About this file

This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more with the County. The form pertains to the Parking Management Services contract for Fort Lauderdale-Hollywood International Airport being solicited by the Broward County Aviation Department. The certification must be completed and returned with the vendor's submittal, or if not provided initially, within three business days of the County's request. Failure to comply within the stated timeframe may result in the vendor being deemed nonresponsive. The form requires vendors to certify compliance with Section 26-125(d) of the Broward County Code of Ordinances regarding criminal history screening practices for employment.

Vendors must certify one of two conditions: either that they have implemented or will implement upon contract award policies and procedures that preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position; or that they are exempt from these requirements because they are required by applicable federal, state, or local law to conduct criminal history background checks at a different time or manner, or because they are a governmental agency. Non-compliance with the criminal history screening requirements constitutes a material breach of contract and entitles Broward County to pursue all available remedies, including contract termination and debarment or suspension proceedings consistent with Chapter 21 of the Broward County Administrative Code. The certification form is dated September 9, 2024.

Section 26-125(d) of the Broward County Code of Ordinances (“Criminal History Screening Practices”) requires that a Vendor seeking a contract in the amount of $100,000 or more with Broward County shall certify:

B. This requirement shall apply only to positions located within the United States that will foreseeably perform work under a contract with Broward County.

C. The failure of Vendor to comply with Section 26-125(d) at any time during the contract term shall constitute a material breach of the contract, entitling Broward County to pursue any remedy permitted under the contract and any other remedy provided under applicable law.

D. If Vendor fails to comply with Section 26-125(d) at any time during the contract term, Broward County may, in addition to all other available remedies, terminate the contract and Vendor may be subject to debarment or suspension proceedings consistent with the procedures in Chapter 21 of the Broward County Administrative Code.
