107.16 Biological (Threatened and Endangered Species) Monitoring.
Obtain the services of a New Jersey Fish and Wildlife Endangered and Nongame Species Program-approved surveyor to provide biological monitoring for the presence of wood turtles, timber rattlesnakes, and any other State-listed species. Provide the surveyor’s qualifications to the CO 14 days prior to any ground disturbance for approval.
Obtain a scientific collecting permit from the New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program (ENS) (http://www.state.nj.us/dep/fgw/exotic_apps.htm).
At least 3 days prior to commencement of site preparation and/or regulated activities, notify the Bureau of Coastal & Land Use Compliance & Enforcement via email at CLU_tomsriver@dep.nj.gov. The notification will include proof of completion of all pre-construction permit conditions, including proof of recording permits and approval plans. An authorized Bureau representative will be allowed on site to inspect to ensure compliance with the New Jersey Department of Environmental Protection permit.
Instruct the surveyor to perform the following at all times during the contract:
(a) Prior to commencement of work, brief all workers on required conservation measures and ensure that all sensitive areas are identified and avoided.
(b) Personally oversee and monitor the installation of all erosion and sediment controls, best management practices, and wildlife barriers, and in advance of such work, search all areas of expected disturbance for the presence of wood turtles, timber rattlesnakes and any other State-listed species.
(c) Personally oversee and monitor all in-stream work, and in advance of such work, search these areas for the presence of wood turtles, timber rattlesnakes and any other State-listed species.
(d) Conduct daily searches of all work and staging areas prior to commencement of work for the presence of wood turtles, timber rattlesnakes and any other State-listed species.
(e) Any wood turtles found must be reported to New Jersey Department of Environment, Division of Fish and Wildlife, Endangered and Nongame Species Program at:
(https://dep.nj.gov/njfw/conservation/reporting-rare-wildlife-sightings/), and carefully relocated outside of the work area.
If and when any wood turtles, timber rattlesnakes, and any other State-listed species are seen either inside or immediately outside the work zone, immediately report the sighting to the surveyor and to the CO. Take necessary actions, including stopping work, to prevent injury to each animal. Do not handle or move gravid female snakes until guidance is provided by the New

Jersey Fish and Wildlife snake biologist, Kris Shantz (609-802-9279). Provide all data collected on wood turtle, timber rattlesnakes and any other State-listed species occurrences for the project, to the CO who will provide to the Delaware Water Gap National Recreation Area Resource Manager.
Injured snakes and turtles will be transported by the surveyor to the Woodlands Wildlife Refuge (Woodlands) in Pittstown, Hunterdon County for treatment and care. The same surveyor is responsible for their release once the animal is healed. The surveyor will notify Woodlands via text to 908-485-8462 of such incidents to enable staff to prepare for the animal’s arrival. The surveyor will notify the CO, who will inform the Delaware Water Gap National Recreation Area Resource Manager.
All information collected on species within the project is the property of the U.S. government.
Keep all information collected on species within the project in strict confidence. Ensure the names and locations of wood turtles, timber rattlesnakes, and any other State-listed species are secure and not disclosed to the public.

Remove Subsections 108.01(d) and 108.01(e) from the Special Contract Requirements and substitute the following:
(d) No site preparation, demolition, grading or construction activities within the banks of Vancampens Brook at Vancampens Glen Bridge will be permitted during the following periods:
• September 15 to March 15 (trout/water quality).
• November 1 to April 1(wood turtle).
(e) No site preparation, disturbance, grading, clearing or construction activity will be permitted from April 1 to May 30 and from September 1 to November 15 within the regulated areas associated with Vancampens Brook at Vancampens Glen Bridge unless the following measures have been taken:
• Prior to the commencement of site preparation, disturbance, grading, clearing or construction activity, silt fence is erected around the footprint of all proposed activities (temporary and permanent) sufficient to exclude small wildlife species, and specifically wood turtles, from entering the proposed construction area.
• Immediately thereafter, a qualified surveyor must thoroughly inspect the fenced-in work area for wood turtles. Any wood turtles found must be reported to the New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program and relocated outside of the proposed work area. Once this inspection is complete, authorized activities may commence within the fenced work area.
• The silt fence is monitored weekly and maintained throughout the project duration.
(f) No work will be permitted during the Millbrook Days event occurring north of Vancampens Glen Bridge, typically held the third weekend of September, as determined by the CO.
