About this file
This is a Commercially Useful Function (CUF) Evaluation and Determination Worksheet used by the California Arts Council (CAC) to assess whether certified Small Business (SB) and Disabled Veteran Business Enterprise (DVBE) suppliers meet compliance requirements for state contract opportunities. The worksheet is designed to evaluate both prime contractors and subcontractors to ensure they are performing a distinct and substantive element of contract work. The evaluation process requires assessors to verify five key compliance criteria: that the supplier is responsible for executing a distinct element of work as described in the scope of work; that the supplier will actually perform, manage, or supervise the work rather than merely serve as a pass-through entity; that the work performed aligns with the supplier's normal business services and functions; that the supplier maintains responsibility for negotiating price, determining quality and quantity, ordering, and making payment for any goods involved; and that any subcontracting by the supplier does not exceed normal industry practices. The worksheet serves as a critical documentation tool in the RFP-25-016 Strategic Planning Consultant procurement, where CAC is seeking qualified contractors to develop a strategic framework for the state arts agency.
CUF compliance determination is binary: if all five evaluation questions receive "YES" or "N/A" responses, the supplier is deemed compliant; any "NO" response results in non-compliance status. The certification itself—whether a firm holds SB or DVBE status—does not automatically confer CUF compliance; rather, CUF compliance must be independently evaluated for each specific contract prior to award. This worksheet applies to all suppliers regardless of certification type and ensures that state resources allocated to small and disabled veteran-owned businesses are directed to firms that will meaningfully contribute to contract performance rather than simply act as intermediaries for larger contractors.
