5.1.1 General

The FAA will provide the Contractor the option of using certain Government-furnished property (GFP), including facilities, utilities, equipment, and materials for use following the terms and conditions of this Contract, and exclusively for the performance of this Contract.

The use of Government-furnished property and utilities for any other purposes is prohibited.

Technical Exhibits I-5-1 and I-5-2 contain lists of Government-furnished facilities and equipment, respectively. All GFP will be provided in a "where is/as is" condition. Title to all GFP will remain with the FAA. The FAA will at all reasonable times have access to all

GFP at the premises where GFP are located. GFP must not be removed from the Technical

Center unless approved by the CO in writing. The listing of GFP must not be construed as being sufficient or adequate to meet the requirements of this Contract. The Contractor must, at their expense, provide additional facilities, equipment, tools, materials, and utilities that may be required to properly perform the requirements of this Contract.

5.1.2 Management of GFP

All Government-furnished property must be managed following the Government-furnished property clauses of this Contract, as including in Section I.

5.1.2.1 Inventory

The Contractor and COR (or other FAA-designated personnel) must conduct a joint inventory during the transition phase, before starting work under this Contract, to determine the exact number and serviceability of Government-furnished property. The

Contractor must report any inventory discrepancies to the COR prior to full performance under this Contract.

The FAA and the Contractor must work closely to ensure all GFP is accounted for and accurately documented. See below Sections for specific requirements regarding inventory of Government Furnished Facilities (GFF), Government Furnished Equipment

(GFE), and Government Furnished Material (GFM). The Contractor must report, on the

Government-furnished Property Loss Report, missing, lost, stolen, recovered, or damaged property to the FAA within one (1) working day. See Technical Exhibit I-5-3 for a copy of the Government-furnished Property Loss Report.

The Contractor must provide to the COR six (6) months prior to Contract completion a complete inventory of all GFP.

5.1.2.2 Maintenance and Repair

Government-furnished equipment (GFE) and Government-furnished facilities (GFF) must be maintained following the requirements of this Contract. See below Sections for specific requirements regarding maintenance and repair of Government-furnished facilities (GFF), Government-furnished equipment (GFE), and Government-furnished material (GFM). The Contractor will be responsible for the cost of any repairs or

Attachment I, Section 5 – Property Management 2 replacement caused by negligence or abuse by the Contractor or their employees or sub-contractors.

5.1.3 Government-Furnished Facilities (GFF)

5.1.3.1 General

The FAA will furnish or make available to the Contractor the facilities listed in Technical

Exhibit I-5-1. The Contractor will be responsible and accountable for such facilities accepted for use. The Contractor must ensure facilities remain suitable for their intended use and take all precautions to prevent safety hazards, odors, and vermin. Janitorial services for GFF must be provided by the Contractor at no additional cost to the FAA. At times, certain GFF may need to be utilized by FAA or other contractor personnel in support of the FAA’s mission. See Technical Exhibit I-5-1 for specific examples. The

Contractor must obtain written approval from the CO prior to making any modifications or alterations to the facilities. Any such modifications or alterations approved by the

FAA will be made at the expense of the Contractor. At the completion of the Contract all facilities must be returned to the FAA in the same condition as received, except for approved modifications and reasonable wear and tear.

5.1.3.2 Inventory and Maintenance/Repair of GFF

Equipment associated with the infrastructure of GFF (e.g. electrical, plumbing, HVAC systems) will be a part of the equipment inventory in the FMMS. Accordingly, PM/RS, RFM/RCR, and service calls for this equipment will be part of the firm-fixed-price portion of this Contract and handled in accordance with Attachment I, Section 3.

5.1.3.3 Availability of Utilities

The FAA will furnish the following utility services for use in GFF, and as may be required for the work to be performed under this Contract: electricity, telephone, natural gas, potable water, and sewage service.

5.1.3.4 Facility Safety Inspections

The Contractor must perform an annual inspection of all GFF to ensure safe use and/or occupancy. Facility Safety Inspections must be documented in a report and submitted to the COR during the transition phase, and once every calendar year until Contract completion. Facility Safety Inspections must follow and comply with OSHA 40 CFR

1610.

5.1.4 Government-Furnished Equipment (GFE)

5.1.4.1 General

The FAA will provide the Contractor the use of certain existing and available FAA-owned tools and equipment which are listed in Technical Exhibit I-5-2. The Contractor and COR (or other FAA-designated personnel) must conduct a joint assessment before

Attachment I, Section 5 – Property Management 3 starting work under this Contract in order, to determine the existing condition and serviceability of GFE. The Contractor must provide fuel for GFE when used by the

Contractor. Upon completion or termination of the Contract, all FAA owned equipment must be returned to the FAA in the same condition as received, except for normal wear and tear. Equipment, which becomes worn out due to normal wear and tear, must be returned to the FAA. The Contractor must provide the COR with an updated condition assessment of all GFE, in writing, on an annual basis within 30 days of the start of each

Contract year.

5.1.4.2 Inventory and Maintenance/Repair of GFE

The Contractor must administer a program for periodic servicing, maintenance, repair, calibration, protection, and preservation of all Government-furnished equipment listed on

Technical Exhibit I-5-2. The Contractor must conduct an annual inspection of all inventory, reporting at a minimum the equipment status, location, condition, and any additional information requested by the COR. The Contractor must document all findings utilizing Technical Exhibit I-5-32, and electronically submit to the COR no later than seven (7) days after the inventory was completed. The Government may request a walkthrough of all GFE inspections upon request. All Government Furnished Equipment will be listed in the FMMS with distinct PM procedures in order, to distinguish from other equipment. PM tasks will be scheduled and documented in the FMMS. Adds, deletes, and changes must be documented on RFM/RCR forms (see Attachment I, Section 3.1.6). All RFM/RCR for GFE will be processed as “no-cost” modifications.

Service calls must be requested, in the FMMS, by the Contractor or FAA, for repair needs, using the problem type “GFE”. Service calls with the problem type “GFE” will not count towards the not-to-exceed total listed in Section J, Attachment B-1 COMS

Pricing Schedule. The Contractor must furnish and replace all parts, subassemblies, and complete units that have failed or are failing to maintain the equipment in an operational condition at all times. The Contractor must install only original equipment manufacturer parts, or items of equal or better quality, in all instances where repairs are required or directed for the preservation of the equipment. See Attachment I, Section 3.2.1.1.3 for specific requirements pertaining to materials. The Contractor must maintain all appearances of the equipment by washing, cleaning, or painting.

The Contractor is responsible for the entire cost of the maintenance and repair program, with the exception of individual repair needs in excess of $10,000. The FAA may decide not to pursue needed repairs based on various factors including availability of funds or age/condition of equipment. The total or partial breakdown or failure of the Government-furnished equipment must not relieve the Contractor of responsibility to fully perform the work of this Contract. In the event the Contractor is unable to operate the Government-furnished equipment for any reason, the Contractor will, at their own expense, furnish the necessary equipment for continued performance of the services under this Contract. The

Contractor must provide report to the COR citing any change in operational status of

Government-furnished equipment within one (1) business day of the change.

Attachment I, Section 5 – Property Management 4

The use of Government-furnished computer equipment for other purposes is prohibited. The computer equipment will be provided on an availability basis through the FAA IT office. The servicing, maintenance, repair, connections, and upgrading of all computer equipment will be the responsibility of the FAA.

Contractor-provided software, such as a company accounting program and estimating software, will be permitted to be loaded into FAA-provided computers only with CO and

FAA IT approval. (CO/IT approval is needed to ensure the software is compatible with the hardware and is compatible with other software and the FAA’s network). Internet access, including e-mail, is already available. Note: from time to time the FAA will upgrade computers and software to remain compatible with the base-wide FAA system configuration and licensing requirements. Any changes to computer hardware or software will result in no additional cost to the Government. The Contractor may also be required to supply and maintain non-FAA network-connected computer equipment for the purpose of interfacing with specialty equipment or systems. These requirements will be specified in Attachment I, Section 5.2.2.3.
