About this file
This is a Federal Funds Addendum to solicitation ARFQ WEH2500000007 issued by the State of West Virginia Department of [agency name not specified in document]. The addendum modifies the solicitation to ensure compliance with federal procurement requirements under 2 C.F.R. 200.317 through 200.327 for expenditures of federal funds. The solicitation is structured as two separate evaluations: one for state-level procurement (including standard state procurements and state federal funds procurements) and one for county/local federal funds procurement. Bid responses for state-level procurement will be evaluated with applicable vendor preferences applied, while county/local procurement evaluations will omit vendor preferences to comply with federal regulations. If both evaluations identify the same winning bidder, the solicitations will be combined into a single contract award; if different bidders win each evaluation, multiple contracts may be awarded.
The addendum incorporates required federal contract provisions addressing minority business participation, women's business enterprises, labor surplus area firms, and domestic preferences for goods and materials produced in the United States. Vendors utilizing subcontractors must take affirmative steps to ensure participation of small and minority businesses and women-owned enterprises. The contract includes breach of contract remedies and penalties, termination for cause and convenience provisions, and equal employment opportunity requirements as specified in 41 CFR Part 60 and Executive Order 11246. Both state and county/local government entities planning to utilize this contract for procurements subject to federal regulations are cautioned to consult with the applicable federal funding agency to ensure contract compliance with federal requirements.
