About this file
This is a Buy American Certificate provision (FAR 52.225-2, October 2022) that establishes certification and disclosure requirements for offerors regarding the domestic or foreign origin of end products in federal procurements. The provision requires offerors to certify that all end products are domestic end products, except those explicitly listed as foreign end products. For any foreign end products that do not consist wholly or predominantly of iron or steel, offerors must indicate whether they exceed 55 percent domestic content, with the exception of commercially available off-the-shelf (COTS) items. Offerors must separately identify line item numbers for domestic end products containing critical components. The provision defines key terms including "COTS item," "critical component," "domestic end product," "end product," and "foreign end product" by reference to the Buy American clause in the solicitation.
This certificate applies to the Department of Veterans Affairs' solicitation 36C77026Q0091 for miscellaneous pharmaceuticals, specifically 1,200 units of Bariatric Multivitamin with Iron (90-count bottles, NDC 50415-0946-08) for delivery to the CMOP facility in Ladson, South Carolina. The acquisition is a small business set-aside with an estimated issue date of February 11, 2026, and a response deadline of February 24, 2026, at 9:00 AM CST. Award is estimated for February 27, 2026. The requirement has a 10-day delivery timeframe with FOB Destination terms. Offerors must submit pricing in the required Excel format, provide manufacturer information and product country of origin, and include proof of state wholesale distributor licensure demonstrating compliance with the Drug Supply Chain Security Act (DSCSA).
