Contracts listed may include those with the Federal Government, state and local governments or their agencies, and commercial customers. If no past performance is reportable, include RFP Attachment 3 –Past Performance Information Sheet within the packet and indicate “No Recent or Relevant Past Performance Information Available”. For less than three (3) entries, the offeror will place N/A in the associated fields of RFP Attachment 3 – Past Performance Information Sheet. The offeror’s proposal shall not include any completed questionnaires, as the respondent(s) to the PPQ will submit their completed forms directly to the CO/CS: dawn.melchione@us.af.mil / tanya.turner-fells@us.af.mil.
If problems were encountered during the performance of the identified contracts, provide evidence of the ability to isolate the root causes of problems and include in the Past Performance Information Sheet (Attachment 3) a description of programs or actions taken to resolve those causes. Problems not addressed in the Past Performance Information Sheet (Attachment 3), but found by the Government during the evaluation of the information in this volume, will be assumed to still exist. Note: In the case of Contractor Performance Assessment Report System (CPARS), if your input has already been provided and the rationale/ circumstances have not changed, DO NOT repeat them here.
L.6.2.2 Key Personnel: Offerors, joint venture members, or critical subcontractors, as defined above (paragraph L.6.1), who either have no prior contracts or do not possess relevant corporate past performance, but have key personnel with relevant performance while employed by another company, may demonstrate the performance of such key personnel by submitting Past Performance Information Sheet (Attachment 3) for three (3) of their most recent and relevant contracts under which such key personnel performed the same role currently being proposed on the instant acquisition and this performance occurred during the past five (5) years from the issuance date of this solicitation. Note however, that the quality of the key personnel’s performance under the submitted contract must be able to be verified by the Past Performance Team in order to be considered in the assessment of confidence. Any such key personnel must already be employed by the offeror/joint venture member, or in the case of a critical subcontractor, must already be employed by the critical subcontractor; a letter of intent to hire does not constitute employment.
L.6.2.3 Subcontractor/Teaming Member Consent Form – In addition to the information provided in the Past Performance Information for each entity as required above, the offeror must submit a consent letter (Attachment 13) executed by each of its proposed teaming member(s) and/or critical subcontractors authorizing release of adverse past performance information to the prime offeror to allow the prime offeror an opportunity to respond. The consent form shall be completed by the team member(s) and/or critical subcontractors identified in your proposal. The completed consent forms shall be submitted as part of your Past Performance Volume III.
L.6.2.4 On the (up to) three (3) contracts submitted in Volume III, Past Performance, include relevant information concerning the offeror’s/joint venture member’s and major subcontractor’s compliance with the requirements of FAR 52.219-8, Utilization of Small Business Concerns or FAR 52.219-9, Small Business Subcontracting Plan, if these clauses were included in the past performance example contract. Copies of contractual reports may be submitted to validate compliance with requirements of FAR 52.219-8/52.219-9. Explanation of efforts where minimum quantitative requirements and/or goals were not met should be provided. (Please note that FAR 52.219-8 does apply to ALL businesses, whereas FAR 52.219-9 only applies to large businesses.)
L.6.2.5 Follow-up Discussions – The Government may conduct follow-up discussions with any of the people/entities identified in the Past Performance Information or in the offeror’s Past Performance Volume. Pursuant to FAR 15.305(a)(2)(ii), the Government may obtain other information by sending out additional questionnaires and through other sources, other than those listed within the Past Performance Information.
L.7.0 VOLUME IV – COST/PRICE (Factor 3)
L.7.1 General Instructions.
L.7.1.1 Contract Line Item Number (CLIN) Structure Offeror’s will propose on ten Contract Line Item Numbers (CLINS). Three CLINS are Cost Reimbursement (CR) type, five CLINS are FFP, one CLIN will be negotiated if the third ship is activated and one CLIN that is not separately priced.
• FFP CLINS 0001 through 0003 will be priced as a fully burdened daily rate (including, but not limited to, danger pay, hazard pay, rate of pay, G&A, profit, medical, incentives, general organization for social insurance, and end of service, etc.).
• CR CLIN 0004 Travel. This is a CR line item, the Government will provide an estimated CLIN value.
• CR CLIN 0005 Material/Equipment. This is a CR line item, the Government will provide an estimated CLIN value.
• CR CLIN 0006 Spares. This is a CR line item, the Government will provide an estimated CLIN value.
• NSP CLIN 0007 Data Deliverables. This CLIN is NOT SEPARATELY PRICED
• FFP CLIN 0008 (Third Ship) The Government will provide an estimated CLIN value. The negotiated fully burdened labor rates in the basic IDIQ will apply, however, the level of effort required to maintain the system will be negotiated if, and when, the third ship is activated. This will result in an appropriate daily rate.
• FFP CLIN 0009 Phase In (30 Days) unit price will include all mobilization cost for the time period specified including any employee cost (including, but not limited to, danger pay, hazard pay, rate of pay, G&A, profit, medical, incentives, general organization for social insurance, and end of service, etc.).
• FFP CLIN 0010 Phase Out (30 Days) unit price will include all mobilization cost for the time period specified including any employee cost (including, but not limited to, danger pay, hazard pay, rate of pay, G&A, profit, medical, incentives, general organization for social insurance, and end of service, etc.).
L.7.1.2 Completeness. A proposal is complete when all pricing data required under this solicitation is provided in the format prescribed and the offeror has complied with all pricing requirements of the solicitation.
L.7.1.3 Price will be evaluated for reasonableness. It is expected that adequate price competition (See 15.403-1(c)(1)(i)) will be the basis for establishing price reasonableness, and comparison of the proposed prices will satisfy the requirement to perform a price analysis per FAR 15.305(a)(1). Upon examination of the initial proposals, the PCO will review this determination. If in the PCO’s opinion, adequate competition exists, certification under FAR 15.406-2 will not be required. In accordance with FAR 15.403-1(b) and 15.403-3(a), data other than certified pricing data may be required to support price reasonableness. Information shall be provided in accordance with FAR 15.403-5 if the PCO determines that there is insufficient information available to determine price reasonableness, and none of the exceptions in FAR 15.403-1 apply. The burden of proof for price reasonableness rests with the offeror.
L.7.1.4 Price will be evaluated for balance. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated as indicated by the application of price analysis techniques. Per FAR 15.404-1(g), the greatest risks associated with unbalanced pricing occur when startup work or mobilization (transition period in this effort) is a separate line item, and the evaluated price is the aggregate of estimated quantities to be ordered under separate line items of an indefinite-delivery contract. An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
L.7.1.5 Professional Employee Compensation Realism is a separate evaluation from the TEP evaluation. Professional Employee Compensation that is unrealistically low or not in a reasonable relationship to the various job categories, since it may impair the offeror’s ability to attract and retain competent professional service employees, may be viewed as evidence of failure to comprehend the complexity of the contract requirements.
L.7.1.6 Price Data. Information beyond that required by this instruction shall not be submitted, unless you consider it essential to document or support your price position. All information relating to the proposed price, including all required supporting documentation must be included in the section of the proposal designated as the Price Volume. Under no circumstances shall this information and documentation be included elsewhere in the proposal.
L.7.1.7 Rounding. All unit prices shall be rounded to the nearest dollar and total dollar amounts provided shall be rounded to the nearest dollar.
