Full and Open Competition

1. Contracting Activity: 145th Airlift Wing MSG/MSC

2. Description of Action: 145th Civil Engineer Squadron requests the inclusion of brand name Monaco Enterprises equipment/systems in solicitation W50S87-23-B- 0001 for the 145th AW Building 51 Renovation at the 145th Airlift Wing located in Charlotte, NC. The Government projects award for 2023 and a combination of fiscal year 2023 Operations and Maintenance and Military Construction funds will be used.

3. Description of Supplies/Services: The item required to be brand name is Monaco Enterprises fire alarm radio transceiver. The radio transceiver is a unit in each building that communicates back to the central reporting station.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

The 145th Airlift Wing currently employs Monaco Enterprises equipment/system for the base-wide fire alarm. The overall system incorporates a central reporting station that is located at the fire station, with transceivers (subject of this memorandum) located in every building on base that communicates back to the central reporting station. The use of different fire alarm equipment/systems will not enable the existing base standard equipment/systems currently employed at the 145th Airlift Wing to communicate with an alternate manufacturer’s equipment/systems. To install another manufacturer's equipment/systems would require substantial duplication of cost to the Government not expected to be recovered through competition. In addition, unacceptable delays in fulfilling the agency’s requirements would result. To convert all facilities on the 145th Airlift Wing which have Monaco Enterprises radio transceivers to another manufacturer is estimated to cost $1M. The same justification and authority has been used in every solicitation and resulting contract that includes fire alarm scope (see paragraph 10 below for further information).

6. Efforts to Obtain Competition: As this is a brand name requirement, this justification will be included with the solicitation as required by FAR 5.102(a)(6).

Solicitation W50S87-23-B-0001 for the subject project will be issued as a small business set-aside and will be posted through the Government-wide point of entry located at www.beta.sam.gov.

7. Actions to Increase Competition: The Government will continue to seek out vendors proposing cost-effective solutions that meet the Government's needs.

Additionally, we will continue to conduct market research to find equipment/systems that are not proprietary in nature.

8. Market Research: A recent discussion with a Monaco representative indicated that no other manufacturer’s equipment/systems will integrate with existing Monaco Enterprises equipment/systems which are currently in use at the 145th Airlift Wing.

10. Other Facts: Recent examples where Monaco Enterprises fire alarm radio transceivers were included/installed include:

b. W91242-19-C-5007 (awarded 29 Mar 2019) – Construct C-17 Simulator Facility
