About this file

This is a Felony Conviction Notice Form attachment for a Property Management Services contract solicitation issued by the Hays Consolidated Independent School District in Texas. The form requires all proposers to disclose whether they or their firm's owners or operators have been convicted of felonies, in compliance with Texas Education Code Section 44.034. Proposers must certify their felony conviction status by selecting one of three options: confirmation that the firm is a publicly-held corporation exempt from the reporting requirement, attestation that no owners or operators have felony convictions, or detailed disclosure of any felony convictions including the names of convicted individuals and specifics of their convictions. The District reserves the right to terminate contracts with proposers who fail to provide required notice or who misrepresent information regarding convictions.

The form mandates that vendors ensure all persons, employees, and subcontractors assigned to provide services at District campuses or facilities have no history of violent, unacceptable, or grossly negligent behavior and no felony convictions. An authorized company official must sign and date the certification, with the signatory's name and signature matching those provided on the proposal affidavit. This documentation is a required submission component of the proposal package and serves as a critical compliance and risk mitigation mechanism for the District in evaluating vendor qualifications for the comprehensive property management services contract.
