B-5 BASIS OF AWARD:
One contract will be awarded, based upon evaluation of that proposal considered to be most advantageous to the Government, cost and other factors considered, see Evaluation Factors Attached.
Contractor Acceptance Statement: By signing the offer, the Contractor agrees to all terms, conditions, and provisions included in the solicitation and agrees to furnish any awarded items at the price set in the schedule unless otherwise excepted as follows:
SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C-1 – PROJECT DESCRIPTION
a) Introduction – The US Forest Service (FS) is soliciting bids for the renovation of the Dolly Copp Campground water, electrical, and telecommunication utilities; toilet building and wastewater systems; and road reconstruction, in Martins Location, New Hampshire, within the White Mountain National Forest, Androscoggin Ranger District.
The contractor shall provide all expertise, labor, supervision, services, equipment, tools, supplies, permits (as applicable), coordination with utilities, transportation, and incidentals necessary to complete the work described. The desired outcome is complete installation per the documentation attached to this solicitation, and adherence to the contract awarded, while keeping portions of the campground open during construction. The awarded contract shall constitute the entire agreement including all terms and conditions applicable to the contract. Work shall be completed as shown in the drawings, maps, specifications, and exhibits as referenced or included in this contract; and in accordance with applicable federal, state, and local regulations.
b) Description of Work – Work includes Phase I: the installation of a new water distribution system, electrical and telephone infrastructure, the demolition of existing pavement, replacement of drainage structures, and construction of new road surfaces. Work may include Phase II: demolition and replacement of wastewater systems, and demolition and replacement of toilet buildings. Work also includes necessary clearing and grubbing, earthwork, and site-stabilization.
c) Project Location – Dolly Copp Campground is located off of the Pinkham B Road, accessed from Highway 16, approximately 5 miles south of Gorham, NH. Also, see vicinity maps on enclosed plans.
d) Price Range – Between $5,000,000 and $10,000,000.
e) Pre-bid Tour –No pre-bid tour is planned.

f) Start Work – It is estimated that work will begin around July 1st, 2016. Site-disturbing activities shall be performed consistent with the periods of restriction noted in the plans, permits, specifications, and other instructions.
g) Period of Performance – Work shall be completed by the following dates, which include time for winter shutdowns as needed. The Period of Performance includes pre-construction and construction activities such as: obtaining permit approvals, submittal of fabrication and manufacturing proposals, ordering and delivery of materials, coordination with utilities, and performance of the work.

h) Government Furnished Materials – None.
i) Use of Environmentally-Preferable Materials – Contractor shall use in the work, and incorporate into finished product, bio-preferred materials and supplies whenever available and practical. Submit to the CO for approval prior to ordering materials, product sheets and manufacturer’s information, indicating environmentally-preferable content. The Forest Service is aware that non-pressure pipe must meet EPA Construction Product standards.
C-2 – PROJECT OPERATIONS
C2-a) Permits – The Government will provide copies of obtained permits for construction activities, as referenced in the solicitation. The Contractor shall obtain additional permits, or amendments to Government-obtained permits, as necessary for their operations as required by local, state, and federal regulations.
C2-b) Staging Area – The Contractor shall coordinate with the CO on a staging area location(s). The Contractor shall operate all equipment and store, transport, and handle materials in a manner that will not damage the existing roads, parking lots, and landscaping.
C2-c) Landscape Preservation – The Contractor shall confine operations to within the clearing limits designated, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside these limits. Preservation areas and construction limits are shown on the drawings and additionally flagged on the ground prior to activity.
Equipment shall be clean and properly maintained. All earth-moving equipment shall be cleaned and then inspected by the COR prior to mobilization. Leaking or faulty equipment shall be repaired or removed as soon as possible. Refueling, greasing, or servicing of equipment shall be in controlled areas away from surface waters. Fording of streams or rivers with mechanized equipment shall not be allowed.
If, prior to or during excavation work, items of archaeological, paleontological, or historical value are reported or discovered, or an unknown deposit of such items is disturbed, the Contractor shall immediately cease excavation in the area so affected. Contractor will then notify the Forest Service and will not resume excavation until written approval is given by the authorized officer.
C2-d) Erosion Control – The Contractor is responsible for implementing temporary erosion control as needed per NHDES best management practices and EPA’s NPDES requirements. Establish erosion protection and dewatering methods prior to conducting excavations. Maintain erosion control measures, and improve and replace immediately any non-functioning measures, throughout the course of the project and until site is stabilized.
Schedule and conduct operations to minimize erosion of soils and to prevent silting or muddying of stream, rivers, irrigations systems, or impoundments.
C2-e) Dewatering – The Contractor is responsible for all dewatering activities. Conduct dewatering suitable to protect the landscape from the activities, and as needed to isolate the work from streams and protect the work from damage.
C2-f) Spill Prevention – The Contractor shall prepare for approval, and adhere to, a Spill Prevention, Control, and Countermeasures Plan suitable to protect environment from the Contractor’s operations.
Pollutants such as fuels, lubricants, bitumens, sewage, hazardous, or otherwise harmful shall be controlled at the site and prevented from release to the environment. All contaminated soil, vegetation or debris resulting from Contractor’s operation shall be immediately contained and within 24 hours shall be removed from site and legally disposed.
Control the discharge of non-hazardous wash water through sufficient siltation treatments, such as filters, barriers, or settlements. Dispose of any materials containing hazardous-substances legally off national forest system lands.
C2-g) Electrical – There is limited electrical service on this project. Contractor is responsible for supplying all electrical services required for construction operations.
C2-h) Services – Potable Water and Toilet Facilities may not be available in this location. The Contractor is responsible for providing temporary sanitation facilities as necessary.
C2-i) Existing Utilities – The Contractor shall ensure locations of any utilities prior to excavation, trenching, or other ground disturbing activity. The Contractor shall be responsible for protecting or otherwise replacing utilities damaged by Contractor’s operations.
C2-j) Security and Protection – Security is the Contractor’s responsibility. Areas adjacent to the construction site will be occupied by the public. Limit access to the construction area to persons involved in the work.
Provide secure storage for materials that are stored on site. Secure completed work as required to prevent loss and damage.
Barricades, warning signs, and lights shall comply with standards and code requirements for erection of structurally adequate barricades. All road warning signs, barricades, and traffic control devices shall conform to MUTCD. Where appropriate and needed, provide lighting, including flashing red or amber warning lights.
The Contractor shall barricade and block all access to holes with orange plastic fence, flashing amber lights, or warning signs. Holes or trenches shall not be left open more than 24 hours unless approved by the CO.
C2-k) Maintenance of Traffic – The Contractor shall have all temporary construction signs and traffic control measures in place prior to beginning work. The Contractor is authorized to use roads under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to limitations and authorizations shown on the plans or specified under this contract, when such use will not damage the roads or National Forest resources, and when traffic can be accommodated safely.

As per phasing shown on the plans, the roads shall remain open and maintained for public travel, except as approved by the COR.
Any emergency vehicle shall be allowed immediate reasonable passage.
C2-l) Protection of Improvements – The Contractor shall complete sequences of construction activity in order to prevent damage to equipment, material, and articles incorporated into the work covered by this contract.
Contractor shall replace, or repair, as approved by the CO any improvements, covered under this contract or already existing, damaged by contractor’s operations.
Before shutting down operations, take all necessary precautions to prevent damage to the project, to minimize erosion, and to prevent spills.
C2-m) Site Cleanup – The Contractor shall be responsible for solid waste disposal and personal sanitation. The Contractor shall at all times keep the area in a clean, neat, and orderly condition. Construction related debris including, but not limited to: used motor oil, oil cans, grease cartridges, and refuse, shall be removed promptly from the site and disposed of in a lawful manner off National Forest System lands. Fees for the use of landfills or transfer stations shall be paid for by the Contractor if there is a charge.
C2-n) Other Operations – The contractor shall avoid interference with the operations of other contractors or projects in the area.
C2-o) Scheduling – Portions of the campground will be open to the public during construction. For construction beginning in 2016, contractor shall begin operations in the southern half of the campground, completing awarded work there before mobilizing to the northern half, unless approved by the Forest Service.
Please refer to “Water & Electrical Construction Scheduling Notes” on sheet C-002 of the Water and Electric plans for additional details on timing and location. Inform Forest Service three (3) weeks prior to demolition of any existing building. Note demolition schedule on Schedule of Operations. For wastewater construction during the camping season, no more than three (3) toilet buildings shall be out of operation at one time. Limit down time for any given toilet as much as possible, with no more than 10 weeks off-line.

1.2 SAFETY MEETING
A. Prior to commencing construction, representatives of the Contractor, including the Superintendent, shall meet with the Government to review the Contract's safety and health requirements.
B. The Contractor's safety and health program shall be reviewed, and implementation of safety and health provisions pertinent to the Work shall be discussed.
1.3 COMPLIANCE WITH REGULATIONS

2.1 PERSONNEL PROTECTIVE EQUIPMENT
A. Special facilities, devices, equipment and similar items used by the Contractor in execution of the Work shall comply with 29 CFR Part 1910, Subpart I and other applicable regulations.
PART 3 - EXECUTION
3.1 EMERGENCY SUSPENSION OF WORK
A. In accordance with FAR 52.236-13, when the Contractor is notified by the Government, of noncompliance with safety or health provisions of the Contract, the Contractor shall immediately, correct the unsafe or unhealthy condition. In accordance with FAR 52.236-13 if the Contractor fails to comply promptly, all or part of the Work will be stopped by Government notice. The Contractor shall not be allowed any extension of time or compensation for damages in connection with a work stoppage for unsafe or unhealthy conditions.
3.2 PROTECTION OF PERSONNEL
A. The Contractor shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.
3.3 ENVIRONMENTAL PROTECTION
A. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances and regulations.
B. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.

FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 07/31/2015 this time stated for completion shall include final cleanup of the premises.

SECTION G--CONTRACT ADMINISTRATION DATA

A post award conference with the successful offeror is required. It will be scheduled and held within ___10___ days after the date of contract award. The conference will be held at __TBD_________.
DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The contracting Officer will designate a Contracting Officer's Representative(COR) at the time of award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer.
Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal for a contract claim.

All invoices are to be submitted online via the electronic Invoice Processing Platform.
