About this file

This is a Questions and Answers (Q&A) document for the Contractor-Hosted Fully Integrated Records Facility (FIRF) IDIQ solicitation (75F40126R00009). The file contains responses to inquiries submitted by potential offerors regarding the RFP requirements, evaluation criteria, and submission procedures. The Q&A document serves as an amendment to clarify ambiguities and provide additional guidance to bidders preparing proposals for this SDVOSB-exclusive contract opportunity.

The document addresses various technical and administrative questions related to the FIRF services contract, which is structured as a single IDIQ contract with a five-year ordering period allowing for Time-and-Materials, Labor-Hour, and Firm-Fixed Price task orders. As an amendment issued on October 7, 2026 (following Amendment 0002 from September 30, 2026), the Q&A provides authoritative interpretations to ensure all potential offerors have consistent understanding of solicitation requirements prior to the October 6, 2026 proposal deadline. The questions and answers cover topics relevant to offeror evaluation and contract performance expectations but do not independently specify products or services required, as those details are contained in the primary RFP and Statement of Work attachments.

Attachment E: Sample Task Order SOW; 7.3 Staffing Plan 9–10

99–100

24–25 Attachment E requires the staffing plan to include resumes of proposed personnel, while Section L.4 requires resumes only for Key Personnel and Section C.8.1 identifies only the Program (Contract) Manager as Key Personnel at the IDIQ level.

Given that the Contractor’s Project Manager will control task order scope, schedule, and costs and serve as the primary point of contact for task order performance, would the Government consider designating the Contractor’s Project Manager as Key Personnel at the task order level and requiring submission of the proposed individual’s name, resume, and signed letter of commitment? The government has revised "Attachment E-Sample Task Order Statement of Work" to include the Task Order Project Manager as Key Personnel in Section 18.
2RFP; C.11 Procurements Requiring Information Security and/or Physical Access Secutity; 7. Roster

Attachment E - Sample TO SOW; 7.1 Contractor Personnel; 7. Roster 17

22Section C.11.7 and Attachment E §7.1.7 require a roster of all staff by name, position, contact information and responsibility. Please confirm whether the roster is a post-award deliverable only, or whether the Government expects it to be included with the staffing plan in the technical proposal. The roster is a post-award deliverable and should not be included with the staffing plan in Volume 1-Technical Proposal.
3RFP; G.13 Other Direct Costs (ODCs)

Attachment K: Sample Task Order Pricing Sheet 37-38

AllSection G.13 states that ODCs associated with specific task orders shall be proposed and evaluated at the task order level. Please clarify how offerors should propose the fixed costs of the Contractor Off-Site Facility that supports all task orders (lease, utilities, security infrastructure, maintenance): as a separately priced IDIQ-level fixed facility CLIN, as an ODC under the first task order, or amortized into the fully burdened labor rates in Attachment K.The government has included, for evaluation purposes, a plug-in amount for facility allocation costs. Facility allocation has been historically allocated across the active task orders during a fiscal year. However, Offerors are reminded to review FAR Part 31.

101-102Section L.4.III lists the documents to be included in Volume 2. Please confirm that offerors may include additional supporting documentation in Volume 2, such as pricing assumptions, invoicing procedures per G.14/G.15, and insurance certificates per H.14, and identify where the Section L.1 supply-chain information should be placed in the proposal. The offerors may include additional supporting documentation such as pricing assumptions, invoicing procedures and supply-chain information in Volume 2-Business/Price Proposal (no page limitations). Offers may list pricing assumptions directly within "Attachment C-IDIQ Pricing Worksheet" and "Attachment K-Sample Task Order Pricing Worksheet," both of which include a "NOTES AND ASSUMPTIONS" tab.
5RFP; H.7 Organizational Conflicts of Interest; Organizational Conflict of Interest/Do Not Compete45-46Section H.7 states that the Contractor, its affiliates and subsidiaries, employees, subcontractors, consultants, and other participating personnel may not compete for, assist with, or furnish the requirements or services described in documents accessed or delivered under the contract. As written, this restriction could be interpreted as preventing the awardee and its team members from competing for a future follow-on or recompete of the FIRF IDIQ requirements.
Please confirm that performance under the resulting contract will not, by itself, preclude the awardee or its team members from competing as a prime contractor or subcontractor for the next iteration or recompete of these requirements, provided that no actual or unmitigated organizational conflict of interest exists. If this interpretation is incorrect, please revise the provision to define the specific activities covered, the duration of the restriction, and the circumstances under which it applies, consistent with FAR 9.507-2 and the examples in FAR 9.508.Performance under the resulting contract will not preclude the awardee or its team members from competing as a prime contractor or subcontractor for the recompete of these requirements, provided that no actual or unmitigated organizational conflict of interest exists.
6RFP; I.1 FAR 52.252-2 Clauses Incorporated By Reference (Feb 1998; Far 52.237-10, Identification of Uncompensated Overtime (Mar 2015)53FAR 52.237-10, Identification of Uncompensated Overtime, requires offerors to include a copy of the policy addressing uncompensated overtime with the proposal.

3. If no, please delete the FAR clause from the solicitation. The solicitation has been updated to remove FAR provision 52.237-10 Identification of Uncompensated Overtime (MAR 2015) from Section I of the document "RFP 75F40126R00009 FIRF IDIQ."
7RFP; Section K, Representations, Certifications, and Other Statement of Offerors87-91A number of the FAR clauses in Section K require completion by the offeror.

1. Must these certifications be submitted with the proposal, or will the certification in the cover letter that all company information listed in the SAM.gov website is complete, accurate, and current suffice in lieu of completing these clauses?

2. If the completed clauses are required, please confirm that these should be included in Volume 2, Business/Price Proposal. The General Formatting Instructions in Section L of "RFP 75F40126R00009 FIRF IDIQ" state that, as an addendum to the cover letter, "The Offeror shall certify that all company information listed in the SAM.gov website is complete, accurate, and current. Offerors must have an active registration in SAM.gov (https://sam.gov) with completed representations and certifications, by the close date of the solicitation." The Offeror’s representations and certifications in SAM are incorporated by reference into its offer. For any FAR and HHSAR provisions and clauses that have not been completed in SAM.gov, please submit the completed information either as an appendix to the Cover Letter/Executive Summary (no page limitations) or as an appendix to Volume 1-Technical Proposal (without counting toward the 75-page limit).

2. Please confirm that this information will not count against any volume page limits. This information may be submitted as an appendix to Volume 1, Technical Proposal. It will not be counted against the 75-page limit.
11RFP; L.4 Proposal Preparation Instructions; FIRF IDIQ Recompete - Questions97The solicitation states that questions must be submitted via email, and that "The FDA will email, as an amendment, the combined RFP questions and FDA responses to each prospective offeror."
Please clarify: will the responses to questions only be provided to offerors who submit questions, as opposed to posted on SAM?The Government will post its responses to vendor questions on SAM.gov via solicitation Amendment 0003 which, among other things, adds a new "Attachment L: Questions and Answers."
12RFP; L.4 Proposal Preparation Instructions; General Formatting Instructions97The solicitation requires that "Any assumptions forming the basis of the submittal shall be clearly identified in the cover letter submitted with the RFP."
Please clarify the nature of assumptions that should be included in the cover letter, as the instructions for the cover letter on page 97 do not mention assumptions. The General Formatting Instructions in section L of "RFP 75F40126R00009 FIRF IDIQ" state that any assumptions forming the basis of the submittal shall be clearly identified in the cover letter. These are administrative and procedural assumptions rather than substantive ones. They typically include: confirming the soliciation basis, noting any outstanding clarification questions that may require proposal revision pending Government responses; stating the proposal validity period; asserting data rights and confidentiality protections for proprietary information; confirming active SAM.gov registration, currency of representations and certifications, and identifying the authorized point of contact.
13RFP; L.4 Proposal Preparation Instructions; General Formatting Instructions

RFP; L.4 Proposal Preparation Instructions; Technical Factor 3 - Management Approach/Organizational Structure 97-98

100-101 Pages 96 and 97 say that cover pages, tables of contents, dividers, glossary, resumes, CPARS, and PPQs do not count against the page limitations.

Technical Factor 3 requires signed letters of commitment from all Key Personnel listed in Section C.8.1.

Please confirm that all letters of commitment are also exempt from the 75 page limit for Volume 1, Technical Proposal. The letters of commitment are exempt from the 75 page limit for Volume 1, Technical Proposal.
14RFP; L.4 Proposal Preparation Instructions; General Formatting Instructions97-98Section L.4 establishes page limitations for Volume 1. Please confirm that required appendices and supporting documents, including the Physical Security Plan (Technical Factor 1), the Project Management Plan and Quality Control Plan (Technical Subfactor 2.1), personnel commitment letters and resumes (Technical Factor 3), and the staffing plan required by Attachment E, Section 7.3, are excluded from the page count. The required appendices and supporting documents are excluded from the 75-page limit of the Volume 1-Technical Proposal.
15RFP; L.4 Proposal Preparation Instructions; II. Volume I - Technical Proposal; Technical Subfactor 2.1 - Technical Understanding and Approach to a Sample Task Order98The last bullet in the instructions for technical subfactor 2.1 states that Offerors shall provide "a description of the staffing workforce deemed most appropriate for the sample Task Order…and the staffing plan must address the rationale for personnel choices and describe how and where in the staffing plan they intend to apply them."
Please confirm that FDA expects offerors to identify the individual personnel proposed for the Sample Task Order and provide their names, proposed positions, and qualifications as part of the staffing plan.See response to question 2.
16RFP; L.4 Proposal Preparation Instructions; II. Volume I - Technical Proposal; Technical Subfactor 2.1 - Technical Understanding and Approach to a Sample Task Order

Attachment E: Sample TO SOW; 4.1.1 Transition-In Services 98

2Please clarify whether transition-in will be separately priced and funded if exercised, or whether transition costs must be included within the Sample Task Order FFP. Will the government refund the successful vendor the transition cost of equipment, systems, databases, software, inventory records, and other operational assets?Transition-in will be separately priced and funded if exercise. Transition costs should not be included in the sample task order FFP.
17RFP; L.4 Proposal Preparation Instructions; II. Volume 1 – Technical Proposal; Technical Factor 1 – Contractor’s Off-Site Facility98-99The solicitation states that the proposed facility must be owned or leased by the Contractor throughout the five-year IDIQ ordering period and through completion of any resultant task orders, which may extend for up to five years beyond the ordering period.
Please clarify whether this requirement means that Offerors must secure a 10-year lease for the proposed facility. This requirement does not mean the offerors must secure a 10-year lease for the proposed facility. The requirement is intended to ensure that the offerors can demonstrate the capability to maintain only one facility to perform all services during the life of the contract and awarded task orders. Offerors may satisfy this requirement by providing evidence of a conditional lease agreement that demonstrates the offeror's ability to secure and maintain the proposed facility for the duration of performance. The goverment will evalute the offeror's approach to facility continuity as part of Technical Factor 1-Contractor’s Off-Site Facility (see Sections L and M of "RFP 75F40126R00009 FIRF IDIQ").
18RFP; L.4 Proposal Preparation Instructions; II. Volume 1 – Technical Proposal; Technical Factor 1 – Contractor’s Off-Site Facility

Attachment C: IDIQ Pricing Worksheet

Attachment K: Sample Task Order Pricing Worksheet; TO Pricing Worksheet; Allocated Facility Cost 98-99

All

All The solicitation requires the Contractor to secure and maintain a contiguous facility of at least 20,000 square feet throughout the five-year IDIQ ordering period and through completion of any resultant task orders. However, Attachment C does not include a line item for facility costs, and Attachment K provides a Government-established facility-cost plug amount applicable only to the Sample Task Order.

Please clarify how Offerors should account for the costs of securing, operating, and maintaining the required facility during periods or for portions of the facility not funded under an individual task order. Will the Government revise the applicable pricing worksheet to provide a mechanism for proposing these costs, or should Offerors assume that any facility costs not allocated to a task order will be borne by the Contractor? The government will not revise the pricing worksheet to provide a mechanism for proposing these costs. The government has included, for evaluation purposes, a plug-in amount for facility allocation costs. Facility allocation has been historically allocated across the active task orders during a fiscal year.
19RFP; L.4 Proposal Preparation Instructions; II. Volume I - Technical Proposal; Technical Subfactor 2.1 - Technical Understanding and Approach to a Sample Task Order

Attachment E - Sample Task Order Statement of Work; Section 4.1.1 Transition-In Services 98-99

2 Please clarify how FDA expects required services to continue while the successor contractor completes the facility buildout, security testing, FDA approval, equipment relocation, system implementation, and transition-in activities. The solicitation addresses transition-in and transition-out requirements in Sections C6.6.1 and C.6.6.2 of "RFP 7540126R00009 FIRF IDIQ." These provisions establish the planning, knowledge transfer, personnel onboarding, equipment relocation, and asset reconciliation requirements that govern the transition between predecessor and successor Contractors.

Regarding continuity of services during facility buildout, security testing, FDA approval, equipment relocation, and system implementation, the Government clarifies the following:

1. Transition Period: The successor Contractor will be afforded a 90-180 day transition-in period from contract award to complete facility preparation and stand-up activities before full performance is required.

2. Predecessor Obligations: The predecessor Contractor is required to continue full performance of required services during the transition-in period in accordance with their existing contract obligations and the transition-out requirements described in Section C.6.6.1. This ensures continuity of vital FDA business operations while the successor Contractor completes facility preparation.

3. Facility Approval: The FDA facility approval process is approximately 90-180 days. Offerors should account for this timeline in their Transition-In Plan and proposed transition period schedule.

Offerors should address their complete approach to facility preparation, parallel operations, and continuity of services during the transition period in their Transition-In Plan submission.

RFP; M.4 Evaluation Criteria; Price Factor 6

Attachment C: IDIQ Pricing Worksheet

Attachment K: Sample Task Order Pricing Worksheet 98–99

103–104

All

All The solicitation provides for award using an LPTA approach and requires the Contractor to provide and maintain a secure, contiguous facility of at least 20,000 square feet. However, Attachment C does not require Offerors to propose their total facility costs, and Attachment K includes a Government-established facility-cost plug amount rather than each Offeror’s actual costs for acquiring or leasing the facility; completing necessary construction, tenant improvements, and facility build-out; installing required security and IT infrastructure; and operating and maintaining the facility.

Please explain how the Government will determine the lowest evaluated price on a complete and comparable basis without evaluating each Offeror’s actual facility costs. Will the Government revise the applicable pricing worksheet to require Offerors to propose the full cost of the required facility and include that amount in the Total Evaluated Price?See response to question 18.

RFP; M.2–M.4; Basis for Award and Price Factor 6

Attachment E: Sample Task Order SOW; 4.1.1 Transition-In Services

Attachment K: Sample Task Order Pricing Worksheet 99

103–108

All The solicitation requires Offerors to propose a transition-in approach addressing activities such as parallel operations, personnel onboarding, coordination with the predecessor contractor, and relocation of Government equipment. These activities may result in materially different costs depending on each Offeror’s existing facility, workforce, systems, equipment, and operational readiness. However, Attachment K does not include a separate line item for proposing transition-in costs and prohibits Offerors from modifying non-yellow-highlighted cells.

Please explain how the Government will determine the lowest evaluated price on a complete and comparable basis without evaluating each Offeror’s actual transition-in costs. Will the Government revise Attachment K to add a separate CLIN to the Base Year pricing sheet under which Offerors must propose all transition-in costs, with those costs included in the Total Evaluated Price?See response to question 18.
22RFP; L.4 Proposal Preparation Instructions; Technical Subfactor 2.1 - Technical Understanding and Approach to Sample Task Order

RFP; M.4 Evaluation Criteria; Technical Subfactor 2.1 - Technical understanding and Approach to Sample Task Order

Attachment E: Sample TO SOW; 7.3 Staffing Plan 99

24-25 Please confirm that an Acceptable sample task order approach must demonstrate availability of the full proposed Attachment K staffing complement on the first day of project operations, and that the 90-day transition period does not permit deferral of recruiting or staffing for required operational positions. Offerors must demonstrate a staffing plan that presents a resourcing and retention apporach that is logical and technically effective, and satisfies the rquirements of the IDIQ SOW. Their staffing plan must demonstate that they can achieve full staffing of all "Attachment K-Sample Task Order Pricing Worksheet" positions by the end of the transition period.

23 RFP; L.4 Proposal Preparation Instructions; II. Volume 1 – Technical Proposal; Technical Subfactor 2.1 – Technical Understanding and Approach to a Sample Task Order

RFP; M.4 Evaluation Criteria; Technical Subfactor 2.1

Appendix 5: FDA-CDRH Document Control Center (DCC) Tracking System Requirements 99

All Section M.4 requires an Offeror to demonstrate that it “has a tracking system” that meets all requirements in Appendix 5.

Please confirm that, to be rated Acceptable, an Offeror must demonstrate at proposal submission that its proposed tracking system is existing and operational through evidence such as a requirements traceability matrix, system architecture, screenshots, audit-log examples, interface descriptions, and applicable FedRAMP or ATO documentation. Please also confirm that an Offeror may not satisfy this requirement solely by proposing to develop or acquire a compliant tracking system after award. The solicitation defines the requirements for the proposed tracking system in "Appendix 5-FDA-CDRH Document Control Center (DCC) Tracking System Requirements." Offerors are required to propose a tracking system that meets all requirements at the time of proposal. The proposed tracking system does not have to be fully operational at the time of proposal.

24 RFP; L.4 Proposal Preparation Instructions; II. Volume 1 – Technical Proposal; Technical Subfactor 2.1 – Technical Understanding and Approach to a Sample Task Order

Attachment K: Sample Task Order Pricing Worksheet; TO Pricing Worksheet; Instructions 99

All Section L.4 instructs Offerors to propose a staffing mix and explain the rationale for their personnel choices and how those personnel will be applied. However, Attachment K prescribes nine labor categories and the corresponding hours for each performance period, and its instructions prohibit Offerors from altering any non-yellow-highlighted cells.

Please confirm that the labor categories and hours prescribed in Attachment K constitute the mandatory staffing baseline and must be used without modification in both the Sample Task Order pricing and the corresponding technical approach. If so, please confirm that the technical staffing plan should explain how the Offeror will organize, deploy, and manage the Government-prescribed workforce rather than propose different labor categories or staffing hours. The Government confirms that the nine labor categories and corresponding hours prescribed in "Attachment K-Sample Task Order Pricing Worksheet" constitute the mandatory staffing baseline for both the Sample Task Order pricing and the corresponding technical approach. Offerors may not modify the prescribed labor categories or hours in any non-yellow-highlighted cells.

The technical staffing plan required under Section L.4 of "RFP 75F40126R00009 FIRF IDIQ" should explain how the offeror will organize, deploy, and manage the Government-prescribed workforce to successfully accomplish the requirements described in the Statement of Work. Specifically, the staffing plan should address:

How the prescribed labor categories will be assigned to specific task areas and functions;

The rationale for how personnel will be deployed across the performance period;

The management structure and oversight approach for the prescribed workforce; and How the offeror will ensure the prescribed labor categories meet the qualification requirements in "Attachment F-Labor Category Descriptions."

Offerors should not propose different labor categories or staffing hours than those prescribed in "Attachment K-Sample Task Order Pricing Worksheet." Proposals that modify the prescribed labor categories or hours will be found non-compliant. Section L.4 of "RFP 75F40126R00009 FIRF IDIQ" is intended to elicit the offeror's management and deployment approach for the Government-prescribed workforce, not to invite alternative staffing proposals.

25 RFP; L.4 Proposal Preparation Instructions; II. Volume 1 – Technical Proposal; Technical Subfactor 2.1 – Technical Understanding and Approach to a Sample Task Order

RFP; M.4 Evaluation Criteria; Technical Subfactor 2.1 99

106 Section L.4 requires Offerors to describe the staffing workforce proposed for the Sample Task Order, explain the rationale for their personnel choices, and identify how and where the proposed personnel will be applied. However, the evaluation criteria for Technical Subfactor 2.1 in Section M.4 do not expressly address the evaluation of the proposed staffing workforce, personnel choices, or supporting rationale.

Please clarify whether these elements will be evaluated under Technical Subfactor 2.1. If so, please identify the objective criteria the Government will use to determine whether an Offeror’s proposed staffing workforce and rationale are Acceptable. The Government confirms that the proposed staffing workforce required by Section L.4 of "RFP 75F40126R00009 FIRF IDIQ" will be evaluated under Technical Subfactor 2.1 – Technical Understanding and Approach to a Sample Task Order. To be rated Acceptable, offerors must propose staff that have the required skills and expertise for a project of this magnitude in accordance with the requirements in "Attachment F-Labor Category Descriptions."

The staffing rationale and deployment explanation required by Section L.4 of "RFP 75F40126R00009 FIRF IDIQ" should demonstrate how the proposed workforce, organized around the nine labor categories prescribed in "Attachment K-Sample Task Order Pricing Worksheet", will be applied to the task areas and functions described in the Statement of Work. Evaluators will assess whether the proposed staffing approach demonstrates that personnel meet the "Attachment F-Labor Category Descriptions" qualification requirements for each prescribed labor category.

No additional evaluation criteria beyond "Attachment F-Labor Category Descriptions" compliance will be applied to the staffing workforce under Technical Subfactor 2.1 – Technical Understanding and Approach to a Sample Task Order. A proposal will be rated Acceptable under this subfactor if it demonstrates that proposed staff meet the skills and expertise requirements defined in "Attachment F-Labor Category Descriptions" for each of the nine prescribed labor categories.

RFP; M.1 Prospective Contractor Responsibility and Eligibility Standards

RFP; M.2; RFO FAR 52.212-2, Evaluation—Commercial Products and Commercial Services 101

103-104 Section L.4 requires Offerors to address their financial capacity, working capital, and other resources. Sections M.1 and M.2 require the successful Offeror to affirmatively demonstrate compliance with the broader responsibility standards in RFO FAR 9.104-1.

Please clarify whether Offerors must submit information or supporting documentation beyond the financial-capacity statement to demonstrate compliance with these responsibility standards. If additional information is required, please identify the specific information or documentation to be submitted, the proposal volume and section in which it should be included, and whether it will count toward any applicable page limitation. The Government clarifies that the financial capacity, working capital, and other resources statement required by Section L.4 of "RFP 75F40126R00009 FIRF IDIQ" constitutes the proposal submission requirement for demonstrating financial capability. No additional financial documentation beyond the financial capacity statement is required to be submitted with the proposal.
27RFP; L.4 Proposal Preparation Instructions; III. Volume 2 – Business/Price Proposal101The solicitation requires "Plans for any additional compensation resulting from employee relations, profit sharing, pensions or health and welfare benefits must also be included."
Please confirm that a statement that this is not applicable will suffice when no such additional compensation is anticipated. The responsibility standards referenced in Sections M.1 and M.2 of "RFP 75F40126R00009 FIRF IDIQ" reflect the requirements of FAR 9.104-1, which governs the Contracting Officer's pre-award responsibility determination. This determination is a separate process from the technical evaluation and will be conducted by the Contracting Officer prior to award. Consistent with FAR 9.105-1, the Contracting Officer may request additional information or documentation from the apparent successful offeror to support the responsibility determination.

Attachment K - Sample Task Order Pricing Worksheet

101-102

All The solicitation indicates that a proposal will be deemed incomplete and rejected if the level of effort in Attachment K is changed, and that only yellow-highlighted cells may be edited. Please confirm that this restriction applies equally to all offerors, that no offeror may add, remove, or reallocate labor hours or labor categories in Attachment K, and that the Section M.4 price evaluation will include the sample task order price in addition to the IDIQ labor rates. Offerors are to complete only the yellow highlighted portions of the spreadsheet. No other cells shall be altered in any way or offers may be deemed nonresponsive. Offerors shall provide a fully loaded labor rate for all labor categories proposed. Offerors who fail to provide pricing for each labor category and each ordering period may be considered nonresponsive. The FDA will conduct price analysis on the Volume 2 Business/Price Proposal submission.

29 RFP; M.3 Basis for Award

RFP; M.4 Evaluation Criteria; Price Factor 6 105

108Section M.2 and M.3 indicate that award will be made to the offeror whose proposal is technically acceptable for all factors, whose past performance is acceptable, and whose evaluated price is lowest. Given the operational risk profile of this requirement (same-day processing of regulatory submissions at a 95% AQL from the first day of performance, an FDA-accepted facility, and an ATO for the tracking system), would the Government consider a best-value tradeoff basis of award that gives weight to demonstrated technical capability and past performance rather than a lowest-price technically acceptable approach? No.
30RFP; M.4 Evaluation Criteria; Technical Subfactor 2.1: Technical Understanding and Approach to a Sample Task Order105In Section M.4, the last bullet in the evaluation criteria for Technical Subfactor 2.1 states that an Acceptable rating is partially based on Offerors proposing "staff that have the required skills and expertise for a project of this magnitude in accordance with the requirements in Attachment F: Labor Category Descriptions.
Please confirm that FDA expects offerors to identify the individual personnel proposed for the Sample Task Order and provide their names, proposed positions, and qualifications as part of the staffing plan.Confirmed.
31RFP; M.4 Evaluation Criteria; Price Factor 6108The evaluation language for Price Factor 6 states that the Government will evaluate proposals by performing price analysis.

1. Please clarify if the price analysis will be based solely on the IDIQ pricing information provided in Attachment C, or if the Sample Task Order costs in Attachment K will also be evaluated.

2. If both will be evaluated, please clarify how each will be evaluated and weighed in the price analysis. The Government clarifies that the Total Evaluated Price under Price Factor 6 will be derived solely from the Sample Task Order pricing in "Attachment K-Sample Task Order Pricing Worksheet".

The IDIQ ceiling rates proposed in "Attachment C-IDIQ Pricing Worksheet" will be reviewed for reasonableness and internal consistency with the Sample Task Order pricing in "Attachment K-Sample Task Order Pricing Worksheet" but will not be assigned a separate evaluated price or weighted separately in the price evaluation.

32 RFP; M.4 Evaluation Criteria; Price Factor 6

Attachment K: Sample Task Order Pricing Worksheet; TO Pricing Worksheet; SCA Category 108

All Attachment K identifies several labor categories - including Project Manager, Supervisor, and Subject Matter Expert - as exempt positions that are not mapped to the SCLS wage determinations. Section M.4 states that the Government will perform a price analysis but does not indicate whether proposed compensation for professional employees will be separately evaluated.

Please confirm that FAR 52.222-46, Evaluation of Compensation for Professional Employees, will be incorporated into the solicitation and applied in evaluating the realism of proposed professional compensation and its effect on the Offeror’s ability to recruit and retain qualified personnel and maintain service continuity. If FAR 52.222-46 will not apply, please clarify how the Government will evaluate the adequacy of compensation proposed for exempt professional labor categories.FAR 52.222-46 was deleted by the FAR RFO and therefore is not applicable.
33Attachment E: Sample TO SOW;
4.2.2 Project Management Plan4-5.Attachment E requires that the Project Management Plan include a list of employee names, job duties, job titles, and hierarchical structure.
Please clarify if actual employee names are required for the Project Management Plan for the Sample Task Order.See response to question 15.
34Attachment E: Sample TO SOW; 7. Contractor Personnel14Given the importance of the Sample TO and its similarity to other FDA procurements, would the government consider including the Task Order Project Manager as a Key Personnel requirement?See response to question 1.
35Attachment E: Sample TO SOW;
7.3. Staffing Plan24-25Attachment E requires resumes of personnel as part of the staffing plan.
Please clarify which personnel require submission of resumes for the Sample Task Order with the proposal, as no Key Personnel are identified at the task order level. The IDIQ solicitation only identifies the Program (Contract) Manager as Key Personnel.See response to question 1.
36Attachment K: Sample Task Order Pricing Worksheet; TO Pricing WorksheetAllocated Facility CostPlease explain the purpose and derivation of the Government-populated “Allocated Facility Cost” amounts in Attachment K and confirm whether those amounts are fixed evaluation values that Offerors must use regardless of actual lease, utilities, security, infrastructure, maintenance, and occupancy costs.See response to question 18.
37Attachment K: Sample Task Order Pricing Sheet; TO Pricing Worksheet; InstructionsAllAttachment K states, “Offerors are to complete only the yellow-highlighted portions of the spreadsheet. No other cells shall be altered in any way, or proposals may be deemed non-responsive.” The “SCA Category” column, which identifies each labor category as either Exempt or maps it to a specific SCLS labor category, is not yellow-highlighted.

Please confirm that Offerors must use the prescribed SCLS/exempt classifications and may not revise the classification or mapping assigned to any labor category. The Government confirms that the prescribed SCLS/exempt classifications prescribed in Attachment K-Sample Task Order Pricing Worksheet" are fixed and may not be revised by offerors.

38 Section A.2, Notice of NAICS/Set-Aside 3 Please confirm whether an offeror must be certified by the SBA and designated in SAM.gov as a Service-Disabled Veteran-Owned Small Business as of the proposal submission date. Is a certified Veteran-Owned Small Business that is not service-disabled eligible to submit an offer as the prime contractor? To be eligible to submit an offer as prime contractor, an offeror must be certified by the SBA as a Service-Disabled Veteran-Owned Small Business concern in accordance with 13 CFR Part 128 and designated as such in SAM as of the proposal submission date. Offers from concerns that are not SBA-certified SDVOSBs will not be considered.

A Veteran-Owned Small Business that does not hold a separate SBA SDVOSB certification is not eligible to submit an offer as prime contractor under this solicitation. VOSB and SDVOSB are distinct certifications. Offers submitted by VOSB concerns not separately certified as SDVOSBs will not be considered regardless of technical merit or proposed price.

39Section A.2, Notice of NAICS/Set-Aside3If a Veteran-Owned Small Business that is not an SDVOSB is not eligible as the prime contractor, would FDA consider revising the set-aside to permit participation by certified Veteran-Owned Small Businesses? No.
40Technical Factor 4, Recent and Relevant Experience100-101Please confirm whether the prime contractor must independently provide at least one prior experience reference that meets all stated requirements for size, scope, complexity, contractor-hosted facility management, and submission volume.Per Section L.4 of "RFP 75F40126R00009 FIRF IDIQ," under Technical Factor 4 –Recent and Relevant Experience, "At least one (1) prior experience shall come from the Offeror who will be the prime contractor for this requirement." Section M.4 of "RFP 75F40126R00009 FIRF IDIQ," under Technical Factor 4 –Recent and Relevant Experience, has been updated to reflect this requirement.
41Technical Factor 4, Prime/Subcontractor Arrangements100-101May the experience of a proposed major subcontractor satisfy one or both required recent and relevant experience references when the prime contractor does not independently possess qualifying experience?See response to question 40.
42Technical Factor 4 and Section M.4100-101 and 107Must each of the two submitted experience references independently satisfy the $25 million contract value, all applicable IDIQ task areas, contractor-hosted facility, and same-or-higher submission-volume requirements?Yes.
43Technical Factor 4, Prime/Subcontractor Arrangements100-101May the prime contractor and a proposed major subcontractor collectively demonstrate the required size, scope, complexity, facility-management experience, and processing volume?Yes, but also see response to question 40.
44Technical Factor 4, Summary of Data101When a subcontractor’s experience is submitted, does the $25 million minimum apply to the total value of the referenced contract or specifically to the subcontractor’s portion of the contract? The $25 million minimum size threshold applies to the total value of the referenced experience performed by the offeror.
45Technical Factor 4, Prime/Subcontractor Arrangements100-101What documentation must an offeror provide to demonstrate that a proposed subcontractor will perform a major or critical portion of the requirement and that its experience should be considered in FDA’s evaluation?Technical Factor 4-Recent and Relevant Experience outlines the required elements for each project identified under the "Summary of Data" sub-heading of Section L.4 of "RFP 75F40126R00009 FIRF IDIQ."
46Technical Subfactor 2.1 and Appendix 598-99 and Appendix 5, Pages 1-6May an offeror satisfy the DCC Tracking System requirements through a proposed subcontractor, provided the prime contractor retains responsibility for implementation, security, integration, operations, and performance?Yes. An offeror may satisfy the DCC Tracking System requirements through a proposed subcontractor provided the following conditions are met:

The prime contractor retains full contractual responsibility for the tracking system's implementation, security, integration, operations, and performance throughout the contract period The subcontractor is identified by name and all major subcontractor documentation requirements previously communicated are satisfied, including a signed teaming agreement or letter of commitment and a workshare description identifying the subcontractor's specific role and estimated percentage of total contract work The offeror demonstrates a credible and executable approach to obtaining all required security authorizations — including any applicable FedRAMP authorization or Authority to Operate — within the approximately 90-180-day transition period, regardless of whether the system is owned or operated by the prime or subcontractor The proposed subcontracting arrangement is consistent with the SDVOSB limitation requiring the prime to perform at least 50% of the cost of contract performance with its own employees Offerors proposing to satisfy the DCC Tracking System requirement through a subcontractor should address the subcontractor's system capability, the prime's oversight and management approach, and the path to ATO in their technical proposal.

47 Technical Subfactor 2.1 98-99 May a proposed subcontractor’s experience implementing and supporting comparable document-tracking systems be used to demonstrate technical acceptability under Technical Subfactor 2.1? Yes. A proposed subcontractor's experience implementing and supporting comparable document-tracking systems may be used to demonstrate technical acceptability under the applicable technical evaluation criteria, provided the following conditions are met:

- The subcontractor is identified by name and all major subcontractor documentation requirements previously communicated are satisfied, including a signed teaming agreement or letter of commitment and a workshare description identifying the subcontractor's specific role

- The prime contractor demonstrates in its technical proposal a credible management and oversight approach for the tracking system, including responsibility for implementation, security, integration, operations, and performance

- The subcontractor's experience is clearly described and attributed to the subcontractor in the technical proposal, including the specific systems implemented, the scope of work performed, and the relevancy of that experience to the DCC Tracking System requirements defined in the solicitation

- The proposed subcontracting arrangement is consistent with the SDVOSB limitation requiring the prime to perform at least 50% of the cost of contract performance with its own employees The Government will evaluate the team's collective technical capability — including subcontractor experience — in assessing whether the proposed approach demonstrates the capability to implement and support a compliant DCC Tracking System. The prime contractor's management and oversight approach will be a key element of this assessment.

48 Appendix 5, Contractor Responsibilities Appendix 5, Page 6 Must the prime contractor own the proposed DCC Tracking System, or may the system be licensed, hosted, configured, maintained, and supported by an approved subcontractor? No. The prime contractor is not required to own the proposed DCC Tracking System. Consistent with previous Government responses, the system may be licensed, hosted, configured, maintained, and supported by an approved subcontractor provided:

- The prime retains full contractual responsibility for the system's implementation, security, integration, operations, and performance throughout the contract period

- The subcontractor is identified by name and all previously communicated major subcontractor documentation requirements are satisfied

- The offeror demonstrates a credible approach to obtaining all required security authorizations including any applicable FedRAMP authorization or ATO within the approximately 90-180-day transition period

- The licensing, hosting, configuration, maintenance, and support arrangement is described in the technical proposal including how the prime will maintain management oversight and ensure system performance and security compliance

- The arrangement is consistent with the SDVOSB limitation requiring the prime to perform at least 50% of the cost of contract performance with its own employees 49 Appendix 5, DCC Tracking System Requirements Appendix 5, Pages 1-6 Please identify the required interfaces, data exchanges, security authorizations, testing activities, and FDA systems with which the proposed DCC Tracking System must integrate. The DCC Tracking System requirements are defined in Attachment A, "Appendix 5-FDA-CDRH Document Control Ceneter (DCC) Tracking System Requirements." Offerors should refer to "Appendix 5-FDA-CDRH Document Control Ceneter (DCC) Tracking System Requirements" for complete functional requirements. The following supplements "Appendix 5-FDA-CDRH Document Control Ceneter (DCC) Tracking System Requirements" in response to this question:

Interfaces and Data Exchanges The system must provide seamless automated data exchange with CDRH data systems per REQ-08. All integration interfaces must be documented, versioned, and maintained in conformance with federal interoperability standards. Specific interface specifications will be provided to the awardee during the transition period in collaboration with CDRH system integrators and FDA IT personnel.

Testing Activities The Contractor must provide User Acceptance Testing (UAT) support for the system and all integrated CDRH applications per the Contractor Responsibilities section of "Appendix 5-FDA-CDRH Document Control Ceneter (DCC) Tracking System Requirements." Disaster recovery plans must be tested at defined intervals per REQ-10. Specific UAT protocols and acceptance criteria will be established collaboratively with FDA during the transition period.

Offerors should address their approach to system integration, security authorization, UAT, and disaster recovery testing in their technical proposal, demonstrating a credible and executable plan for achieving full system compliance within the transition period.

50 Technical Factor 1, Contractor’s Off-Site Facility 98 What documentation will FDA accept as evidence that the offeror will possess the required facility by contract award? Will a contingent lease, letter of intent, purchase option, or landlord commitment satisfy this requirement? The proposal must demonstrate that the facilty meets the requirements outline in the RFP. For purposes of demonstrating that the facility will be owned or leased by the Offeror by the time of contract award, the Offeror may provide: A contingent lease agreement; A landlord commitment letter; A letter of intent (executed by both parties identifying the property and proposed lease terms; acceptable only when accompanied by a narrative explaining why a contingent lease or landlord commitment letter could not be obtained and the offeror's plan for executing a binding agreement); or Proof of facility ownership — deed or title documentation confirming the offeror owns a qualifying facility that will be available for performance.

51Technical Factor 1 and Section F.230 and 98By what date must the proposed facility be fully leased or owned, built out, approved, connected, staffed, and ready to process FDA work? The proposed facility must be fully leased or owned and ready for staff to process work by March 13, 2027.
52Technical Factor 1 and Technical Subfactor 2.198-99Will FDA allow facility construction, physical-security improvements, technology installation, and the Verizon connection to be completed during the 90-day transition period following award?Yes.
