for Wastewater Disposal System must be filled out and supplied to Public Works – Environmental Compliance, Water and Wastewater Program Manager along with 3 copies of the design submittal.
3. Wastewater Program Manager will have the Public Works Director sign DEC Application for Approval of Plans for Wastewater Disposal System.
4. A transmittal letter to DEC will be generated and signed by Public Works Environmental Chief. The entire package will be transported to NYSDEC within 2 days.
The transmittal letter will be stamped received by DEC. The stamped cover letter will be scanned and emailed to project manager, DANC Contracting Officer Representative (COR) and Master Planning.
5. DEC will respond to submittals by letter. Incomplete packages that require clarification or resubmittals the DEC response letter will be addressed to the Wastewater Program Manager. Resubmittals will be routed through the Wastewater Program Manager for tracking purposes. DEC Authorization to construct letters will be

6. Certification of completed sewer by designer of record must be reviewed by COE or PW Engineering for accuracy and completeness then given to Wastewater Program Manager. A/E will witness the testing and certify that project was constructed in accordance to the approved plans. Deviations from approved plans require as-builts along with the testing results. A transmittal letter to NYSDEC will be generated and signed by Public Works Environmental Chief. The certification package will be transported to DEC within 2 days. The transmittal letter will be stamped received by DEC. The stamped cover letter will be scanned and emailed to project manager, DANC Contracting Officer Representative (COR) and Master Planning.
7. DEC will review and accept certifications and respond to the Project Leader with cc to Public Works Director, Wastewater Program Manager and DANC .
Fort Drum Mountain Community Homes or Contractor Owned Construction:
1. Sewer capacity assurance and cultural resources consultation must be complete as soon as a project is in design phase. Submit estimated sewer flows with population increase to Master Planning, DANC COR, and Wastewater Program Manager. Submit site footprint (pdf, .dgn and shape file) to Cultural Resources and Wastewater Program Manager. Wastewater Program Manager will ensure both Capacity Assurance and Cultural Resources documentation are supplied.
2. Contractor Owned Construction will sign DEC Application for Approval of Plans for Wastewater Disposal System and submit application and 3 copies of the design submittal to DEC.
3. Other projects such as Mountain Community Homes or Contractor Owned Construction the A/E Project Company and Project Manager will manage their own sewer application submittals but keep Public Works Environmental Compliance Wastewater Program Manager, DANC Contracting Officer Representative (COR), and Master Planning fully informed by letter.
4. DEC will respond to submittals by letter. Incomplete packages that require clarification or resubmittals will be handled by the A/E Project Company. DEC Authorization to construct letters will be sent to A/E Project Company. Copy of authorization to construct will be routed to Wastewater Program Manger, DANC Contracting Officer Representative (COR) and Master Planning.

5. Certification of completed sewer by designer of record will be submitted by A/E Project Company. Copy of certification transmittal letter will be routed to Wastewater Program Manager, DANC Contracting Officer Representative (COR) and Master Planning.
6 NYCRR Part 750-2.10 Special Provisions - New or Modified Disposal Systems
(a) Except as provided in subdivision (h) of this section, prior to construction of any new or modified waste disposal system or modification of a facility or service area generating wastewater that could alter the design volume of, or the method or effect of treatment or disposing of the sewage, industrial waste or other wastes, from an existing disposal system, provided that discharge from such system is required in accordance with this
Part to be authorized under a SPDES permit, the permittee shall submit to the regional water engineer an approvable engineering report, plans, and specifications that have been prepared by a person or firm licensed to practice professional engineering in the
State of New York in accordance with standards accepted by the department.
(b) The construction of such new or modified disposal system shall not start until the discharger receives written approval of the system from the department and an issued permit. The department may require the discharger to remove any constructed disposal system or portion thereof if such a system or portion thereof is constructed prior to written approval from the department. The department may approve portions of disposal systems to allow for design and construction of disposal systems to proceed at the same time.
(c) The construction of such new or modified disposal system shall be under the general supervision of a person or firm licensed to practice professional engineering in the State of New York. Upon completion of construction, that person or firm shall certify to the department that the disposal system has been fully completed in accordance with the approved engineering report, plans and specifications, permit and letter of approval; and the permittee shall receive written acceptance of such certificate from the department prior to commencing discharge.
(d) The department reviews disposal system reports, plans, and specifications for treatment process capability only, and approval does not represent any opinion of the system's structural integrity.

(e) Department approval of the disposal system or service area does not relieve the permittee of any responsibility for compliance with its SPDES permit.
(f) The department may accept, in lieu of submission of engineering reports or plans and specifications, certification by a person or firm licensed to practice professional engineering in the State of New York that the design of the disposal system or service area conform to design standards accepted by the department. The department may require certification by letter or form (where the form may include but is not limited to a checklist consistent with the applicable standards). Such certifications shall be deemed notifications in accordance with ECL Section 17-0819.
(g) The following standards are accepted by the department:
(1) Ten States Standards (see section 750-1.24) for use in designing POTWs and
POTW collection systems;
(2) Intermediate Design Standards (see section 750-1.24) for use in designing facilities that are not POTWs, which treat only sanitary sewage; and
(3) Other standards that are acceptable by the department.
(h) Submission of approvable engineering report, plans, and specifications is not required where:
(1) the treatment unit is temporarily (less than one year) installed for benchmarking and/or troubleshooting and the permittee has provided notification to the Regional water engineer at least 30 days prior to installation.
(2) an equivalent or superior treatment unit is installed.
(3) changes to treatment units do not have a reasonable potential to affect the discharge.
(i) Sewer Extensions, public or private, must be reviewed and approved in accordance with this section before construction and connection to any conveyance tributary to a
SPDES permitted discharge.
§750-1.2 Definitions
(44) Industrial waste means any liquid, gaseous, solid or waste substance or a combination thereof resulting from any process of industry, manufacturing, trade, or

Revision 3 Date: 10‐4‐19 business or from the development or recovery of any natural resources, which may cause or might reasonably be expected to cause pollution of the waters of the state in contravention of the standards adopted as provided herein. Industrial wastewater is any wastewater that is not sanitary waste or uncontaminated stormwater.
(77) Sewage means the water-carried human or animal wastes from residences, buildings, industrial establishments or other places, together with such groundwater infiltration and surface water as may be present. The admixture with sewage as above defined of industrial wastes or other wastes as hereafter defined, shall also be considered sewage within the meaning of this Part.
(79) Sewer connection means a point of connection between a building, residence, or other structure and a public sewer except that any connection designed or intended to convey 2,500 gallons per day or more of residential sewage alone or in combination with storm water shall be considered a sewer extension.
(80) Sewer extension means a newly constructed or proposed sewer designed to serve one or more sewer connections.
(95) Wastewater means water that is not stormwater, is contaminated with pollutants and is or will be discarded.

Provisions to Insure Verity
All applications, reports, notices or notifications required or authorized to be made or filed by this title or by rules or regulations promulgated pursuant hereto or by the provisions or conditions of any permit issued pursuant to this title or title three of this article by or on behalf of a permittee, applicant for a permit or person in control of an outlet into the water of the state or point source shall be verified or sworn to in respect to all statements of fact therein or shall bear a form notice as provided in section 210.45 of the penal law to the effect that false statements made therein are punishable.
