About this file

This is a Certificate of Residency Form attachment required for the Hays Consolidated Independent School District's Property Management Services contract opportunity in Texas. The form implements Texas Government Code Chapter 2252, Subchapter A, which establishes residency requirements and preferences for state and local contracts. Proposers must certify their residency status by identifying whether they are resident proposers (those whose principal place of business is in Texas, including contractors whose ultimate parent company or majority owner is based in Texas) or non-resident proposers. The form requires proposers to identify the city and state of their principal place of business and includes a certification signature line for the proposer's authorized official.

Non-resident proposers face a competitive disadvantage under this law, as they may only be awarded a contract if they underbid the lowest proposal submitted by a responsible resident proposer by an amount equal to the preferential treatment percentage that the non-resident proposer's home state would require of Texas contractors. If the non-resident proposer's home state has preferential treatment on bids, the proposer must disclose the applicable percentage. This statutory requirement ensures that Texas-based contractors receive favorable consideration while maintaining compliance with state law governing contractor residency and competitive bidding practices.
