About this file
This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives and Office of the Government Records Ombudsman. The form is designed to allow businesses to request confidential treatment of certain submitted records under Utah Code § 63G-2-305, specifically protecting trade secrets and commercial financial information that could potentially result in competitive injury if disclosed. The form requires businesses to provide a concise statement supporting their confidentiality claim and mandates that they submit both a redacted and non-redacted version of their proposal.
Key procedural requirements include that the confidentiality claim must include specific justification for protection, be submitted with the original information, and cannot involve completely redacting an entire proposal. The Division of Purchasing will not perform redactions on behalf of the claimant, and making a confidentiality claim does not guarantee the information will be permanently classified as confidential if a public records request is subsequently made. The form provides fields for company information, details about the confidentiality claim, specific page and paragraph references for confidential content, and requires a signature and date to validate the request.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
