About this file
This is a Liquidated Damages Form for the Town of Palm Beach, Florida, establishing the financial penalties for contract performance delays. The form outlines that the Town and Contractor acknowledge the difficulty in calculating damages resulting from untimely project completion and therefore agree that the Contractor and its surety shall be liable for liquidated damages based on the Florida Department of Transportation schedule (paragraph 8-10). Damages accrue daily from the date after the scheduled completion date, including any approved written time extensions via Change Orders, and continue accumulating until the Work achieves final Completion. Should the Contractor be terminated for default prior to Completion, liquidated damages continue to accrue and are charged against the Contractor until the Work is completed. The form requires the Contractor's authorized representative to sign confirming understanding and compliance with these liquidated damages terms.
For the related Par 3 Restroom Renovation project, the estimated budget is $232,000.00, with construction required to commence by July 7, 2026, substantial completion by the end of September 2026, and final completion by October 15, 2026. A mandatory Pre-Bid/Site visit will be held in person at Palm Beach Par 3, 2345 South Ocean Boulevard, Palm Beach, Florida 33480, and bids from firms without representative attendance at this meeting shall be deemed non-responsive and ineligible for award. The Town will award the contract to the lowest responsive and responsible bidder meeting all requirements and reserves the right to reject any or all bids. Selected contractors must possess a General Contract License, Certified Electrical Contractor certification, and Certified Plumbing Contractor certification. All bids must be submitted online through Euna Procurement (Bonfire), the Town's eProcurement platform.
