RFI for RFI for Elevator Modernization at RFK Solicitation #47PM0123R0022 - EQWPIAA-23-0023

RFI Government's ResponseLine No.

Pre-Bid Survey Request – In order to submit an intelligent and comprehensive design/build bid for this project as required per the bid solicitation we will need to survey the following areas of all 17 elevator groups: machine rooms, elevator pits, top of the elevator shafts, elevator #24 overhead space from the roof, elevator cab interiors, top/bottom/one intermediate floor of each elevator group lobbies, main electric room(s) including existing automatic transfer switches and generator(s), fire control room, and existing elevator status panel. We will need to survey all 17 elevator machine rooms and one elevator pit/overhead/cab interior in each elevator group. We anticipate that this site survey will take approximately 30 minutes per elevator group for a total of about 8 hours. Please confirm when we can complete this survey either Friday July 7th or any day the week of July 10th

There will not be a second pre-bid walk-through for this project solicitation.

Please reference the existing RFK Building Elevator Tech Study by Reon, Inc / Lerch Bates/Eco Mar, LLC/ TCS Consulting dated July 5, 2019. All findings and and recommendations have been made regarding the replacements, reuse-retainage, and refurbishment of equipment bnased on code requirements, safety complinace, and customer preferenecs. The Design-Build General Construction team shall evaluate these findings and recomnedations and present their design document based on the results of those findings and recommendations, which the government shall approve during the design review process and final product submissions. The D-B Construction Contractors bid proposal should be based on tne SOW presented and RFK Elevator Tech Study referenced.

Construction Work Hours – Please confirm that onsite construction work hours of 6am to 2:30pm are acceptable for the entirety of this project. Please confirm if there will be any limitations due to standard noise (not excessive) or working in public spaces (elevator lobbies) during those hours. When are US courts in session and will normal working hours between 6am to 2:30pm on M-F weekdays be allowed while courts are in session?

The government uses an 80-hours per week base calendar for its design & construction projects. The SOW list the building hours for operations and visitor access. However, the design-build construction team may choose to occasionally plan some tasks, work activities, and project resources outside of the typical building hours with approval from the government. The GSA PM, GSA BM, and CMa associates will coordinate all work tasks that requires outside hours, such as, early starts, special deliveries, demolition, noise-making activities, removal of equipment, pre-testing, final testing, commissioning, and acceptance, with the tenant-agency staff and agency security. According to the DC Noise Control Act, standard maximum noise levels for commercial buildings in DC is limited to no more than 65 decibels (dBA) during the hours from 7 am - 9 pm. The contract should plan accordingly for work activities to be completed during building unoccupied times that will exceed the maximum noise level. The design-build GC, GSA PM and DOJ staff will coordinate all actvities that will exceed the maximum noise levels at least 2-weeks in advance of the requested actvitity.

Minority Participation Requirements – There is a 35% total participation goal, 28% minority and 7% female participation goal for this project to hire contractors that meet those owner qualifications. Please confirm whether this is a goal or a requirement. The majority of this project is elevator related work at roughly 70-80% of the entire project value. Four elevator bidders were present at the pre-bid meeting and none meet the minority/female qualifications set forth. With that said, it is impossible for any of the current bidders to meet these goals due to the nature of the specialized work on this project. Please also confirm whether the recent Supreme Court ruling on affirmative action in public university institution admission policies will have any impact on the stated Executive Order 11246 GSA Inspection Requirements – Please confirm who will have inspection jurisdiction over this project. Please confirm that DCRA will not be involved

GSA utilizes third-party elevator inspection services. DCRA will not be involved with our elevator inspections.

Asbestos & Lead Paint Requirements – Please confirm that the contractor will not be responsible for any asbestos or lead paint testing or remediation services on this project.

The Design Build General Contractor shall be resposnible for any testing requirement and incidental environmental abatement that may be requirted primarily in the elevator hoistway and elevator lobby ceilings.

Design Changes Process – Please confirm that we are to propose a design/build scope of work that meets IBC, ASME A17.1, and NFPA code requirements.

Please confirm which code year for the ASME A17.1 code we are to design this project to. The Lerch Bates Technical Study references the ASME A17.1 2016 code, but that study is four years old. Please confirm if we are to include non-code related items in our bid proposal as add alternate options (ie. machine room painting, pit painting, etc.) for scope items that are not required to meet code. Please confirm that our design scope will be accepted prior to the contract award at a lump sump fixed cost proposal to complete the proposed design meeting all code requirements and that design changes as requested by the GSA after the project award will be an adjustment to the contract via change order.

GSA adopts the "latest and greatest" code as it becomes available. Suggest that you bid per the SOW.

-"Please confirm whether this is a goal or a requirement." Answer: The Minority Participation Requirement is a goal.

-"Please also confirm whether the recent Supreme Court ruling on affirmative action in public university institution admission policies will have any impact on the stated Executive Order 11246". Answer:

Please note as stated above the Minority Particiaption Requirement is a "goal" and as of this moment, we have received no direction to state whether the Supreme Court Ruling will have an impact.

(see Eco Mar, LLC report in the RFK Elevator Tech Study dated July 5, 2019.)

7/13/2023 3 of GSA RFI Responses

Elevator Machine Room HVAC Design Intent – Please confirm the design intent for the elevator machine room HVAC units. There are existing Mitsubishi HVAC units currently sitting on the machine room floors in many of the elevator machine rooms but they are not hooked up or currently functional. The Lerch Bates Elevator Modernization Technical Study appears to be outdated since it was completed four years ago in respect to the existing conditions in the machine rooms as it relates to the current ventilation systems. Please confirm machine room HVAC design and construction intent. Are the existing Mitsubishi HVAC units anticipated to be installed by the contractor as part of this project, if so please provide an inventor of the pre-purchased machine room HVAC units?

Or will they be installed separate to this project prior to the elevator modernization work starting?

The Mitsubishi VRF units will be installed under a separate GSA BA54 Repair and Alterations project and will be completed prior to the construction start of the RFK Elevator Modernization start. The Design Build General Contractor should provide a separate quote for the Elevator Machine Room HVAC purchase and installation, which may be removed at the government's descretion.

Elevator Pit Sump Pump Design Intent – Please confirm whether or not sump pumps will be required to be installed in all of the elevator pits. Currently there are no sump pumps in the elevator pits. The Lerch Bates Technical Study recommends surface mounted sump pumps to be installed in all elevator pits.

Please confirm if this will be required since different jurisdictions interpret the ASME A17.1 elevator differently in respect to the requirement for sump pump installations in elevator pits on elevator modernization projects.

Please follow the Reon, Inc / Lerch Bates recommendations to provide surface-mounted sump pumps in the elevator pits.

Bid Date Extension Request – The current bid due date of Wednesday July 19, 2023 is not enough time to provide a well informed technical and price proposal for this major project. It leaves us with 10 working days after the July 4th holiday to compile this design/bid proposal which is not sufficient time to provide a price competitive bid proposal. Additionally subcontractors typically need to get pricing to the Prime contractor one week before the bid due date to allow enough time for the prime contractor to compile a full bid proposal. A typical bid timeframe for this size project is six weeks. Please confirm if the bid due date can be extended to Friday August 11, 2023.

See repsonse to RFI #1.

7/13/2023 4 of GSA RFI Responses

Item 2.3.1 (c)(8)-(9) of the Statement of work specify complete design-build HVAC solutions for the elevator machine rooms. At the pre-bid site visit, we noted that several machine rooms contained Mitsubishi Electric units, some still wrapped in plastic. Please confirm whether we should include these units in pricing or whether a new turnkey system should be designed and installed.

See Reponse to RFI #7.

Item 2.12, specifically at 2.12 of the statement of work specifies the inclusion of fire protection modifications, specifically the modification of the existing sprinkler system. P-100 is somewhat at odds with A17.1 on the inclusion of sprinklers in machine rooms. P-100 defers to the regional fire protection engineer (FPE) on whether sprinklers should be active in machine rooms. Sprinkling mach rms has fallen out of favor as machine rooms should generally have no flammable material in them, thus obviating the need for sprinklers. Regional GSA FPEs are beginning to remove sprinklers from machine rooms. Does the FPE with oversight of this project have a strong opinion on the inclusion/exclusion of sprinklers in the machine room? Please advise.

The fire spinkler system alterations/modifications should be designed per the PBS P100. The GSA Fire Protection Engineer will be involved during the design stages of this elevator project. The decsion to later cap the sprinkler drops in the EMRs shall be at the giovernment's decretion at a later time or under a completely separate stand-alone fire life safety project.

Please share As built drawings.

As-Built drawings & O&M Records will be available after award. The Final Tech Study TReport was used as the basis of the SOW and shall be used as the basis for the Design-Build Construction proposal(s).

Based on the pre-bid, GSA will award:

Base bid – Design portion only Option 1 – 8 elevators only.

Is this correct?

It is our hope to award both the Base and excercise Option 1 at award. However, this will be determined by funding.

Please confirm the 540-day contract term is for the base bid and Option 1 only. YES. Correct.

Please confirm anticipated project timeframes. At present it appears anticipated timeframe is insufficient for work scope and does not match the estimated schedule. For instance, Phase 1 appears to be 905 days compared to the 758 days stipulated in the solicitation offer. Additionally, based on our reading, bidders will be required to procure materials during and before the end of the DB portion of the contract is fulfilled. Please provide your agreement and/or direction concerning this matter.

a. Please provide overall schedule for bidders to use.

It is not the government's intent to dictate means and methods or curb creative ways that the design-build teams operate under this contract award. However, the Design-Build Construction team will need to determine if the period of performance to verify that the project timelines associated with their indiovidual proposals are reasonable for each of the options listed.

a) The initial contract award for the Base Contract includes the Design of 30 elevators, plus Option 1 which includes the Constyruction of eight (8) elevators. The effort will take 540 calendar days.

The Design-Build Contractor should focus on prioritizing the Option 1 elevators and order to expedite the design approval, equipment selection, and government approval of the initial eigt (8) elevators for factory release, delivery, and on-the-job installation.

If the response to question 1 is “yes”, please confirm bidders still need to provide pricing for Options 2-4. Is this correct?

b. Please confirm bidders will be allowed to escalate pricing for the differencing in prices quoted vice prices when materials are purchased.

c. Please confirm bidders will be allowed to escalator pricing for the difference in labor rates from 2023 to the current price when and if Options 2-4 are awarded.

d. Please confirm GSA is aware of extended lead-times regarding material t i h O ti 2 4 t ti ll d d th ill b

Yes, Contractors will need to provide pricing for Options 2-4.

a. Bidders are to provide prices for base and all options. The timeline or target dates when these options will be funded is at the governments discretion.

b. Bidders shall price inaccordance to their needs. If at any time the contractor should wish to escalate pricing for the differencing in prices quoted vice prices when materials are purchased they should submit the request to the Contracting Officer in writing and a determination will be made at that time.

c. Bidder shall provide current pricing

Options 2-4 are awarded, they should submit the request to the Contracting Officer in writing and a determination will be made at that time.

d. Yes, GSA is aware of extended lead-times regarding material.

If at any time the contractor should wish to escalator pricing for the difference in labor rates from 2023 to the current price when and if

7/13/2023 6 of GSA RFI Responses procurement, meaning when Option 2-4 are potentially awarded there will be significant downtime between award and work.

e. How will this affect bonding? Will bidders need to keep insurance and bonding open for the entire project, or individual insurance/bonding be permitted based on award of each option?

e. When it is determined that an Option will be exercised, the awardee will be advised if it will require a bonding will increase.

In the body of the specification reference is made to Mega construction project.

If the project is awarded in segments and award value is less than $35M, does the Mega construction project requirement become non-applicable? Please advise. Reference Solicitation (Section III.K. Mega Construction Project Program)

Please confirm the project is subject to and awarded contractors will be bound to uphold PLA (Project Labor Agreement) requirements.

a. Please confirm if contractors need to meet/comply with PLA this requirement applies to all prime and subcontractors. Is this correct?

Reference the Davis Bacon Requirements

Yes

Please confirm small business criteria and goals to be implanted on this project. Reference page 17 of 39 Please confirm awarded contractors need to comply with the following FAR Cost and Pricing Data requirements:

a. FAR 52.215-2

b. FAR 52.215-10, 11, 12, 13 & 15.

Confirmed. Access doors are accessible. The Design-Build Contractor shall be responsible for making repairs and match existing finishes.

Although the project is considered a design build, please confirm contractors are only allowed to use non-proprietary equipment. Meaning any equipment installed should be of a type and nature that allows anyone to attend factory training and that 100% replacement parts be available for procurement from anyone.

NON-Proprietary equipment only.

Reference Line No. 13

The slide deck will be provided via amedment

Please confirm all elevator machine room trap doors are accessible and can be used during the project. During the site visit we were not allowed to open any existing trap doors, but we were informed all the doors are in working order with access available. However, when we visited the area beneath the trap doors it appeared the openings were covered by sheetrock. Please verify what material is covering the trap doors and who will remove and/or replace it once the project is over.

Confirmed. Access doors are accessible. The Design-Build Contractor shall be responsible for making repairs and match existing finishes.

Can the building provide any rating or floor loading for the staircases near the elevator lobbies? Our main concern is the area directly below the trap doors.

Please advise.

The structural loads for most federal buildings is 100 pounds per square foot. Placing a 0.75-inch x 4-ft x 8-ft plywood underneath the trap doors will not only protect the floor finishes but also dispurse the weigh across a broader area.

Please provide the sign in sheet from the walkthrough.

Please provide the slide deck from the pre-bid meeting.

7/13/2023 7 of GSA RFI Responses

Because we did not see every elevator on the walkthrough, please provide a list of elevators that have main and auxiliary COPs. No additional information will be provided at this time.

Please confirm if any fixture cover plates are aged or lacquered bronze. Several elevators we looked at appeared to have bronze fixtures. Some were regular and some appeared to be oil rubbed or aged. Please confirm which elevators have aged bronze fixtures.

The original hall fixtures are recommended to be refinished and upgraded with LED bulbs and all others to be replaced with new matching fixtures on levels 1-5. This work should be coordinated with the elevator control upgrades that have been replaced to match historical style and shall to be completed with elevator modernization. Due to the unique cast aluminum fixtures associated with the 26 passenger elevators, cars and hall fixtures for all 25 passenger elevators should be purchased at one-time/ single package under the first phase of the project. Doing so will ensure best pricing and matching fixtures.

Please confirm freight elevator loading classification. Are the freight elevators C1, C2 and or C3 rated? All four (4) freight elevators are 5,000 pound capacity, C1 Loading.

During the site visit we noticed open and/or available space in the attic area. Will contractors be allowed to use the space outside the machine rooms for staging materials onsite?

Yes. The GSA PM and DOJ Facility Management Staff will coordinate How much of the area can be used for staging. Maintaing a clean, safe, and accessible egress pathway will be paramount to determining the boundaries of the staging area.

Will any space be designated as an on-site office for the contactors project management team? See RFI #32 Response.

a. Any activity that produces noise (>65 dBA) or odor (welding, brazing, painting, and etcetera) space within the building is subject to be stopped during occupied hours. See RFI # 2 Response.

b. The U.S. Courts schedule is updated every 2 weeks. This project will require weekly coordination between the GSA PM, DOJ Facility Mgmt Staff, and the D-B Contractor during the construction phase.

Please describe in detail how bidders will handle maintenance of the existing elevator equipment during performance of the modernization. Is the expectation the awarded contractor will assume maintenance of all elevators in the building or assume maintenance of the awarded units? Is the government anticipating bidders will provide elevator maintenance as part of the bid and award of the Base bid and Option 1 also include an elevator maintenance agreement? If yes, please provide any details regarding current/ongoing and after project completion of how elevator maintenance will be handled.

a. Please provide a specification for any/all elevator requirements.

b. Please confirm awarded bidder will not be responsible for returning units to service that area currently out of service. During the walkthrough it was noted that several units were locked out and parts were cannibalized from the units that were out of service.

The elevator modernization project does not include maintenance of the elevators. Upon immediate shutdown and demolition of the individual elevators or elevator group (aka Option) the Design-Build Contractor shall be responsible for all aspects of maintaining safety and limiting liability in completing trhe required work per the contract. Upon final testing, commissioning, and acceptance of the elevator(s) under each option and the typical 30-45 day elevator adjustment period, the operation and maintenance (O&M) of the new elevators shall be the responsibility of the O&M/Contract Facility Managenment vendor for the RFK Building. The standard one (1) year warranty for labor and materials shall apply to each elevator

a. Not applicable.

b. Elevators that have been locked out by the elevator O&M contract shall remain locked out if the GSA and DOJ choposes to do so. These will fall into the same sequence of work as per the SOW. The design-build contractor will not be asked to make O&M repairs or perform "double-work" before completing the modernization under this contract award.

cannot be accomplished in “adjacent spaces” and/or while US courts are in session.

a. Please confirm which elevator machine rooms and elevator lobbies are considered adjacent space.

b. Also is there a tentative US Courts session calendar?

7/13/2023 8 of GSA RFI Responses

Throughout the specification reference is made to the historic elevator fixtures on levels 1-5. Please confirm exactly what elevators this is referring to and whether refurbishment is wanted.

See RFI #30 Response.

Please verify, via a list, which elevator cabs are considered historic and set to be refurbished and not replaced.

a. Please confirm how the refurbishment process will work. Specifically, timelines. Past experience has proven historic cab renovation can take months in the planning phase which usually results in an overall contract duration extension.

Please read "Page 100" of the the Reon, Inc / Lerch Bates Elevator Tech Study dated July 5, 2019 have made recommnedations to repair and refurbish many of the existing cabs and cab fixtures.

Elevator cabs that would require restoration of interior woodwork, finishes, and fittings are the following:

Group 1: (Elev. 1-4 & 6), Group 2: (Elev. 37-39), Group 3: (Elev. 32-35), Group 4: (Elev. 28 & 30), Group 5: (25 & 27); Group 7: (Elev. 7-9), Group 8: (Elev. 12 & 14), Group 9: (Elev. 15 & 17) and Group 10: (Elev. 20 & 22). Elevators 11, 23, and 19 currently lack historical features requiring restoration.

Elevators 10, 24, 31, and 40 are service elevators without historical features.

a.GSA NCR Office of Historic Preservation and the SHiPO (Gary Porter) will review design documentation, design suggestions, and metallic samples from conservators / metal refinishers and for approval. The process typically occurs during the inital design phase

Please confirm elevator hoistways (29, 26 & 18) are blank and the specification does not include any work regarding these units including but not limited to bidders installing elevators in these open elevator shafts.

Confirmed. The elevator hoistways at 29, 26, and 18 are blank. This contract does not include any work to re-install or re-establish these elevators.

The specification stipulates that the existing elevators are roped in a 2:1 configuration. During the site visit it was noted that the elevators are wrapped in a 1:1 Double wrapped configuration. Please confirm if the specification intends to retain the 1:1 double wrap configuration or is it the intent to move to a 2:1 roping configuration.

Move to a 2:1 roping for all passenger and maintain 1:1 roping for the four freight elevators.

Please confirm the warranty period for elevators turned over after Option 1 is complete. At present it is unclear when the warranty starts/ends for Option 1 and how the warranty is affected by the potential award of Options 2-4. Please provide an example detailing how the warranty will work regarding acceptance of an elevator and timeframe warranty will be intact.

The warranty period of 1 year on material and labor for the elevator modernization begins 1 day after government acceptance of any single elevator or elevator group. The elevator warranty periods for the subsequent Options will be staggered by virtue of the government's acceptance dates. The execution of an extended warranty period to align all elevator options into a single warranty period is highly unlikely and not feasible under the current scenario.

Evaluation Factor 1 requires a value of total project construction at award of no less than $8M for a minimum of 10 elevators. At present, most elevator projects, not unlike this one, are awarded in phases and many utilize new contracts for each phase. Are bidders allowed to use an aggregate, multiple projects from the same owner/agency within the timeframe to meet the $8M minimum value?

a. If not, please consider reducing the overall value to ~$3.5M per contract.

Yes, bidders allowed to use an aggregate, multiple projects from the same owner/agency within the timeframe to meet the $8M minimum value

Considering the size and scope please consider extending the bid date to 21 days after answers to questions are provided. See RFI # 1 Response

7/13/2023 9 of GSA RFI Responses

Solicitation Section II.D. Technical Proposal: Factors 1 and 2 – Due to the high number of elevators on this contract, please consider lowering the contract value threshold requirement to $3,500,000 and six (6) elevators as design-build elevator modernizations over $3,500,000 and more than six (6) elevators are less frequent.

No, We will not lower the contract value threshold

Solicitation Section II.D. Technical Proposal: Factors 1 and 2 – Can the value of the submitted construction projects be escalated to current approximate values?

To clarify - If we submitted a bid 6 years ago for $6,000,000, it is possible that the same project would bid for a value of $8,000,000 today due to various material, labor, and equipment cost escalations. Will the offeror be able to escalate the value of the previously completed projects (as originally bid) to account for inflation of costs in today’s dollars?

For example if we would like to submit project X which we bid in 2018 for $7,500,000, are we able to provide within our technical submission both the original value of $7,500,000 and the escalated 2023 value of Project X of $8,500,000, and if yes will the escalated value be the value evaluated by the government for the submitted project?

Please confirm that GSA considers “freight/service” elevator no.’s 10, 24, 31, and 40 to be “passenger elevators” as defined by ASME A17.1, Section 1.3. The classification of an elevator as “freight” or “passenger” is a key factor in determining whether sprinkler protection can be omitted from the hoistway overhead. NFPA 13-2022, Section 9.3.6.6 only permits sprinklers to be omitted from passenger elevator hoistways. The terms “freight” and “service/freight” are used interchangeably throughout the Statement of Work and throughout the 2019 Elevator Mod Tech Study when referring to elevators 10, 24, 31, and 40. b PBS P100, Section

3.6.4.3 classifies “freight/service” elevators to be passenger elevators, however ASME A17.1 does not recognize or define the term “freight/service elevator.” ASME A17.1, Section 1.3 defines an elevator as either a freight elevator or a passenger elevator. Please advise

The four (4) elevators, E;levators #10, 24, 31, and 40 shall be designated as "Freight". All are 5,000 pound capacity, C1 loading.

The Scope of Work, page 17 of 69 (fire protection paragraph), states “The current system is lacking an integrated recall system and will need to be incorporated.” During the site walk, we observed that there appear to be fire alarm control relays in each elevator machine room. Please provide additional details on what is meant by the system is lacking an “integrated recall system.”

The current elevator recall system is not tied into the building's main fire alarm control panel.

Elevator Recall System Panel is meant. The current elevator recall system is not tied into the building's main fire alarm control panel.

Are pressurization (smoke control) systems present in any of the elevator hoistways? NO.

Is it the intent to require the installation of a dedicated function fire alarm control unit (as defined by NFPA 72-2022 Section 3.3.115.2.1) for each group of elevators?

YES. The elevator recall system shall be new.

7/13/2023 20 of GSA RFI Responses

The Scope of Work, page 20 of 69 (second to last paragraph), states, “Firefighters’ elevator provisions should be addressed where possible.” Please provide more details on what is meant by “Firefighters’ elevator provisions.” Did the writer mean that “Firefighters’ Emergency Operation – Phase I (manual and automatic recall) and Phase II” should be addressed?
