| GREAT SUPPORT |
| RFP ATTACHMENT 8 |
| Company Name: | |
| Solicitation Number: | 47QFLA24R0013 |
Note to Offerors: Please provide the specific paragraph reference using the Section/Sub-Section numbers in the solicitation.
| QUESTION # | SECTION (TOR, PWS or Attachment) | PARAGRAPH/SUBSECTIONS # | PARAGRAPH TITLE | QUESTION | GOVERNMENT RESPONSE |
| 1 | PWS | C.12.1 | Transition-in Plan | This paragraph states, "The draft Transition-In Plan is due with solicitation response." Should this plan be submitted as a separate document, or should it be incorporated into one of the required volume documents (e.g., the Management section of Volume III)? | The DRAFT Transition-In Plan shall be incorporated in the Volume III - Element 1: Management Plan submission. Revised language is incorporated in paragraph L.6.2 and Section M under paragraph 2.1 |
| 2 | PWS | B.1.4 | Limitations on Subcontracting | Request the last sentence be amended to be in accordance with FAR 52.219-14 in whereas prime contractor will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. | Concur. Language has been revised in paragraph B.1.4 |
| 3 | PWS | B.1.5 & L.8 | Pricing Spreadsheet | As contractors will be bidding using rates from their GSA pricelists, will the Government allow a column to be added to the pricing spreadsheet to show the published rate and then the discounted rate? | As this is an open market acquisition, offerors are not restricted to their GSA schedule pricing. If the offeror elects to use their GSA schedule pricing or a discounted rate, then that rate should be entered in Column D of the Pricing Schedule. |
| 5 | PWS | C.5.0 | Performance Requirements Summary/Monthly Invoice | Request consideration be given regarding the Acceptable Quality Level (AQL). With ASSIST, the contractor is unable to retract an invoice once submitted (example to correct a minor discrepancy like omitting an attachment). To expect 100% accuracy for the life of the award (except the first two months) is not realistic. Would the Government consider no more than two violations per year? Should the GSA Pricelist be included as a separate tab within the spreadsheet? | Concur with the recommendation on the ACQ for monthly invoices. Revised language to read "No more that 2 violations the first 2 months after contract award. No more than 2 violations during each period of performance." See previous response above pertaining to the GSA Pricelist |
| 6 | PWS | C.5.0 | Performance Requirements Summary/Personnel Availability | Typical vacancy fills in other contracts are within 30 calendar days. We request the Government consider changing "10 days" to "30 calendar days". This will allow the necessary timeframe to locate exceptional quality of personnel. |
| In addition, to make it absolutely clear, we recommend any time "days" are referred to add either business days or calendar days for clarity. | The Government is adding "business" days to this requirement and additional "justification" language has been incorporated. | |||||
| 7 | PWS | C.5.0 | Performance Requirements Summary/Personnel Retention | Would the Government consider adding to the language regarding the 15% turnover that should turnover be due to personnel joining the Government, this does not count towards "turnover"? | The contractor is allowed under this AQL to submit any justification for failure to retain personnel for the Government's consideration IAW with this requirement. The requirement remains as is. | |
| 8 | PWS | C.6.0 | Estimated Level of Effort (LOE) | As it states that the LOE is not intended to be binding on either party or to be the only possible solution, are recommended changes to the LOE and Pricing Spreadsheet allowable? | For proposal purposes, revisions to the labor categories, skill mix, and estimated hours are prohibited. Paragraph C.6.0 provides each potential offeror a "projection" of workload based on historical data for planning purposes. The estimated LOE will be based on assigned projects and tasks at any given time. Positions and hours may fluctuate based those assigned projects/tasks. | |
| 9 | PWS | C.8.2 & C.10.0 | Travel Requirements/Other Direct Costs | As G&A is a cost to travel, ODCs, and materials, please confirm that G&A is allowable on travel reimbursement requests. | G&A on travel and ODCs is allowed in accordance with a contractor's cost accounting standards (CAS) disclosure statement | |
| 10 | PWS | C.9.2 | Proposed Staffing and Approval Upon Initial Contract Award | As stated in 2.0, this is a non-personal services contract. The contractor is to manage and organize resources and personnel needed to efficiently and effectively meet the objectives of each task. |
H.7.2 states "Do not permit government officials to interview potential contract employees....."
C.9.2 requires "receiving approval" of the proposed personnel and staffing level. Request the Government remove this requirement as it conflicts with 2.0 and potentially H.7.2.
| This requirement is to ensure the contractor adheres to the staffing plan as proposed specifically the Key Personnel requirement. The Government will not be involved in the direct hiring, management, supervision, or direction of contractor personnel. Therefore, this does not conflict with the definition of non-personal services nor paragraph H.7.2. | |||||
| 11 | PWS | G.1.0 | For Travel Reimbursable CLINs | Please clarify the statement regarding the funded amount not being a guarantee to the Contractor. | The estimated travel cost is based on historical data. The Government may fund the CLIN at the ceiling value; however, the contractor may not receive travel requirements during the period of performance that equals the total funded and/or ceiling value. Therefore, they would only be reimbursed for the "actual" travel costs incurred. |
| 12 | PWS | C.10.0 | Other Direct Costs | Please clarify whether the ODCs are ODCS or OLM. In addition, please confirm IFF is applicable to ODCs and should be included when invoicing. | OLMs are more commonly associated with task orders under schedules/BPAs contracts. ODCs will be utilized for this open market acquisition for any additional costs tied to the award that aren't considered standard direct labor or material cost. |
| 13 | PWS | G.2.3 | Final Invoice | While the LH rates are fixed, G&A on travel, ODCs, and materials are invoiced at provisional rates. Will the Government add a provision for quick closeout procedures? Otherwise contractor will be unable to final invoice within 30 days of completion as it takes DCAA awhile to audit and finalize indirect rates. | See paragraph G.4.3 |
| 14 | PWS | L.8 | Provisions Incorporated by Reference | Request removal of FAR 52.237-10 Identification of Uncompensated Overtime. F.1.3 Work Schedule specifically states that overtime is not allowed. | The provision is required in all solicitations above the SAT for professional or technical services to be acquired on the basis of the number of hours to be provided. GREAT Support meet these requirements. |
