About this file

This is an FAA Buy American Preference certification document issued by the Federal Aviation Administration for the City of Amarillo's Baggage Handling System Modernization project at Rick Husband Amarillo International Airport (Bid Number BVB-414-26, Project Number 540402). The document outlines mandatory compliance requirements for bidders participating in this Airport Improvement Program project, issued March 17, 2026. As a condition of bid responsiveness, all bidders must complete and submit a certification statement indicating their compliance strategy with 49 U.S.C. § 50101 and the Buy America Act (BABA). Bidders must select one of four mutually exclusive certification options: installing only U.S.-produced steel and manufactured products; installing only specified U.S.-manufactured construction materials; installing products with FAA-issued waivers; or installing excepted articles per Federal Acquisition Regulation Subpart 25.108.

Bidders selecting any of the first three compliance options must provide documentation of product sourcing and origin, commit to faithful compliance with domestic content requirements, and refrain from seeking waivers after contract establishment except under extenuating circumstances. Bidders unable to meet 100 percent Buy American preferences may qualify for a Type 3 waiver, requiring submission of formal waiver requests and supporting documentation within 15 calendar days of being selected as the responsive bidder; failure to submit documentation results in rejection. The document specifies required documentation for Type 2 (Nonavailability), Type 3 (Domestic Content Below 60 Percent), and Type 4 (Unreasonable Cost Increase Exceeding 25 Percent) waivers, including content percentage worksheets, market research records, and comparative bid analyses. False certifications are subject to prosecution under federal law.
