Re: Notice of Intent
Allen Street Reconstruction
Braintree, MA
MassDOT Project No. 613727
Pare Project No. 18221.02
Dear Ms. Feeley and Members of the Braintree Conservation Commission:
On behalf of the Town of Braintree (the Town), Pare Corporation (Pare) has prepared this Notice of Intent
(NOI) pursuant to the Regulations of the Massachusetts Wetlands Protection Act 310 CMR 10.00 (the
Regulations) and the Town of Braintree Wetland Bylaw (the Bylaw) for the proposed reconstruction of
Allen Street in Braintree, to be managed by the Massachusetts Department of Transportation (MassDOT).
The work described in this NOI is submitted under the Limited Project provisions of 310 CMR 10.53(3)(f).
Enclosed for your review are the following materials:
• One (1) original and two (2) copies of a NOI for the above-referenced project, including the WPA
Form 3, WPA Transmittal Form, Abutter Notification Documentation, Figures, Project Narrative, Existing Conditions Photographs, Wetland Delineation Report, and Stormwater Report; and
• Two (2) full size sets of Project Plans, entitled “Massachusetts Department of Transportation
Highway Division - Allen Street” dated April 2026, bound separately.
• One (1) set of pre-addressed, stamped envelopes for abutter notifications, to be circulated by the
Braintree Conservation Commission.
An electronic copy of the NOI is being sent concurrently to the Massachusetts Department of
Environmental Protection (DEP) Southeast Regional Office. As a municipality, the Town is exempt from state and local filing fees.
The Town, as the Applicant, proposes the reconstruction of Allen Street with a one-way traffic conversion along with associated site improvements including but not limited to sidewalks, replacement of retaining walls, installation of pedestrian railings, and utility replacement and relocation. Under existing conditions, Allen Street has numerous deficiencies including deteriorated pavement, sidewalk, curbing, and retaining wall conditions, steep roadway cross slopes, narrow roadways with insufficient street parking, traffic obstruction caused by street parking, and troublesome intersections.
The project is located within the 200-foot Riverfront Area associated with the Weymouth Fore River as well as the Buffer Zones associated with the river and an adjacent Bordering Vegetated Wetland. In addition, portions of the work area downslope of the south retaining wall will result in temporary
A00860 - 4
Braintree Conservation Commission (2) April 15, 2026 construction impacts within Land Subject to Coastal Storm Flowage and Coastal Bank (corresponding to the 100-year flood elevation). The project avoids direct impacts to the river and Bordering Vegetated
Wetlands. Most of the proposed work area is comprised of impervious surfaces within the public right-of-way. Minor encroachments into vegetated areas are necessary to accommodate the roadway, retaining wall, and drainage improvements; however, these impacts have been minimized to the extent practicable given the constraints of the site. The project will result in the unavoidable loss of eighteen (18) trees greater than
4” diameter, most of which are located within the retaining walls supporting the roadway. The Town shall coordinate with the Commission on appropriate mitigation to address the tree replacement requirement under the local Tree Protection Policy.
On behalf of the Town, Pare respectfully requests that the Braintree Conservation Commission issue an
Order of Conditions allowing the project to proceed as proposed. Thank you for your consideration of this application. If you have any questions, please feel free to contact us.
Sincerely, Lauren Gluck, P.W.S.

PROJECT NARRATIVE
A00860 - 34
Pare Corporation Allen Street Reconstruction Pare Project No. 18221.02 Notice of Intent
-1-
I. Introduction
This Notice of Intent (NOI) is submitted by Pare Corporation (Pare) on behalf of the Town of
Braintree (the Town) for the proposed reconstruction of Allen Street in Braintree, extending approximately 0.26 miles between the intersection with Shaw Street and Thayer Road and the intersection with Quincy Avenue (Route 53). This NOI is submitted pursuant to the Regulations of the Massachusetts Wetlands Protection Act 310 CMR 10.00 (referred to herein as the WPA
Regulations) and the Town of Braintree Wetland Bylaw (referred to herein as the Bylaw) in accordance with the Limited Project provisions of 310 CMR 10.53(3)(f) for “maintenance and improvement of the existing public roadways.”
The project addresses various deficiencies with Allen Street including deteriorated pavement, sidewalk, curbing, and retaining wall conditions, steep roadway cross slopes, narrow roadways with insufficient street parking, traffic obstruction caused by street parking, and troublesome intersections.
The construction of the project will be managed by the Massachusetts Department of Transportation
(MassDOT). The project goal is to address these deficiencies and increase accessibility and safety for pedestrians and traffic flow. Proposed improvements include intersection geometric changes, converting Allen Street to one-way traveling westward with street parking, an 8-foot sidewalk, and improvements to intersection approaches, drainage, sanitary sewer, retaining walls, and other associated features within the project limits.
The project is located within the 200-foot Riverfront Area associated with the Weymouth Fore River as well as the Buffer Zones associated with the river and an adjacent Bordering Vegetated Wetland.
In addition, portions of the work area downslope of the south retaining wall are located within Land
Subject to Coastal Storm Flowage, and minor temporary impacts are proposed to Coastal Bank
(corresponding to the 100-year flood elevation). The project avoids direct impacts to the river and bordering vegetated wetlands. Most of the proposed work area is comprised of impervious surfaces within the public right-of-way. Per 310 CMR 10.02(2)(b)2.p., portions of the work in the 100-foot buffer Zone and 200-foot Riverfront Area qualify as “minor activities” not requiring WPA review, including “pavement repair, resurfacing, and reclamation of existing roadways within the right-of-way configuration provided that the roadway and shoulders are not widened”; however, note that these are not exempt from review under the Bylaw. Minor encroachments into previously disturbed vegetated areas are necessary to accommodate the roadway, sidewalks, retaining wall, and drainage improvements; however, these impacts have been minimized to the extent practicable given the constraints of the site.
The following narrative discusses the project background and existing site conditions; demonstrates the need for the work; describes the proposed project; discusses activity within jurisdictional areas;
and demonstrates project compliance with the applicable regulatory provisions of the WPA
Regulations and the Bylaw.

II. Existing Site Conditions
A. PROJECT LIMITS
The project area includes the intersection of Allen Street, Shaw Street, and Thayer Road, along with the entire eastern segment of Allen Street branching approximately 0.26 miles from the intersection to its intersection with Quincy Avenue (Route 53). The limits of each of the other roadway approaches at the intersection extend approximately 50 feet each, except for Thayer Road, which extends approximately 100 feet. Minor encroachments onto surrounding properties will be necessary to complete the reconstruction of the roadway and associated wall repairs and drainage improvements.
MassDOT is currently in the process of obtaining easements from these property owners, which include the parcels listed on WPA Form 3 “Attachment A” in Section 1.
B. ALLEN STREET
Allen Street runs west/east in the vicinity of the project area and is classified as a major collector under Town jurisdiction. Allen Street has two-way traffic and a roadway width that varies throughout its extent. The roadway lacks any lane striping except for a short segment at the intersection with
Quincy Avenue. This segment of Allen Street contains a bituminous concrete sidewalk of varying width on the south side extending the whole distance from Shaw Street to Quincy Avenue. There are existing retaining walls along the sidewalk in areas with steep slopes and drop-offs. Along the south side of the roadway, passenger cars and trucks use the sidewalk as parking to allow clearance for traffic to pass. Both sides of the roadway contain residential buildings and houses with little to no setbacks from the sidewalk and street pavement. The posted speed limit is 25 miles per hour.
The pavement on Allen Street from the intersection with Shaw Street to the intersection with Quincy
Avenue is in poor condition. The roadway pavement is deteriorating, with alligator cracking, longitudinal cracking, edge cracking, potholes, and patching. The condition of pavement on Shaw
Street and Quincy Avenue is generally good, appearing to have been paved in the past few years. The east segment of Allen Street has no curbing on the north side of the roadway. The south side has varying curb types including bituminous concrete, granite, and concrete curbs with steel edging embedded. Most sections of the curb, like the sidewalk, are in poor condition and are even missing in some locations. The curb reveals are not uniform along the roadway. Granite curb is present on Shaw
Street and the west segment of Allen Street. Bituminous concrete berm is present on Thayer Road.
All curbing on these streets is fair to good condition.
The majority of Allen Street is not striped within the project limits, with the exception of some faded centerline on the approach to Quincy Avenue. Each of the project intersections have striped stop bars and crosswalks. The condition of signage within the project limits is good, while others, typically along the local roadways, are faded and/or do not meet the standards set by the Manual on Uniform
Traffic Control Devices (MUTCD).
A00860 - 36
-3-
There are temporary chain-link fences and construction barriers on Allen Street in front of a future development under construction. As mentioned previously, the construction barriers and fencing block off the existing sidewalk and narrow the roadway.
The south side of Allen Street between Thayer Road and Quincy Avenue is supported by various stone masonry walls, both cemented and dry-laid that are in poor to fair condition, with some localized sections that have previously failed. Wall-mounted chain link fence is installed throughout with embedded fence posts that are in poor to severe condition. At the Allen Street and Shaw Street intersection, there are short masonry retaining walls on the northeast and northwest corners. These walls are in fair condition and are not expected to be affected by construction.
C. INTERSECTION OF ALLEEN STREET, SHAW STREET, AND THAYER ROAD
The intersection of Allen Street with Shaw Street and Thayer Road forms a five-legged layout that includes Shaw Street at both the north and south approaches, Allen Street at the east and west, and
Thayer Road to the northeast. The intersection is stop-controlled but not signalized, with existing stop signs located at both the east and west segments of Allen Street and at the Thayer Road approach.
Neither the north nor the south approach on Shaw Street has stop signs, allowing traffic to flow freely in both directions. This intersection has bituminous concrete sidewalks and ramps leading to the roadway grade; however, these will need to be reconstructed as they are not ADA-compliant. There are striped crosswalks across both sides of Allen Street, but none to cross Shaw Street at this intersection.
As the east segment of Allen Street approaches Shaw Street, the visibility of southbound traffic from the north Shaw Street approach is limited due to a retaining wall, tree, and vegetation on the northeast corner of the intersection. Drivers need to pull out past the existing crosswalk to see oncoming traffic from Shaw Street southbound.
D. SHAW STREET
Shaw Street runs north/south in the vicinity of the project area and is classified as a major collector under Town jurisdiction. Shaw Street makes up both the north and south approaches of the project intersection, and the roadway consists of double yellow centerlines with 12-foot lanes and striped shoulders of varying widths. On the north approach of the intersection, Shaw Street has bituminous concrete sidewalk and granite curb on both the east and west sides. On the south approach, Shaw
Street has a bituminous concrete sidewalk with granite curb on the east side of the roadway. There is no posted speed limit on the roadway, however, the Town of Braintree Engineering Department has confirmed that the official speed limit is 30 miles per hour.
A00860 - 37
Pare Corporation Allen Street Reconstruction Pare Project No. 18221.02 Notice of Intent
-4-
E. THAYER ROAD
Thayer Road is a two-way, local road under Town jurisdiction. The roadway runs northeast/southwest, beginning on the east side of Shaw Street and continues northeast approximately 0.27 miles to its terminus. Thayer Road has a typical width of approximately 20 feet with varying pavement widths along the extents of the roadway. The roadway lacks centerline striping, delineated shoulders, and sidewalk within project limits. Thayer Road has bituminous concrete berm running on both the north and south side of the roadway. The stop bar at the Shaw Street and Allen Street intersection is striped with no other markings. Thayer Road is steep approaching the intersection, with slopes exceeding
10%, but the slopes become more gradual towards the stop bar and intersection center. There is no posted speed limit on Thayer Road; therefore, a de facto speed limit of 30 miles per hour is assumed.
F. INTERSECTION OF ALLEN STREET AND QUINCY AVENUE
Allen Street ends at Quincy Avenue (Route 53) as a stop-controlled “T” intersection. Quincy Avenue is a 4-lane roadway on a steep decline from north to south. There is faded crosswalk and stop line striping crossing Allen Street, but only the south side of the roadway has a pedestrian curb ramp. The south side of the Allen Street crossing has temporary construction fencing and barriers as a new development is being constructed. The end of the bridge guardrail by the southern pedestrian curb ramp is broken and leaning.
G. BICYCLE AND PEDESTRIAN ACCOMMODATIONS AND ADA COMPLIANCE
Sidewalks exist on four of the five approaches of the Shaw Street and Allen Street intersection. Shaw
Street on the south approach has bituminous concrete sidewalk on the east side of the roadway. The north approach of Shaw Street and the west approach of Allen Street have bituminous concrete sidewalk on both sides of the roadway. All sidewalks mentioned are in fair to good condition with only occasional cracking.
The east segment of Allen Street has bituminous concrete sidewalk extending the full length of the south side of the road. The sidewalk is deteriorating to the point where the underlying soil is visible, and it has multiple signs labeling it as closed. Residents currently use the closed-off sidewalk as parking due to the narrow roadway width and limited curb reveal. The sidewalk in front of the development being constructed is fenced in with surrounding barriers.
There are striped crossings with ramps on Allen Street at both the intersections with Shaw Street and
Quincy Avenue. Other than one ramp in poor condition by Quincy Avenue, none of the existing curb ramps within project limits are ADA-compliant. The ramps are bituminous concrete and do not have detectable warning panels. The curb ramp on the southeast corner of the Shaw Street intersection exceeds the maximum allowable slope.
H. DRAINAGE AND UTILITIES
A00860 - 38
Pare Corporation Allen Street Reconstruction Pare Project No. 18221.02 Notice of Intent
-5-
Subsurface utilities within the project limits include electric, gas, water, drainage, and telecommunications. Several existing electric and communications duct banks and vaults are present within Allen Street. There are several catch basins and manholes within the roadway. Some of the existing drainage outfalls directly through the existing retaining wall along the south side of Allen
Street. Due to the height of the wall, this has led to erosion on the downhill side of the retaining wall under the drainage discharge.
I. WETLANDS AND FLOODPLAIN
According to the FEMA Flood Insurance Rate Map (FIRM) (Panel 25021C0226G revised July 8, 2025), the southern limits of the site are located within Flood Zone AE, 1% chance annual flooding, with a varying flood elevation of 11.5 to 10 (NAVD 88). Areas below the flood elevation are designated as Land Subject to Coastal Storm Flowage. A copy of the FIRM is attached as Figure 3.
Additional wetland resource areas in the vicinity of the site include the 200-foot Riverfront Area associated with the Weymouth Fore River, a tidal waterway to the south of the site; one area Bordering
Vegetated Wetland (BVW) adjacent to the river; and Coastal Bank corresponding to the 100-year flood elevation. Most of the river edge is developed and consists of vertical walls and riprap slopes, except for a low-lying area between 44 and 50 Allen Street where the BVW is present. Most of the
200-foot Riverfront Area on and directly bordering the site is degraded, consisting of the existing roadways, walls, a vehicle storage lot, driveways, and shoulder areas lacking topsoil. Non-degraded
Riverfront Area is present in vegetated areas south of the retaining walls between 44 and 50 Allen
Street, and between 60 and 94 Allen Street. Pare Corporation completed a delineation of this area on
March 10, 2026, and a follow-up investigation to document trees and Riverfront Area conditions on
April 9, 2026.
Wetlands are described in greater detail in the Wetland Delineation Report, which is included as
Section 6 of this NOI.
