Attachment 3 - Government Responses to Solicitation Questions Solicitation No. 70Z02326R93280004
Homeland Security Cutter - Light Icebreaker (HSC-L) Amendment A00003
Question No. Offeror Question Government Response
Q1 Will the Government remove FAR 52.225-5 and FAR 52.225- 6 and apply the Buy American requirements?
Yes. Amendment A00003 removes FAR 52.225-5, Trade Agreements, and FAR 52.225-6, Trade Agreements Certificate. The amendment adds FAR 52.225-1, Buy American–Supplies, and FAR 52.225-2, Buy American Certificate.
Q2 Must an eligible past performance reference have been performed by the Offeror as the prime contractor?
Yes, in part. At least one of the three recent and relevant past performance references must demonstrate work performed by the Offeror as the prime contractor. The remaining references may demonstrate work performed by the Offeror in another performance role or work performed by an identified major subcontractor, teaming partner, or design agent proposed to perform a major or critical HSC-L function. No more than three past performance references may be submitted. See revised Sections L and M for the applicable submission instructions and evaluation criteria.
Q3 Will the Government allow release of technical information to foreign governments?
Yes. A00003 deletes that sentence only in C.2.3(e). Detailed requirements governing technical-information access, permitted disclosure, data rights, safeguarding, export controls, and related restrictions will be addressed in the Phase II solicitation amendment. Deletion does not itself authorize disclosure of controlled or restricted information.
Q4 Will timely Phase I Offerors be permitted to revise their Past Performance submissions?
Yes. Timely Phase I Offerors may submit a revised Volume I – Past Performance and related PPQs by August 3, 2026, at 12:00 p.m. Eastern Time. No new initial proposals and no revisions to the Cover Letter or Volume I are authorized.
Q5 How will the Government address engines and other major equipment identified by manufacturer, brand, or model?
Amendment A00003 adds FAR 52.211-6, Brand Name or Equal, to the solicitation. During Phase II, the Government will identify any engines or major equipment described on a brand-name-or-equal basis and will provide the applicable salient physical, functional, or performance characteristics for those items. Offerors proposing an equal item will be required to demonstrate that the proposed item satisfies the identified salient characteristics. This clarification applies to identified engines and major equipment, not generally to all parts, materials, or components.
