About this file

This is a Commercially Useful Function (CUF) Evaluation and Determination Worksheet used by state and local government agencies to assess whether certified Small Businesses (SB), Minority Businesses (MB), and Disabled Veteran Business Enterprises (DVBE) performing work on contracts are meeting CUF compliance requirements prior to contract award. The worksheet is completed individually for each certified SB and/or DVBE identified on a bidder's declaration, whether the entity is functioning as a prime contractor or subcontractor. The evaluation determines whether suppliers are performing a distinct and commercially useful function rather than serving merely as pass-through entities. The worksheet requires evaluators to document the OSDS number, certification type, supplier name and DBA, evaluation date, solicitation number, and a description of the goods and/or services to be performed by the evaluated supplier.

The worksheet employs five core evaluation criteria to determine CUF compliance. These criteria assess whether the supplier is responsible for executing a distinct element of work; actually performing, managing, or supervising the work involved; performing work consistent with its normal business services and functions; responsible for negotiating price, determining quality and quantity, ordering, making payment, and installing (if applicable) for any products or materials involved; and not subcontracting a greater portion of work than expected by normal industry practices. The evaluator must answer yes or no to each criterion based on documentation submitted by the bidder, including bidder declarations, confirmation letters, Standard Form 843, and supporting documentation such as certifications, resumes, and business registrations. A supplier achieves CUF compliance only if all five questions receive a "YES" response or a "N/A" designation for question four; a single "NO" response results in non-compliance determination. The worksheet emphasizes that SB and DVBE certification alone does not constitute CUF compliance and that additional information and instructions are available through the Commercially Useful Function Requirements Policy and Frequently Asked Questions documentation.
