About this file
This justification and approval document requests approval to use other than full and open competition for a sole source contract with Tridium for network controls as part of an HVAC system upgrade at the Dayton VA Medical Center. The project aims to improve a sub-specialty waiting area and involves upgrading existing exam rooms and corridors. Key details include utilizing a Tridium-based platform to integrate with existing building automation systems, conducting market research showing multiple sources can provide compatible network controllers, and determining pricing will be fair based on previous procurements. The contracting officer certification asserts use of other than full and open competition is necessary as only Tridium can meet integration needs into the current system.

PROJECT 553-19-103 Improve Sub-Specialty Waiting Area B310
JUSTIFICATION AND APPROVAL
FOR
OTHER THAN FULL AND OPEN COMPETITION
1. Requesting Agency: Department of Veterans Affairs
Engineering (138) 4100 West Third Street Dayton, Ohio 45428
Contracting Activity: Department of Veterans Affairs
VISN 10 Network Contracting Activity 3140 Governor’s Place Blvd Kettering, OH 45409
2. Nature and/or Description of the Action Being Processed:
Request approval to use other than full and open competition to solicit on a Brand Name Only to use “Tridium” building automation systems communications networks referenced in Section 23 09 23.
3. A description of the supplies or services required to meet the agency's needs:
As part of the project the HVAC system will be upgraded and will incorporate network level controllers with a “Tridium” platform. This type control system is being incorporated on all new and existing HVAC systems throughout the Dayton VAMC.
Estimated Value of the J&A requirement is $ .
4. An identification of the statutory authority permitting other than full and open competition.
This request is submitted pursuant to the authority of Title 10 U.S.C. 2304(c)
(1) or 41 U.S.C. 253(c) (1), which provides that full and open competition need not be obtained where there is “only one responsible source and no other supplies or services will satisfy agency requirements”. FAR Part 6.302-1(c) “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
A “Tridium” based platform is used throughout the medical center to achieve integration across all the building automation system in place.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized.
The Building Automation System (BAS) communication network that is used at the Dayton VAMC is a “Tridium” based platform. Integration into the existing system may only be achieved by each Network Level Controller (NLC) having a “Tridium” based platform There are multiple sources for these controllers;
“Tridium” simply refers to the manufacturer of the software (Niagara AX) that resides on the Network Controllers. This procurement will be competed / synopsized on www.fbo.gov and will indicate the requirement for brand name specification regarding the BAS communication network. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price.
7. A determination by the contracting officer that the anticipated cost to the
Government will be fair and reasonable.
There have been previous purchases for the “Tridium” based software. The Contracting Officer will be able to determine a fair and reasonable pricing based on previous procurement history and commercial pricing. The pricing will be determined to be fair and reasonable to the government based on competition and commercial price lists as applicable.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Market research has been previously conducted for prior projects, concerning this subject. Multiple manufacturers produce network level controllers that support a “Tridium” platform. Honeywell and Vykon are examples of these manufacturers. This product is open for the public to purchase, this allows any contractor who has been properly trained on the product to install. The certification classes are also open to the public. There are at least 2 contractors in the tristate area who currently can install these products.
9. Any other facts supporting the use of other than full and open competition, such as: N/A
10. A listing of the sources interested in the acquisition: N/A
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Solicitations for future requirements will utilize “brand name or equal” language, if it is in the Government’s best interest to do so. The current requirement must be solicited using a brand name description because the Government needs to create an exact copy of a system/item that is currently in use. The VA will continue to review the marketplace during future construction initiatives to determine if products have become available which meet the needs of the VA.
12. Certification requirement:
I certify the supporting data, including the statement of the Government’s minimum needs and other rationale for other than full and open competition is complete and accurate to the best of my knowledge. (FAR Subpart 6.303- 1(b)).
