About this file
This is a Special Provisions addition document issued by HUD addressing compliance requirements for the North Woodrow Wilson Street Sidewalk Improvements project in Florida, a Community Development Block Grant (CDBG)-funded infrastructure initiative. The project encompasses the addition of sidewalk on the east side of N. Woodrow Wilson Street from W. Lowry Avenue to the CSX railroad, including flexible paving, grading, drainage, concrete sidewalks and driveways, stripping, signage, tree removal, sodding, and replacement of an existing potable watermain and appurtenances. The document specifies that all subrecipients, contractors, developers, and other entities receiving Covered CPD Program funds through the CDBG grantee must comply with the Build America, Buy America Act (BABA) requirements as enacted under the Infrastructure Investment and Jobs Act (IIJA), Public Law 117-58, 41 U.S.C. § 8301 note.
The document mandates that notification of BABA compliance requirements must be included in all subawards, contracts, purchase orders, requests for proposals, and relevant procurement and bid documents. Specifically, all construction, alteration, maintenance, or repair of infrastructure funded with Federal Financial Assistance must apply a domestic content procurement preference (Buy America Preference or BAP) for materials, unless HUD has issued a specific waiver. The document provides sample language for grantees to incorporate into their procurement documents and directs parties to https://www.hud.gov/baba for additional details on fulfilling BABA requirements.

Text version
Subrecipient Compliance with BABA Requirements The terms and conditions of Federal awards attach to the FFA and flow down to subrecipients at all tiers. This means that all subgrantees, contractors, developers, etc., who receive Covered CPD Program funds through a CPD grantee must comply with BABA requirements. Language notifying subrecipients that the procurement of materials for public infrastructure projects must comply with the BAP must be included in all subawards, contracts, purchase orders, requests for proposals, and all other relevant procurement and bid documents.
Sample language that grantees may use for this purpose is included below.
Pursuant to the Build America, Buy America Act (BABA), enacted as part of the Infrastructure Investment and Jobs Act (IIJA). Pub. L. 117-58, 41 U.S.C. § 8301 note, the Federal Financial Assistance used to fund this infrastructure project is required to apply a domestic content procurement preference (the “Buy America Preference” or “BAP”) for all construction, alteration, maintenance, or repair of infrastructure, including buildings and real property, unless application of the BAP has been waived by HUD. Additional details on fulfilling the BABA requirements can be found at https://www.hud.gov/baba.
