4. Does the vaccination mandate apply to everyone in an office that supports the project? If yes, does it also apply to individuals in the office who are not supporting that federal project?
Answer: Information about compliance with Executive Order 14042 (vaccine mandate for covered federal contractors) can be found at https://www.saferfederalworkforce.gov/contractors/.
Contractors are advised to check that website periodically for any changes.
5. What are the repercussions for noncompliance with the vaccination requirement?
Answer: Covered contractors are expected to comply with all requirements set forth in their contract. Where covered contractors are working in good faith and encounter challenges with compliance with COVID-19 workplace safety protocols, the agency contracting officer will work with them to address these challenges. If a covered contractor is not taking steps to comply, significant actions, such as termination of the contract, may be taken. We refer you to https://www.saferfederalworkforce.gov/contractors/ which includes several FAQs to include information regarding compliance and noncompliance.
6. Are exceptions to the vaccination requirement granted by the government?
Answer: The USCG will not be granting exemptions to the vaccine requirement. Contractors are advised to review all the information at https://www.saferfederalworkforce.gov/faq/contractors/ but we specifically address your attention to these 3 Q&As:
Q: Who is responsible for determining if a covered contractor employee must be provided an accommodation because of a disability or because of a sincerely held religious belief, practice, or observance?
A: A covered contractor may be required to provide an accommodation to contractor employees who communicate to the covered contractor that they are not vaccinated for COVID-19, or that they cannot wear a mask, because of a disability (which would include medical conditions) or because of a sincerely held religious belief, practice, or observance.
A covered contractor should review and consider what, if any, accommodation it must offer. The contractor is responsible for considering, and dispositioning, such requests for accommodations regardless of the covered contractor employee’s place of performance. If the agency that is the party to the covered contract is a “joint employer” for purposes of compliance with the Rehabilitation Act and Title VII of the Civil Rights Act, both the agency and the covered contractor should review and consider what, if any, accommodation they must offer.
Q: Do all requests for accommodation need to be resolved by the covered contractor by the time that covered contractor employees begin work on a covered contract or at a covered workplace?
A: No. The covered contractor may still be reviewing requests for accommodation as of the time that covered contractor employees begin work on a covered contract or at a covered workplace. While accommodation requests are pending, the covered contractor must require a covered contractor employee with a pending accommodation request to follow workplace safety protocols for individuals who are not fully vaccinated as specified in the Task Force Guidance for Federal Contractors and Subcontractors.
Q: When a covered contractor employee is not vaccinated because a covered contractor has provided the employee with an accommodation, what workplace safety protocols must the employee follow while in a Federal workplace?
A: The Federal agency will determine the workplace safety protocols that individuals who are not fully vaccinated must follow while in a Federal workplace. As noted in Task Force guidance, in most circumstances individuals who are not fully vaccinated need to follow applicable masking, physical distancing, and testing protocols. However, there may be circumstances in which an agency determines that the nature of a covered contractor employee’s job responsibilities at a Federal workplace, or the location of their work at a Federal workplace, requires heightened safety protocols. Further, in some cases, an agency may determine that the nature of a covered contractor employee’s responsibilities at a Federal workplace are such that no safety protocol other than vaccination is adequate—in that case, covered contractor employees who are not fully vaccinated would be unable to perform the requisite work at the Federal workplace. Such circumstances do not relieve the contractor from meeting all contractual requirements.
In order for agencies to assess appropriate safety measures for contractor employees in Federal workplaces, contractors subject to a contractual requirement for maintaining COVID-19 workplace safety protocols pursuant to Executive Order 14042 should generally notify their contracting officers when one of their employees who works onsite at a Federal workplace has received an exception to the requirement to be fully vaccinated.
7. Please provide the CAD files of the building schematics provided in the RFP.
Answer: Provided with Amendment 02. File Name: JMC_RFP Duplex Schematics.dwg.
8. Does the “Amendments acknowledged” form count towards the 20-page limit?
Answer: Signed SF30s do not count towards the page count. Reference the section titled "Non- Price Proposal Closing Date" on p. 5 of the TOA.
9. Does the response to the “Reps regarding certain telecommunications” count towards the 20-page limit?
Answer: The Cyber/IT Related Solutions Form does not count towards the page count. Reference the section titled "Non-Price Proposal" on p. 21 of the TOA.
10. The RFP shows that the only ADA units provided are 4 BR units – does the USCG have no requirements for 3BR ADA compliant units to provide more diversity of living quarters?
Answer: Overall Kodiak D-17 Family Housing Project is planned as an eventual 79/80 housing unit development at some time in the future. It was decided to utilize the Base Bid area as the best opportunity to develop the ADA units – which would be 4 housing units (2 duplexes) for the full development = 5% of those 80 units as required by ADAAG. By making them all 4 BR units, the larger footprint is built-out, maximizing Base bid unit types, minimizing design and construction cost by detailing repetition, and likely will not have to be addressed again during the life of the project development. This approach has also been used in the standard units where the footprints of all standard 3BR and 4BR duplex design units have been kept the same. This repetition of structural features allows maximum space with the minimum design and construction costs due to repetition in both building and site layouts. Although diversity of living quarters is a very reasonable goal, unit equity, unit size and maximizing total number of units with current funds available is top priority. Diversity opportunities may exist in more cosmetic or surface components such as siding, entrance door, and trim colors.
11. The wage rates included in the RFP appear to be outdated. For example, the carpenter wages are $3.74 less that those currently listed by the State of Alaska. Please review and advise if the referenced wage determination will be updated for this solicitation.
Answer: The wage determination provided with the TOA is the current applicable wage determination for the project. This will be updated as needed throughout the solicitation via amendment.
