SUBJECT: Nationwide Permit (NWP) Verification

Dear Mr. Allen:

I am responding to your request dated July 11, 2024 for a Department of the Army (DA) permit for your proposed project, Salt Creek Interpretive Trail Boardwalk (File No.

SPL-2024-00164). The proposed project is located within Salt Creek in Death Valley National Park, Inyo County, California (Latitude 36.591663°, Longitude -116.988339°).

Because this project would result in a discharge of dredged and/or fill material into waters of the United States, a Department of the Army permit is required pursuant to Section 404 of the Clean Water Act (33 USC 1344; 33 CFR parts 323 and 330).

I have determined construction of your proposed project, if constructed as described in your application, would comply with NWP 45 Repair of Uplands Damaged by Discrete Events. Specifically, and as shown in the enclosed figures (Enclosure 1), you are authorized to:

1. Reconstruct the Salt Creek Boardwalk and parking lot, repair the entrance road, and replace the damaged vault toilet, which were damaged by flood events in August 2022 and August 2023.

2. Authorized work includes up to four temporary crossings across Salt Creek, installed using culverts and approximately 70 cubic-yards of fill material (rip rap and clean fill), that shall be removed following construction of the boardwalk and the permanent placement of approximately 130 cubic-yards of rip rap to be installed along the edge of the entrance road and parking lot.

3. Permanent impact to approximately 0.44-acre intermittent stream (Salt Creek) and temporary impact to approximately 0.15-acre intermittent stream (Salt Creek) are authorized. No impacts to wetlands are authorized.

For this NWP verification letter to be valid, you must comply with all of the terms and conditions in Enclosure 1. Furthermore, you must comply with the non-discretionary Special Conditions listed below:

1. Within 30 days of completion of the authorized work, you must sign and return the enclosed Certificate of Compliance (in accordance with General Condition 30).

2. Prior to initiating construction activities in waters of the United States, the

Permittee shall clearly mark the work area limits with flagging or similar measures to ensure mechanized equipment and personnel do not enter waters of the United States outside of permitted work area. Adverse impacts to waters of the United States beyond the Corps-approved construction footprint are not authorized. Such impacts could result in permit suspension and revocation, administrative, civil or criminal penalties, and/or compensatory mitigation requirements.

3. No work may occur in waters of the United States when flows are present. Work may resume once conditions have dried sufficiently for equipment to reenter waters of the United States.

4. Material removed from waters of the United States must be placed in an upland location. Any material removed from waters of the United States that is not used to repair upland erosion must be disposed of in an upland location where it may not migrate back into waters of the United States.

5. Once work in waters of the United States is complete, the work area shall be stabilized and restored back to its original contours and elevations as much as practical.

6. Pursuant to 36 C.F.R. section 800.13, in the event of any discoveries during construction within waters within the Corps Permit Area (PM insert permit area/APE map) of either human remains, archaeological deposits, or any other type of historic property, the Permittee shall notify the Corps Regulatory Project Manager (Kerrianne Zdimal, 970-259-1764 x1) and the Corps' Regulatory Archaeology Staff (Winston Zack 505-342-3393) within 24 hours. The Permittee shall immediately suspend all work in any area(s) where potential cultural resources are discovered. The Permittee shall not resume construction in the area surrounding the potential cultural resources until the Corps Regulatory Division re-authorizes project construction, per 36 C.F.R. Section 800.13.

This verification is valid through March 14, 2026. If on March 14, 2026 you have commenced or are under contract to commence the permitted activity you will have an additional twelve (12) months to complete the activity under the present NWP terms and conditions. However, if I discover noncompliance or unauthorized activities associated with the permitted activity I may request the use of discretionary authority in accordance with procedures in 33 CFR part 330.4(e) and 33 CFR part 330.5(c) or (d) to modify, suspend, or revoke this specific verification at an earlier date. Additionally, at the national level the Chief of Engineers, any time prior to March 14, 2026, may choose to modify, suspend, or revoke the nationwide use of a NWP after following procedures set forth in 33 CFR part 330.5. It is incumbent upon you to comply with all of the terms and conditions of this NWP verification and to remain informed of any change to the NWPs.

A NWP does not grant any property rights or exclusive privileges. Additionally, it does not authorize any injury to the property, rights of others, nor does it authorize interference with any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal, state, or local authorizations required by law.
