FAR Part 6 Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: 145th Airlift Wing MSG/MSC
2. Description of Action: 145th Civil Engineer Squadron requests the inclusion of all brand names listed in “Exhibit A: Base Standard Finishes” in solicitation W50S87-23- B-0001 for the 145th AW Building 51 Renovation at the 145th Airlift Wing located in Charlotte, NC. The Government projects award for 2023 and a combination of fiscal year 2023 Operations and Maintenance and Military Construction funds will be used.
3. Description of Supplies/Services: The items required to be brand name are base standard finishes for various applications on the 145th Airlift Wing, to include paint, ceramic tile, acoustical ceiling tile, carpet tile, vinyl composite tile, plastic laminate products, rubber coved base, transition strips, corner guards, face brick, and split face concrete masonry unit block.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
The 145th Airlift Wing currently employs base standards for interior and exterior finishes to reduce cost for maintenance and repair to existing facilities. To install another manufacturer's interior and exterior finishes would require substantial duplication of cost to the Government not expected to be recovered through competition. Using another manufacturer's finishes, paint for example, will not match existing and would require the Government to purchase and keep additional stock.
This significantly increases maintenance costs with each change in manufacturer. In addition, unacceptable delays in fulfilling the agency’s requirements would result.
The 145th Airlift Wing currently has 36 facilities that employ the finishes described in Exhibit A. To convert the entire installation to new finishes would cost an estimated $3M initial cost, and $5M in recurring maintenance cost over the expected life cycle of each facility.

6. Efforts to Obtain Competition: As this is a brand name requirement, this justification will be included with the solicitation as required by FAR 5.102(a)(6).
Solicitation W50S87-23-B-0001 for the subject project will be issued as a small business set-aside and will be posted through the Government-wide point of entry located at www.beta.sam.gov.
7. Actions to Increase Competition: The Government will continue to seek out vendors proposing cost-effective solutions that meet the Government's needs.
Additionally, we will continue to conduct market research to find equipment/systems that are not proprietary in nature.
8. Market Research: All brand names listed in Exhibit A can be sourced by general contractors bidding on the subject construction project.
9. Interested Sources: Not applicable
10. Other Facts: All recent construction projects which include the addition and/or alteration of any interior or exterior finishes include the manufacture finishes described in Exhibit A.
