Addendum No. 7 to DCF ITN 2425 012 – SFETC Operations

This addendum document modifies the Florida Department of Children and Families (DCF) Invitation to Negotiate (ITN) for Southeast Florida Evaluation and Treatment Center (SFETC) Operations. The DCF, Office of Substance Abuse and Mental Health, seeks a single qualified respondent to provide comprehensive forensic mental health facility operations for a 249-bed state-owned facility in Florida City serving adults and juveniles adjudicated as adults under Chapter 916, Florida Statutes, including individuals deemed Incompetent to Proceed (ITP) or Not Guilty by Reason of Insanity (NGI). Services encompass full facility management, operations, maintenance, security integration, and substance abuse and mental health treatment. The anticipated contract start date has been revised to July 1, 2026, with an initial term of five years following the start of service and a potential five-year renewal option. The response submission deadline is January 8, 2026. The Services Approach and Solution section page limit has been increased from 50 to 75 pages to accommodate comprehensive program and facility management descriptions. Key organizational requirements include submission of Appendix V (Program Description Template) and Appendix VI (Facility Management Description Template) with detailed information on staffing, plans, and programs.

This addendum addresses 66 written inquiries from prospective respondents and implements 12 substantive changes to the original ITN. Notable amendments include clarification that a single award is intended despite reserved rights language; correction of contract term dates from September 1, 2025, to July 1, 2026; requirement for a new Proposed Cost Allocation Plan (Appendix IX) supporting the Budget Summary and Pricing Schedule; and updated staffing plan corrections, particularly in the Treatment/Mental Health section. The incumbent provider is identified as Recovery Solutions, LLC. Respondents must provide pricing for a pricing schedule spanning from July 1, 2026, through August 31, 2035 (initial term and renewal period), based on a rate of $0.00 per available bed day with 249 beds and varying daily counts. The facility is The Joint Commission (TJC) accredited under Behavioral Health Care standards and currently maintains 141 operational cameras, 55 Wi-Fi access points, two negative pressure rooms, and one dental chair. Key operational data includes current staffing vacancies in multiple positions with documented vacancy deduction penalties totaling over $1.98 million across three fiscal years. The Department does not provide property insurance; respondents are responsible for all other required insurance coverage. No federal funding is involved in this contract, which is funded through general revenue appropriations with an anticipated annual budget not exceeding $32,006,062.

Department’s Discretion

Section 1.1 states that the Department is seeking a single qualified respondent.

Section 2.10.1.4 states that the Department may select more than one Respondent.

Please clarify the Department’s intent.

The Department’s intent, as stated in Section 1.1, is to contract with a single qualified Respondent to operate the South Florida Evaluation and Treatment Center (SFETC).

Section 2.10.1.4 is part of standard reserved rights language and provides flexibility to select more than one Respondent if necessary due to unforeseen circumstances or if in the State’s best interest.

However, for this procurement, the Department intends to make only one award, and the inclusion of Section

2.10.1.4 does not change that intent.

Agreement

The ITN states “The anticipated start date of the resulting contract is September 1, 2025”. However, this is prior to the submission day.

Refer to Change No. 1.

No, each Respondent may submit only one official Response to this solicitation. Multiple separate submissions from the same Respondent will be deemed non-responsive and will not be evaluated.

However, a single Response may include multiple approaches, models, or options for delivering the required services (e.g., alternative staffing configurations, PMT-08 9 Rev. January 30, 2024

5. GEO Care 3.4.4

Respondent’s Response

The section states “The Respondent’s Response and any additional submittals, if incorporated into or attached to the contract.

Can the Department confirm that the response will be attached to the contract?

The Department’s intent is that relevant portions of the awarded Response —including any additional submittals required by the Department—may be incorporated into the resulting contract, but only to the extent that those elements are expressly accepted or modified through negotiations and reflected in the executed contract.

Inclusion of the Response does not signify Departmental acceptance of or agreement to any terms, conditions, or representations contained therein unless those terms are specifically incorporated into and made part of the executed contract. Section 4.2.1 provides the required contents for the Title Page, and 4.2.1.6 states:

Name, title, telephone number of three

(3) state or federal clients for whom the Respondent has operated facilities for within the past five years.

Since the Title Page is typically a one-page document, is it the Department’s intent to have Respondents include this information on the Title Page, or would the Department allow Respondents to include this information with their completed Appendix V: Program Description Template as part of the response to Item C. Organizational Capacity? If Respondents may include this information with Appendix V, will the Department consider increasing the page limit for Section 4: Services Approach and Solution?

The Department recognizes that the information required in Section 4.2.1.6 may not fit on a single page. Respondents may expand the Title Page section as needed to include all required information, including the contact details for three state or federal clients, provided the format remains clear and concise.

The additional space used to satisfy the Title Page requirements will not count toward the page limit for the remainder of the Response.

Responding to the ITN the goals identified in both Appendix V - Program Description Template and Appendix VI - Facility Management Description Template. Increasing the number of pages available for Section 4: Services Approach and Solution from the current 50 pages to allow submission of at least 75 pages will enable Respondents to provide a more thorough response, supporting the ability of the Evaluators to determine the best value to the state.

SFETC is not Medicare-certified. Therefore, there is no Medicare or Medicaid revenue to report for the past three fiscal years. Most forensic residents served at SFETC are not eligible for Medicaid reimbursement due to the federal Institution for Mental Diseases (IMD) exclusion, which prohibits federal Medicaid payments for services provided to individuals between the ages of 21 and 64 who are residing in institutions primarily engaged in the treatment of mental diseases.

The section states “The negotiation process is intended to enable the Department to determine which Respondent presents the best value, whether and with whom it will contract, and to establish the principal terms and conditions of such contract.

How does the Department interpret best value? Please clarify as there is no definition of best value in the ITN.

The term “best value” is in section 287.012(4), F.S., which defines “best value” as:

“The highest overall value to the state based on objective factors that include, but are not limited to, price, quality, design, and workmanship.”

However, consistent with section 287.057, F.S., and standard state procurement practice, the Department reserves the right to require a performance bond if it is determined to be in the best interest of the State, such as
