About this file
This attachment document outlines the Certificate of Interested Parties (Form 1295) filing requirements established by Texas House Bill 1295 for the Hays Consolidated Independent School District's Property Management Services contract solicitation. The disclosure requirement applies to business entities entering into contracts with the District on or after January 1, 2016, and requires submission of the completed Form 1295 at the time the signed contract is submitted to the District. The filing obligation is limited to contracts that require board action or vote before execution, have a value of at least $1 million, or involve services requiring lobbyist registration under Texas Government Code Chapter 305.
The disclosure requirement does not apply to publicly traded business entities, including wholly owned subsidiaries, or electric and gas utilities as defined by Texas Utilities Code. Prospective contractors must complete Form 1295 using the filing application available on the Texas Ethics Commission website, print the completed form with its certification of filing and unique certification number, obtain authorization and notarization from an authorized agent, and submit the notarized form to the District. The Texas Ethics Commission provides the form and assistance at 512-463-5800 or https://www.ethics.state.tx.us/whatsnew/elf_info_form1295.htm. Bidders must certify whether Form 1295 filing is required or not required for their submission.

In 2015, the Texas Legislature adopted House Bill 1295, which added section 2252.908 of the
Government Code. The law states that a governmental entity or state agency may not enter into certain contracts with a business entity unless the business entity submits a disclosure of interested parties to the governmental entity or state agency at the time the business entity submits the signed contract to the governmental entity or state agency. The disclosure requirement applies to a contract entered into on or after January 1, 2016. The requirement above applies only to a contract of a district that:
1. Requires an action or vote by the board before the contract may be signed;
2. Has a value of at least $1 million; or
3. Is for services that would require a person to register as a lobbyist under Government Code
Chapter 305 Tex. Gov't Code 2252.908
The disclosure requirement does not apply to a contract with:
1. A publicly traded business entity, including a wholly owned subsidiary of the entity;
2. An electric utility, as defined by Utilities Code 31.002; or
3. A gas utility, as defined by Utilities Code 121.001.
