3052.219-71 (Deviation) DHS MENTOR-PROTÉGÉ PROGRAM (DEVIATION 24-01) (APRIL 2024)

(a) Large businesses are encouraged to participate in the DHS Mentor-Protégé program for the purpose of providing developmental assistance to eligible protégé entities to enhance their capabilities and increase their participation in DHS contracts.

(b) The program consists of:

(1) Mentor firms, which are large prime contractors capable of providing developmental assistance;

(2) Protégé firms, are small businesses, veteran-owned small businesses, service-disabled veteran-owned small businesses, HUBZone small businesses, small disadvantaged businesses, and women-owned small business concerns, Historically Black Colleges and Universities, and Minority Serving Institutions; and

(3) Mentor-Protégé agreements, approved by the DHS Office of Small and Disadvantaged Business Utilization (OSDBU).

(c) Mentor participation in the program means providing business developmental assistance to aid protégés in developing the requisite expertise to effectively compete for and successfully perform DHS contracts and subcontracts.

(d) Large business prime contractors serving as mentors in the DHS Mentor-Protégé program are eligible for a post-award incentive for subcontracting plan credit. The mentor may receive small business subcontracting credit for costs it incurs to provide assistance to a protégé. The mentor may use this additional credit towards attaining its subcontracting plan participation goal under the same or another DHS contract. The amount of credit given to a mentor firm for these protégé developmental assistance costs shall be calculated on a dollar for dollar basis and reported in the Summary Subcontract Report via the Electronic Subcontracting Reporting System (eSRS) at www.esrs.gov. For example, a mentor/large business prime contractor would report a $10,000 subcontract to the protégé subcontractor and $5,000 of developmental assistance to the protégé as $15,000. The Mentor and Protégé will submit a signed joint statement agreeing on the dollar value of the developmental assistance and the Summary Subcontract Report.

(e) Contractors interested in participating in the program are encouraged to contact the DHS OSDBU for more information.

52.212-2 EVALUATION - COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Price, Technical, and Past Performance

Technical and past performance, when combined, are equal to price

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award multiple contracts resulting from this solicitation to the responsible offeror(s) whose offer(s) conforming to the solicitation is(are) the Lowest Priced Technically Acceptable Offer (LPTA) for those locations. Technically acceptable is defined as the offeror's ability to meet all the requirements identified in the Statement of Work and the offeror's demonstrated ability to perform the contract successfully through Past Performance. Only the lowest priced offer will be evaluated for technical acceptability. If the lowest priced offer is found not to be technically acceptable, then the next lowest priced offer will be evaluated. This process will continue until a technically acceptable offer is identified; not all offers will be evaluated. The following factors shall be used to evaluate offers: (1) Technical, (2) Past Performance and (3) Price.

(1) Technical Capability and Understanding

The Government will evaluate the offeror's ability and method/approach to providing all the requirements in the Statement of Work as identified in their technical section/proposal. Technical will be rated as to the extent the offeror can clearly and fully demonstrate that it has a thorough understanding of the requirements and can successfully provide the requirements. Offerors that cannot specifically address their ability and method/approach to providing all the requirements in the Statement of Work or that do not submit a Technical Section with their offer may be rejected without further consideration. Offerors shall address their proposed method for accomplishing all the tasks outlined in the Statement of Work and a well thought-out approach that is likely to yield the required results within the required time frame, in addition to their overall understanding of the requirements. The technical proposal should be precise and not assume the evaluation team is aware of the offeror's abilities to accomplish this requirement. Offers that do not demonstrate the ability to perform the listed tasks in the SOW (by a lack of https://www.sam.gov relevant experience and/or written skills, or technical expertise) will be evaluated as "Fail".

(2) Past Performance

Offerors shall furnish the information listed below for at least 2 different contracts, that are ongoing or completed within the last three (3) years, are relevant to this requirement (i.e., the same or similar requirement) and are held with government (federal, state, local), private or commercial entities. "The same or similar requirements" under this RFQ is defined as those providing the same or similar services or supplies to a government, private, commercial entity. Note: The Government may use past performance information obtained from any source to evaluate past performance. All information obtained will be used to determine the offeror's ability to perform the contract successfully.

Past Performance Questionnaires (PPQ)

Offerors are responsible for ensuring that Past Performance Questionnaires (PPQ) (Attachment 2) are completed and submitted on at least two (2) different government (federal, state, or local), private or commercial contracts that have been awarded to the offeror. The Offeror shall send Past Performance Questionnaires to points-of-contact (i.e., past performance evaluators) at government, private or commercial entities that have firsthand knowledge of contracts completed within the past 3 years or ongoing and are relevant to this requirement (i.e., the same or similar requirement). Only one Past Performance Questionnaire shall be completed per contract and the same person cannot complete more than one Past Performance Questionnaire. (A Past Performance Questionnaire shall not be completed by a point of contact/employee of a prime contractor that your company worked for as a sub-contractor or your company's parent or sister company.)

Each past performance evaluator shall submit a completed Past Performance Questionnaire (PPQ) directly to the Contract Specialist, Tyrone Minnifield, via e-mail at Tyrone.Minnifield2@uscg.mil on or before the "Quote Due Date. An Offeror shall not complete the Past Performance Questionnaire on behalf of a past performance evaluator nor shall they forward a completed PPQ to the Contract Specialist. The PPQ shall be forwarded to the Contract Specialist and Contract Officer from the past performance evaluator's e-mail address or fax number. If the PPQ is faxed an email shall be sent from the evaluator to the Contract Specialist for receipt confirmation.

* Contractor Performance Assessment Reporting System (CPARS) records may be used in lieu of PPQ.*

(3) Price (Only the lowest priced technically acceptable offer will be evaluated on Price)

The Government will evaluate price for reasonableness and award multiple contract(s) to the offeror with the lowest priced technically acceptable offer. Under LPTA, non-priced/cost factors are of equal importance and are evaluated on a pass/fail basis. There is no ranking of proposals based on non-price/cost factors and no higher value is earned by proposals exceeding the solicitation requirements.

Offerors are required to provide unit prices for all items. A zero-dollar figure ($0.00) unit price means the Offeror will provide the service at no charge to the Government. Unit prices left blank or annotated with something other than a dollar figure will be considered unacceptable and the Government has discretion whether to reject the offer without any further consideration.

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option (s).

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer ), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.233-2 SERVICE OF PROTEST (SEPT 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from Email OPAP@uscg.mil and copy Contracting Officer.
