About this file
This is a Design/Bid/Build (D/B/B) Contractor's Agreement form (State Form SC-6.21) issued by the State of Colorado Office of the State Architect State Buildings Program for the EM2624 Yaeger Structural Stabilization and Repairs project. The agreement establishes the contractual relationship between the State of Colorado and a contractor selected to perform construction work. The contractor must perform all work required for complete and prompt execution as described in the Contract Documents to the highest industry standards and satisfaction of the State and its Architect/Engineer. The contractor is required to achieve Substantial Completion within a specified number of calendar days from the Notice to Proceed, with Final Acceptance occurring within an additional specified period. Timely completion is designated as an essential condition, with liquidated damages potentially assessed for failure to meet deadlines.
The contract sum is to be determined and inserted by the parties, with payment subject to authorized additions and deductions as outlined in the General Conditions. The agreement incorporates multiple exhibits including the Contractor's Bid, Performance Bond, Labor and Material Payment Bond, Insurance Certificates, and Building Code Compliance Policy. Depending on project characteristics, the contract may include provisions for Federal Davis-Bacon Act wage requirements (if federally funded), State prevailing wage requirements (for projects $500,000 or more not federally funded), and apprenticeship utilization certifications (for projects $1 million or more not federally funded). The contract is not valid until approved and signed by the State Controller or designee, and the contractor bears no obligation to perform work prior to the Effective Date. Labor burden calculations are required on all construction projects, and applicable prevailing wage determinations and apprenticeship contribution rates must be included as exhibits when relevant.
