Each bidder shall become informed as to the nature of the work, labor conditions, and other matters that may affect the cost and time of completion of the work. The failure or omission of any bidder to examine any form, instrument or document shall in no way relieve any bidder from any obligation in respect to his bid.
18. Specific Performance:
This contract will require specific performance on all criteria as stated in your proposal. All specifications as written unless specifically taken exception to by you, and that exception accepted by the City will be strictly adhered to. The bonds shall cover the faithful performance of the contract and the payment of all obligations arising in the form the owner prescribes and with such securities as the owner may approve. The period of the performance bond shall extend one year from the date of acceptance of all work performed under the contract. The contractor shall pay the premium for the required bonds.

BEST VALUE BID CRITERIA
BASIS OF PROPOSALS AND SELECTION CRITERIA
The City of Amarillo uses the Best Value Bid procurement method as authorized by the Texas
Legislature and further defined by Texas Local Government Code Title 8, Subtitle A, Section
252.043. Criteria used from Sec. 252.043(b) may include:
(a) the purchase price.
(b) the reputation of the bidder and of the bidder's goods or services.
(c) the quality of the bidder's goods or services.
(d) the bidder's past relationship with the COA
(e) any relevant criteria specifically listed in the request for bids or proposals.
The Maximum Point value is equal to 100 points. The selection criteria used to evaluate each proposal includes the following:
A. BASE BID PURCHASE PRICE (40 POSSIBLE POINTS):
Submit pricing with your bid response on the form of proposal (attachment A) provided with this bid document. The quality of Bidders is not judged solely by a low initial cost proposal or, conversely, eliminated solely because of a high initial cost proposal.
B. BIDDER QUALIFICATIONS (50 POSSIBLE POINTS):
Evaluation of the Bidder’s qualifications will use the “Bidders Statement of
Qualifications” and any past experience with the Bidder. The “Bidders Statement of
Qualifications” is a minimum, and the Bidder may provide additional pertinent information relevant to the project for which they are submitting this proposal.
Evaluation of Bidder’s qualifications will be based on the following:
a) Reputation of the Bidder and Bidder’s goods and services
b) The quality of the Bidder’s goods and services
c) The Bidder’s past relationship with the City of Amarillo.
d) The Bidder’s ability to perform the work within the time specified without delay or interference.
e) Evaluation of the experience and qualifications of the Bidder’s proposed key personnel to execute the project.
C. SAFETY RECORD QUESTIONNAIRE (10 POSSIBLE POINTS):
Evaluation of the Safety Record Questionnaire (found in Attachment B) will be based on the sum of the four questions in the questionnaire. Questions 1 through 3 have a maximum point rating of one (1) point. A NO response will receive 1 point. A
YES response will be evaluated for a point value between 0 and 1.
Question 4 relates to the Experience Modification Ratio(EMOD). The lowest EMOD score of proposals received becomes the standard of evaluation. The lowest EMOD will receive a maximum point score for Question 4 of two (2) points. Other EMOD scores will be evaluated by taking the lowest EMOD score and divide it by the EMOD score of the proposal being evaluated. That fraction will then be multiplied by the maximum point value of 2 to determine the point value for the proposal being evaluated.
