About this file

This is a Liquidated Damages Form from the Town of Palm Beach, Florida, establishing the financial penalties associated with project delays. The form outlines that the Town requires timely completion of work, with time being of the essence. The contractor and the contractor's surety are jointly liable for liquidated damages assessed on a per-calendar-day basis following the scheduled completion date. The damages are assessed according to the Town's adopted Florida Department of Transportation schedule (paragraph 8-10) and continue to accrue if the contractor is terminated for default prior to project completion. The form requires the contractor to acknowledge understanding and compliance with the liquidated damages terms through authorized signature, confirming the contractor's awareness of financial exposure for schedule delays or failure to complete the work.

This document serves as a binding acknowledgment by the contractor regarding delay penalties applicable to the A39, A42, A43 Pump Station Ventilation Improvements project. The liquidated damages calculation follows the FDOT schedule, though the specific dollar amounts per calendar day are referenced as "attached list" within the form but not detailed in this document excerpt. The form does not address pricing for the work itself, set-asides, or funding sources, as those elements are covered in the related Invitation to Bid and associated contract documents. The liquidated damages provision applies regardless of whether delays result from contractor performance issues or other circumstances, and penalties continue accumulating through project completion.
