DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval for

Other Than Full and Open Competition

1. Contracting Activity:

Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC)

The proposed procurement, a Lowest Price Technically Acceptable (LPTA) under FAR 15, is for the 562-184 Consolidate Primary Care construction project at the Erie VA Medical Center (VAMC) located in Erie, PA.

The acquisition plan number for this project is 36C776-23-AP-1396. The project funding is on the FY24 operating plan and a 2237 will be provided at award.

2. Nature and/or Description of the Action Being Processed:

This justification is to support the 562-184 Consolidate Primary Care construction project at the Erie VAMC that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials. The use of a particular brand name for the items listed below accommodates standardization of these items throughout the facility.

a. Fire Alarm System

i. Honeywell, Notifier NFS2-3030

b. Facility BAS System

i. Johnson Controls International, Metasys Building Automation and HVAC Control System

c. PACS (Card Reader)

i. Stanley Convergent Security Solutions, HID pivCLASS Reader

d. Door Locks

i. Best, Figure 8, 7-Pin Cylinder

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

This procurement is for the Consolidate Primary Care construction project at the Erie VAMC. The scope includes a new addition to the first floor of the existing Main Building (Building 1), to be located on the front part of the building (North side), extending the building towards E 38th Street on one side, and towards the West on the other, going all the way to the current entry vestibule. A portion of the existing building, which connects to the proposed expansion, will be remodeled as part of this project. This portion of the existing building to be remodeled, is mainly occupied by the White Clinic, Women’s Health, and Cardiology. The proposed project will add necessary new clinical space, and will also renovate existing clinical space, so that the overall effect will be an expanded Primary Care Clinic, integrated as one continuous, cohesive unit, once the project is complete. In addition to what’s indicated above, the project also includes the construction of a Partial Basement, to house mechanical equipment and utility closets.

The Project also contemplates the reconfiguration of outdoor areas impacted by the building expansion, such as the existing parking lot right in front of the expansion, the vehicular circulation and drop-off area in front of the building, sidewalks, curbs, and green areas, among others.

There are four brand name items listed for which the VA is not able to accept equal or alternate items. The value of these items is listed below and the VAAR construction magnitude for the entire project is between $10,000,000 and $20,000,000.

a. Fire Alarm System

i. Honeywell, Notifier NFS2-3030

ii. ROM Value:

iii. Unique Qualifications: The Notifier System allows for 24 hour/7 day/week continuous monitoring of all fire alarm equipment installed on the Erie VAMC campus. These control systems are required for a 100% fully compatible fire alarm control system to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

b. Facility BAS System

i. Johnson Controls International, Metasys Building Automation and HVAC Control System

ii. Value:

iii. Unique Qualifications: The Metasys System shall be utilized as the main control system for the new air handling unit to be installed in Building 01, for the Consolidate Primary Care Minor Project. The Metasys System allows for 24 hour/7 day/week continuous monitoring of all HVAC equipment and added control points installed on the Erie VAMC campus. These control systems are required for a 100% fully compatible HVAC Control System to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

c. PACS (Card Reader)

i. Stanley Convergent Security Solutions, HID pivCLASS Reader

ii. Value:

iii. Unique Qualifications: The Stanley PACS system allows for 24 hour/7 day/week continuous monitoring of all access control equipment and added control points installed on the Erie VAMC campus. These control systems are required for a 100% fully compatible PACS system to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

d. Door Locks

i. Best, Figure 8, 7-Pin Cylinder

ii. Value:

iii. Unique Qualifications: The BEST System shall be utilized as the main key system in Building

01, for the Consolidate Primary Care Minor Project. The Erie VAMC carries different lock components to fix and provide maintenance to the existing locksets, such as interchangeable cores and others. Also, the Erie VAMC has a master key system for the locks it already has, and future door locks should also be part of this system.

4. Statutory Authority Permitting Other than Full and Open Competition:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 41 U.S.C. § 3304(a)(1) ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;

( ) (6) National Security per FAR 6.302-6;

( ) (7) Public Interest per FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

These items have been standardized throughout the Erie VAMC. Installing a different manufacturers’ system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:

a. Fire Alarm System

i. Honeywell, Notifier NFS2-3030

ii. Impact: These control systems are required for a 100% fully compatible fire alarm control system to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside. The installation of a system which is not compatible to the present Notifier System would cause increased problems through false alarms or the risk of loss of life because of the lack of critical alarm if smoke or fire is not detected. There would be an increase in acquisition cost by having to purchase the front-end hardware/software and would still involve disjointed systems without integrity and an unmanageable Fire/Smoke Alarm System.

b. Facility BAS System

i. Johnson Controls International, Metasys Building Automation and HVAC Control System

ii. Impact: These control systems are required for a 100% fully compatible HVAC Control System to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside. The installation of a system which is not compatible to the present Metasys System would cause increased maintenance problems through false alarms, incorrect temperature control, and equipment monitoring of critical HVAC and related systems utilized in a clinical environment. There would be an increase in acquisition cost by having to purchase the front-end hardware/software and would still involve disjointed systems without integrity and an unmanageable HVAC Control System.

c. PACS (Card Reader)

i. Stanley Convergent Security Solutions, HID pivCLASS Reader

ii. Impact: These control systems are required for a 100% fully compatible PACS system to be utilized at the above-mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside. These control systems are required for a 100% fully compatible PACS system to be utilized at the above mentioned site. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

d. Door Locks

i. Best, Figure 8, 7-Pin Cylinder

ii. Impact: The Erie VAMC carries different lock components to fix and provide maintenance to the existing locksets, such as interchangeable cores and others. Also, the Erie VAMC has a master key system for the locks it already has, and future door locks should also be part of this system. For all these reasons, other locks would not work as a suitable substitute. This item is being sole sourced under a larger construction project that will be a competed as a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set aside.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside. This Justification for Other Than Full and Open Competition will be posted to Contract Opportunities with the solicitation.

7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable:
