About this file

This is a bid criteria and statement of qualifications document issued by the City of Amarillo for the Rick Husband Amarillo International Airport Baggage Handling System Upgrades project. The City employs a Best Value Bid procurement method authorized under Texas Local Government Code Section 252.043, which allows evaluation criteria beyond price alone. Bidders must submit proposals on forms furnished by the City with pricing stated clearly and legibly in ink or typewritten format. All proposals must be executed properly with appropriate signatures and authorization documentation based on the bidder's business structure (individual, partnership, corporation, or other entity). The City requires joint ventures to comprise no more than two firms, with each completing separate evaluations. Failure to submit required evaluation information may result in proposal rejection at the City's discretion, and material misstatements on qualification forms may constitute grounds for rejection or post-award contract termination.

The City's evaluation framework allocates 100 maximum points across three categories: Base Bid Purchase Price (40 points), Bidder Qualifications (50 points), and Safety Record Questionnaire (10 points). Bidder Qualifications are assessed using a Statement of Qualifications addressing reputation, service quality, past City relationships, performance timelines, and key personnel experience. Safety Record evaluation examines OSHA citations within three years, environmental protection violations within five years, criminal convictions resulting in bodily harm within ten years, and Experience Modification Ratio (EMOD) scores. Bidders must provide comprehensive organizational information, including corporate structure, financial data, construction experience, key personnel biographical details with project histories, and major equipment lists. The City requires documentation of projects completed within the past five years, detailed subcontractor information for firms providing more than 10 percent of contract work, and reference contact information. Post-closing requirements mandate submission of a final subcontractor list within seven business days after the proposal due date.

INSTRUCTIONS FOR BID

1. PREPARATION FOR PROPOSAL

1.1 The proposal shall be correctly filled in, stating the price in numerals for which the Bidder intends to do the work contemplated or furnish the materials required. Such prices shall be written in ink, distinctly and legibly, or typewritten. In case of discrepancy between the unit price and the extended total for a proposal item, the unit price will be taken. A proposal that has been opened may not be changed for the purpose of correcting an error in the proposal price. The Bidder shall submit the proposal on forms furnished by the City, and any corrections to the proposal price must be made on the proposal submittal prior to proposal opening.

1.2 If the proposal is submitted by an individual, his name must be signed by him or his duly authorized agent. If a proposal is submitted by a firm, association, or partnership, the name and address of each member must be given and the proposal signed by a member of the firm, association or partnership, or person duly authorized. If the proposal is submitted by a company or corporation, the company or corporate name and business address must be given, and the proposal signed by an official or duly authorized agent. Powers of attorney authorizing agents or others to sign proposals must be properly certified and must be in writing and submitted with the proposal. The proposal shall be executed in ink.

BEST VALUE BID CRITERIA

BASIS OF PROPOSALS AND SELECTION CRITERIA

The City of Amarillo uses the Best Value Bid procurement method as authorized by the Texas

Legislature and further defined by Texas Local Government Code Title 8, Subtitle A, Section

252.043. Criteria used from Sec. 252.043(b) may include:

(a) the purchase price.

(b) the reputation of the bidder and of the bidder's goods or services.

(c) the quality of the bidder's goods or services.

(d) the bidder's past relationship with the COA

(e) any relevant criteria specifically listed in the request for bids or proposals.

The Maximum Point value is equal to 100 points. The selection criteria used to evaluate each proposal includes the following:

A. BASE BID PURCHASE PRICE (40 POSSIBLE POINTS):

Submit pricing with your bid response on the form of proposal from provided with this bid document. The quality of Bidders is not judged solely by a low initial cost proposal or, conversely, eliminated solely because of a high initial cost proposal.

B. BIDDER QUALIFICATIONS (50 POSSIBLE POINTS):

Evaluation of the Bidder’s qualifications will use the “Bidders Statement of

Qualifications” and any past experience with the Bidder. The “Bidders Statement of

Qualifications” is a minimum, and the Bidder may provide additional pertinent information relevant to the project for which they are submitting this proposal.

Evaluation of Bidder’s qualifications will be based on the following:

a) Reputation of the Bidder and Bidder’s goods and services

b) The quality of the Bidder’s goods and services

c) The Bidder’s past relationship with the City of Amarillo.

d) The Bidder’s ability to perform the work within the time specified without delay or interference.

e) Evaluation of the experience and qualifications of the Bidder’s proposed key personnel to execute the project.

C. SAFETY RECORD QUESTIONNAIRE (10 POSSIBLE POINTS):

Evaluation of the Safety Record Questionnaire will be based on the sum of the four questions in the questionnaire. Questions 1 through 3 have a maximum point rating of one (1) point. A NO response will receive 1 point. A YES response will be evaluated for a point value between 0 and 1.

Question 4 relates to the Experience Modification Ratio(EMOD). The lowest EMOD score of proposals received becomes the standard of evaluation. The lowest EMOD will receive a maximum point score for Question 4 of two (2) points. Other EMOD scores will be evaluated by taking the lowest EMOD score and divide it by the EMOD score of the proposal being evaluated. That fraction will then be multiplied by the maximum point value of 2 to determine the point value for the proposal being evaluated.

Bidders Statement of Qualifications

Individual Bidders and joint ventures submitting a proposal must complete the following evaluation information for the Project. Joint ventures shall be composed of not more than two firms and each firm must complete separate evaluations. Evaluation information must be submitted at time of proposal submittal. Failure to submit the following

Bidder Evaluation information may result in the OWNER considering the proposal non-responsive and result in rejection of the proposal by the OWNER. Bidders are to provide any additional information requested by the

OWNER.

The OWNER reserves the right to waive irregularities in determining the firm's qualifications and reserves the right to require the submission of additional information at the discretion of the purchasing agent in writing.

The qualifications of a firm shall not deprive the OWNER of the right to accept a proposal, which in its judgement is the best value to the OWNER, to reject any and all proposals, to waive irregularities in the proposals, or to reject nonconforming, non- responsive, or conditional proposals. In addition, the OWNER reserves the right to reject any proposal where circumstances and developments have in the opinion of the OWNER changed the qualifications or responsibility of the firm.

Material misstatements on the qualification’s forms may be grounds for rejection of the firm's proposal on this project.

Any such misstatement, if discovered after award of the contract to such firm, may be grounds for immediate termination of the contract. Additionally, the firm will be liable to the OWNER for any additional costs or damages to the OWNER resulting from such misstatements, including costs and attorney's fees for collecting such costs and damages.

Safety Record Questionnaire

The City of Amarillo City Council desires to avail itself of the benefits of Section 252.0435 of the Local Government Code, and consider the safety records of potential Bidders prior to awarding proposals on City contracts. Pursuant to Section

252.0435 of the Local Government Code, City of Amarillo has adopted the following written definition and criteria for accurately determining the safety record of a Bidder prior to awarding proposals on City contracts.

The definition and criteria for determining the safety record of a Bidder for this consideration shall be:

The City of Amarillo shall consider the safety record of the Bidders in determining the responsibility thereof. The City may consider any incidence involving worker safety or safety of the citizens of the City of Amarillo, be it related or caused by environmental, mechanical, operational, supervision or any other cause or factor. Specifically, the City may consider, among other things:

a. Complaints to, or final orders entered by, the Occupational Safety and Health Review Commission (OSHRC), against the Bidder for violations of OSHA regulations within the past three (3) years.

b. Citations (as defined below) from an Environmental Protection Agency (as defined below) for violations within the past five (5) years. Environmental Protection Agencies include, but are not necessarily limited to, the U.S. Army

Corps of Engineers (USACOE), the U.S. Fish and Wildlife Service (USFWS), the Environmental Protection

Agency (EPA), the Texas Commission on Environmental Quality (TCEQ), the Texas Natural Resource

Conservation Commission (TNRCC) (predecessor to the TCEQ), the Texas Department of State Health Services

(DSHS), the Texas Parks and Wildlife Department (TPWD), the Structural Pest Control Board (SPCB), agencies of local governments responsible for enforcing environmental protection or worker safety related laws or regulations, and similar regulatory agencies of other states of the United States. Citations include notices of violation, notices of enforcement, suspension/revocations of state or federal licenses or registrations, fines assessed, pending criminal complaints, indictments, or convictions, administrative orders, draft orders, final orders, and judicial final judgments.

c. Convictions of a criminal offense within the past ten (10) years, which resulted in bodily harm or death.

d. Any other safety related matter deemed by the City Council to be material in determining the responsibility of the

Bidder and his or her ability to perform the services or goods required by the proposal documents in a safe environment, both for the workers and other employees of Bidder and the citizens of the City of Amarillo.

In order to obtain proper information from Bidders so that City of Amarillo may consider the safety records of potential

Bidders prior to awarding proposals on City contracts, City of Amarillo requires that Bidders answer the following three (3) questions and submit them with their proposals:

QUESTION ONE

Has the Bidder, or the firm, corporation, partnership, or institution represented by the Bidder, or anyone acting for such firm, corporation, partnership or institution, received citations for violations of OSHA within the past three (3) years?

YES NO

If the Bidder has indicated YES for question number one above, the Bidder must provide to City of Amarillo, with its proposal submission, the following information with respect to each such citation:

Date of offense, location of establishment inspected, category of offense, final disposition of offense, if any, and penalty assessed.

Bidder’s Initials

QUESTION TWO

Has the Bidder, or the firm, corporation, partnership, or institution represented by the Bidder, or anyone acting for such firm, corporation, partnership or institution, received citations for violations of environmental protection laws or regulations, of any kind or type, within the past five years? Citations include notice of violation, notice of enforcement, suspension/revocations of state or federal licenses, or registrations, fines assessed, pending criminal complaints, indictments, or convictions, administrative orders, draft orders, final orders, and judicial final judgments.

If the Bidder has indicated YES for question number two above, the Bidder must provide to City of Amarillo, with its proposal submission, the following information with respect to each such conviction:

Date of offense or occurrence, location where offense occurred, type of offense, final disposition of offense, if any, and penalty assessed.

QUESTION THREE

Has the Bidder, or the firm, corporation, partnership, or institution represented by Bidder, or anyone acting for such firm, corporation, partnership, or institution, ever been convicted, within the past ten (10) years, of a criminal offense which resulted in serious bodily injury or death?

If the Bidder has indicated YES for question number three above, the Bidder must provide to City of Amarillo, with its proposal submission, the following information with respect to each such conviction:
