About this file
This is a Darfur Contracting Act Certification form issued by the California Department of General Services (DGS) Procurement Division, applicable to Request for Proposal RFP-25-016 Strategic Planning Consultant from the California Arts Council (CAC). The certification requirement applies to any company with business activities or operations outside the United States within the previous three years. Companies meeting this criterion must certify either that they are not a scrutinized company as defined under Public Contract Code Section 10476, or provide written permission from DGS authorizing them to submit a proposal if they are classified as scrutinized. The form provides two certification options: Option #1 requires the authorized company representative to certify under penalty of perjury that the prospective bidder is not a scrutinized company, while Option #2 requires submission of written DGS permission for companies classified as scrutinized entities. Companies without international business activities during the previous three years are exempt from completing this form.
The RFP seeks a single Strategic Planning Consultant to develop a current strategic framework for CAC, as required by Government Code 11816 and National Endowment for the Arts state arts agency partnership requirements. Eligible bidders include California independent contractors, individuals, sole proprietors, partnerships, certified small businesses, disabled veteran business enterprises, 501(c)(3) organizations registered in California, and private for-profit organizations based in California. The maximum budget is $49,999 with potential amendment to add up to $40,001 in additional funds. Proposals must be submitted to Procurement@arts.ca.gov by specified key action dates, and interested bidders are directed to monitor Cal eProcure for any addendum announcements or changes to the RFP requirements.
