About this file
This file is an Amendment 001 containing Requests for Information (RFI) and responses related to a pad-mounted transformer solicitation. The document provides clarifications on four key bidding requirements submitted between August 31, 2025, and September 8, 2025. The organization conducting the solicitation does not receive federal or state funding and therefore does not require a Business Associate Agreement (BAA) or Foreign Entity Ownership Disclosure (FEOC) statement; however, bidders must comply with Executive Order 13920 regarding critical infrastructure and adversary countries. Oregon Contractor Classification Board (CCB) certification is not mandatory for this procurement. Overseas manufacturers are permitted to submit bids directly provided they meet all RFQ requirements and can supply references from utilities currently using their transformers within the Pacific Northwest region of the United States. A bid bond or surety bond is not required for participation in this solicitation.
This amendment clarifies bidding accessibility and reduces barriers to entry by eliminating bonding requirements and CCB certification mandates, while establishing reference requirements for overseas manufacturers to ensure equipment compatibility and proven performance within the relevant geographic market. The Foreign Entity disclaimer reflects compliance with critical infrastructure protection policy rather than a categorical prohibition on international suppliers, allowing qualified manufacturers from non-adversary nations to compete. The requirement for Pacific Northwest utility references ensures that overseas bidders can demonstrate equipment performance in comparable climatic and operational conditions relevant to the procuring entity's service area.

RFI Number Question Request Date Response
1 Does an FEOC statement, or BAA, suffice for the Exhibit D requirement? 9/8/2025
BAA applies to federally funded and some state funded projects. We do not receive federal or state funds and our board policy does not require BAA. The
Foreign Entity disclaimer has to do with Executive Order 13920 which addresses critical infrastructure and adversary countries. Essentially, we are to avoid buying electrical equipment from adversary countries. We can still buy electrical equipment from countries that are not adversary.
2 Does the Bidder Oregon CCB consideration mandatory? 8/31/2025 This requirement doesn’t apply to this solicitation.
We are overseas manufacturer, would it be possible for us to particiapte in the bidding as a bidder directly? 8/31/2025
We can accept quotes from overseas manufacturers provided all RFQ requirements are met. References must be provided from utilities within the
Pacific Northwest of the United States that are currently using your transformers.
4 Bid Bond/Surety bond, is it required? 8/31/2025 A bid or surety bond is not required for this solicitation.
