About this file
This document is a Mediator Application Packet for the State of Nevada's Alternative Dispute Resolution (ADR) program, specifically administered by the Real Estate Division's Office of the Ombudsman for Common-Interest Communities and Condominium Hotels. The contract seeks to establish a roster of qualified mediators who will handle disputes related to residential property associations, including issues involving covenant interpretations, assessment procedures, and association bylaws. Mediators will be assigned claims through the Division, conduct mediation sessions not exceeding 3 hours, and complete assignments within 60 days of claim filing. The contract term appears to run on a fiscal year basis from July 1 through June 30, with mediators expected to be available for up to 4 hours of instruction annually.
The compensation structure includes a maximum fee of $500 for a 3-hour mediation, with potential hourly extensions up to $200 if all parties agree. The State may provide a subsidy of up to $500 per mediation assignment if parties qualify, with $250 allocated per party. Mediators must be registered with the Secretary of State and Controller's Office, maintain an updated curriculum vitae, and agree to various administrative requirements such as notifying the Division of conflicts of interest, providing mediation summaries, and being geographically accessible to assigned parties. The program does not guarantee a minimum volume of services and seeks to contract with experienced mediators who can meet the agency's diverse needs.
